A RESOLUTION GRANTING A ONE-YEAR EXTENSION OF'
A CONDITIONAL USE AS LISTED IN ORDINANCE NO.
6871, AP.TICLE XV, SECTION 2 (8) ( a) TO PEP.MI T
CONSTRUCTION OF A 13-STORY PARKING GARAGE AS
PART OF A 36-STORY MIXED USE
RETAIL/GARAGE/OFFICE STRUCTURE CONNECTED TO
AN EXISTING 12-STOPY OFFICE BUILDING (CITY
NATIONAL RANK BUILDING), LOCATED AT 25
NORTHWEST MIAMI COURT AND 25 WEST FLAGLER
STREET, ALSO DESCRIBED AS LOTS 5, 6, 12 AND
13, BLOCK 115N, MIAMI NORTH, (B-41) AS PER
PLANS ON FILE; ZONED C-3 (CENTRAL
COMMERCIAL). THIS CONDITIONAL USE IS IN
CONJUNCTION WITH A VARIANCE FOR HEIGHT,
NUMBER OF OFFSTREET LOADING SPACES AND
PERCENTAGE OF OFFSTREET PARKING SPACES, AND A
PETITION FOR REDUCED OFFSTREET LOADING
SPACES.
WHEREAS, Article XXXII of the Comprehensive Zoning Ordinance
No. 6871, permits the City Manager, with approval of the City
Commission, to grant an extension of a conditional use approval
for a period of one year; and
WHEREAS, the City Manager recommends such an extension of
the conditional use approval granted by Zoning Board Resolution
No. ZB-104-83, dated June 20, 1983.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The request for a one-year extension of a
conditional use approval granted by Zoning Board Resolution No.
ZB-104-83, pursuant to Ordinance No. 6871, Article XV, Section
2(8)(a) to permit construction of a 13-story parking garage as
part of a 36-story mixed use retail/garage/office structure
connected to an existing 12-story office building (City National
Bank Building), located at 25 Northwest Miami Court and 25 West
Flagler Street, also described as Lots 5, 6, 12 and 13, Block
115N, Miami North, (B-41) as per plans on file, zoned C-3
(Central Commercial) in conjunction with a variance for height,
number of offstreet loading spaces and percentage of offstreet
parking spaces, and a petition for reduced offsteet loading

PLANNING DEPT. APPROVAL OF THE CONDITIONAL USE PARKING AND HEIGHT VARIANCE;
t DENIAL OF THE VARIANCE REQUESTS FOR COMPACT PARKING SPACES,
OFF-STREET LOADING SPACES, AND REDUCED LOADING BAYS.
Off -Street parking is a necessary component of a•mixed use
development. Four hundred and one parking spaces are being
i provided for the 293,482 gross square foot building or a
ratio of 1 space per 732 square feet of gross floor area.
The City has consistently approved variances for the height
of a structure in the C-3 zoning district. The 425' height
will not have an adverse impact on surrounding properties.
The request for a greater percentage of compact parking
spaces (63% vs. 40% allowed) is not in keeping with
current demand and usage. Off-street loading spaces are
necessary for proper development. New Zoning Ordinance
9500 would require 6 off-street truck loading bays
12' X 35'. Truck loading bays must be of sufficient size
to accommodate deliveries from large trucks (see previous
recommendations on Ordinance 9500).
PUBLIC WORKS: Request the dedication of the north 10' of lots 5 and
6 and also the south 5' of lots 12 and 13.
METRO-DADE PWD The PWD recommends against the requested variances
of required number and size of loading spaces.

The subject resolutions were approved on June 20, 1983
by the City of Miami Zoning Board, as indicated by the
attached copies of said resolutions and letters from Mr.
Teres-Lagoaes. The six month period for the conditional use
`t and variance approvals are -set to expire on December 20,
1983.
On behalf of the applicant, City National Bank of
Miami, we hereby request a one year's extension of said
approvals so final project planning can be completed on a
reasonable time table before construction must commence.
We submit that substantial. progress has been achieved
in terms of project planning to date as follows:

gressing towards completion for the hiring of a
general contractor.

expected to occur before the end of the year.

Wingerter Laboratories, Inc. for foundation design
and planning.

Gentlemen:
This letter of intent accompanies the zoning application of
City National Bank, et al., for property located at the southeast
corner of the interseetlon of N.W. First Street and N.W. lriiami
Court., lots 5 and 6, Mock 115N, City of Miami (Plat $ook D, 1bage
41, of the Public Records of Dade County). The applicant pro-
poses a thirty-six level mixed -use project including two levels
of retail, thirteen levels of parking, seventeen levels of
office, three mechanical and roof levels and a circular rooftop
restaurant at the thirty-sixth level for an approximately 425
feet high structure. The building will be constructed in two
phases, with the retail, parking and possibly two office levels
constituting the first phase of the project.

