S33-10 4 A RESOLUTION REVERSING THE ZONING BOARD'S GRANT OF VARIANCE FROM ORDINANCE N0. 6871, ARTICLE IV, SECTION 11(1), WHICH PERMITTED THE CREATION OF A LOT DESCRIBED AS TRACT "A" TENTATIVE PLAT #1151-D, "GRANT SUBDIVISION" ALSO DESCRIBED AS APPROXIMATELY 3639 NORTH- EAST MIAMI PLACE, AS PER SURVEY ON FILE, WITH AN AVERAGE WIDTH OF 28' (60' REQUIRED); AND A SECOND STREET FRONTAGE OF 25' (30' REQUIRFD). WHEREAS, the Miami Zoning Board at its meeting of May 16, 1983, Item No. 2 following an advertised hearing, adopted Resolution No. ZB 83-83, by a 5 to 0 vote GRANTING a variance as hereinafter set forth; and WHEREAS, the objectors have taken an appeal to the City Commission from approval of the variance; and WHEREAS, the City Commission, after review and upon careful consideration of this matter finds that there are no peculiar circumstances affecting this parcel of land, and no practical difficulties or unnecessary hardship that would impair the owner's right to the reasonable use of the property without the variance which has been granted as set forth above, nor any other basis upon which to grant a variance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Board's grant of variance from ordinance No. 6871 ARTICLE IV, Section 11(1), to permit the creation of a lot described as approximately 3639 Northeast Miami Place also described as Tract "A" tentative plat #1151-D, "GRANT SUBDIVISION" , as per survey on file, with an average width of 28' (60' required); and a second street frontage of 25' (30' required is hereby reversed. Approval Subject to Unity of Title The method ot determining average of width in this instance does not work and is not logical as the western portion of the site meets the average*lot width by itself. The unity of title will assure that the northeastern portion (25') will not be sold off as a separate site. PUBLIC WORKS Dedication is required by plat DADE COUNTY TRAFFIC Recommends that the eastern portion of Tract "A" which fronts on N.E. 1st Ave not have vehicular access to N.E. 1st Ave for lack of on site turn around.