1) Conditional Use for Parkins Garaae.
The applicant requests that a conditional use permit be
granted in accordance with Article XV, Section 2(8)(a) and Arti-
cle XXXII of the Zoning Ordinance of the City of Miami, to con-
struct the approximately 401 space parking garage as described
above and as shown on the plans accompanying this zoai•nq applica-
tion.
The granting of the conditional use is in the public inter-
�± emt and will not adversely affect the public interest, welfare,
and safety in .any any. She plans of this project clearly depict
the in which Inqrew and egress have been prow ded for
with attention to automotive and pedestrian safety and conve-
nience, and traffic flow and control. Ro adverse effects are
expected -an adjacent properties anal properties generally in the

been demonstrated for this facility in downtown Miami. Our
-traffic consultant, David Plummer and Associates, has analyzed
the demand for parking created by this project's proposed retail -
office uses and surrounding uses, and has concluded that the
demand justifies the proposed use. Report enclosed as Exhibit
"A". The garage will adequately serve the building in which it
will be I , 1- 14, as well . as the area in which it is proposed.
Mr. P-Immaer's analysis fort er establishes that the traffic gen-
erated by this structure will not detract from existing levels of
.service an the roadways in downtown Miami.
21 $eight Variance for 425 Feet Parking -Office Structure.
The applicant -requests that a variance be granted fra® the
300 feet height limitation in Article XV, Section f to a11ow
Constrnctivn of this proposed mixed -use building #o a beight of
approximately 425 feet as shown on the plans accompanying this
application. The reasonable use of property in the C-3 district
in downtown Miami has of recent years been equated with high-rise
mixed -use structures. Buildings are being constructed in excess
of 500 feet high at the present time in this district, and the
300 feet limitation seems neither desirable nor practical.
Literal interpretation of this limitation would deprive the
applicant of rights commonly enjoyed in this district and would
create an undue and unnecessary hardship on the applicant. No
special privilege is requested. Other buildings in this district
which either ,presently or in the future are proposed to exceed

Financial Tower (765 feet), Edward Ball Building - Miami Center
(485 feet), Theodore Gould proposed building (825 feet), Freedom
Tower project (680 feet). The variance, if granted, will be in
harmony with the general intent and purpose of the zoning ordi-
nance, and will not be detrimental to the public welfare. Fur-
ther, the FAA has determined that the proposed structure will act
-be a i.ssrd.to AIX savhgation. See enclosed Exhibit "B". 2t is
also exceeded in -height by the new Dade Administration Building
(5.17 feet) two blocks to the west, which the FAA has similarly
determined was not an a hazard. See Downtown Government Center
- phase one ems.-- _mt Order. luly • 1981.

3) Variance to Allow in Excess of 40 Per Cent Compact
Spaces.
The Appifcaat retests a variance from the requirements of
Article =11, Section 2, of the Zoning Ordinance to allow
approximately 252 out of 401.spaces, or approximately 63%, to be
2 -compact spaces (40% allowed),. While Article XXIII, Section 1
exempts structures within the C-3 district from the off-street
:pazkiaq s of that article, the language of Article
I -Section 2(2) states that its off-street parking provisions
apply for I arkiYtg spaces 'required or provided."
The use of smaller sized cars In the gaited States is
cieazly an. estabUsbed tremd that iias been magoiug for some tim
now. The probability is that a greater number of people will
have smaller cars than larger cars in the future, and the design
of parking facilities for use into the end of the twentieth and
beginning of the twenty-first centuries should follow this trend.
The imposition of this requirement on the applicant therefore is
an unnecessary hardship. Furthermore, the size and configuration
of this parcel limits the number of spaces which can be provided
to serve larger cars, and in order to provide the necessary
number of spaces to support this project, the ratio of compact to
regular size spaces must be modified to provide a workable garage
design. ,

privilege is created by granting this request, and the purpose
and intent of the zoning code are upheld.
4) Variance to Allow 2 Off -Street Loading_ Spaces.
3'he applicant Requests that a variance be granted from
Article XXIII, Section 7, of the Zoning Ordinance to allow two
(2) off-street loading spaces (five (5) required). Off-street
loading spaces -are calculated based upon the square footage of

5) Approval of Reduced Size Off -Street Loading Spaces.
Applicant requests approval of reduced size off-street load-
ing spaces, in accord with Article XXIII, Section 7(8) of the
Zoning Ordinance, to allow 12 feet by 35 feet loading spaces (12
feet by 45 feet required).

As stated above, the deliveries associated with this struc-
ture will not be such as to normally involve service by vehicles
requiring the 45 feet loading space length required by the Zoning
Ordinance. Furthermore, the size and configuration of the site
preclude the applicant from providing spaces of the size re-
quired. Article XXIII, Section 7(8) specifically recognizes such
r_irzamstan s and authorizes the Zoning Board to reduce the
required dimensions upon such findings. Furthermore, the new
Zoning Ordinance provides for a loading space dimension in accord
i with the dimensions applicant proposes: 12 feet by 35 feet. See
Proposed Zoning Ordinance 52023.2. In accordance with the above,

result in an mmeccessary Hardship on the applicant and the
granting of this request will not adversely affect the public
Ir interest, ve3.fare, and safety the applicant requests approval of

We relieve that the sought after approvals are totally con-
sistant with the City of Miami Comprehensive Neighborhood Plan
6(1976 - 1986) which identifies the site in the Central Business
District and recommends that development in this area:
"Provide a wide variety of businesses
and residential opportunities within an
intensely developed urban center offering a
range of commercial, cultural, recreational
facilities, 24-hour activities, a pedestrian
orientation, and a sensitive response to the
climate and culture."
