ORDINANCE NO. 9745
AN EMERGENCY ORDINANCE MAKING APPROPRIATIONS FOR THE
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1984; AUTHORIZING
THE DIRECTOR OF THE DOWNTOWN DEVELOPMENT AUTHORITY TO
INVITE OR ADVERTISE FOR BIDS FOR THE PURCHASE OF ANY
MATERIAL, EQUIPMENT OR SERVICE EMBRACED IN THE SAID
APPROPRIATIONS FOR WHICH FORMAL BIDDING MAY BE REQUIRED
PROVIDING THAT THIS ORDINANCE SHALL BE SUPPLEMENTAL
AND IN ADDITION TO THE ORDINANCE MAKING APPROPRIATIONS
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1984 FOR THE
OPERATION OF THE CITY OF MIAMI, FLORIDA; PROVIDING THAT
IF ANY SECTION, CLAUSE OR SUBSECTION SHALL BE DECLARED
UNCONSTITUTIONAL, IT SHALL NOT AFFECT THE REMAINING
PROVISIONS OF THIS ORDINANCE.
WHEREAS, the Board of the Downtown Development Authority of the
City of Miami has approved and submitted to the City Commission a Budget
Estimate of the expenditures and revenues of the Authority for the Fiscal
Year 1983-84 as prepared by the Director of the Downtown Development
Authority, copies of such estimates having been made available to the
newspapers of the City; and
164HEREAS, The City Commission adopted this appropriations ordinance
on first reading September 12, 1983, but at subsequent meetings requested
further information from the Downtown Development Authority prior to
considering final adoption of the appropriations ordinance; and
WHEREAS, said information has now been provided to the Commission
by the Downtown Development Authority as requested; and
WHEREAS, this ordinance is being considered on an emergency basis
since ,pending and future contracts, obligations, and operating requirements
of the Downtown Development Authority cannot be met until the full appropriation
for fiscal 1983 - 1984 is made by the Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI,'-.FLORIDA:
Section 1. The following appropriations for the Fiscal Year 1983-
1984 be, and the same are hereby, made for the maintenance and for the purpose
of financing the operations and other legal and proper purposes of the Downtown
Development Authority of the City of Miami, Florida, to wit:

Rents, Insurance, Printing, Promotion

Section 2. Said appropriations are the anticipated expenditure
requirements for the Downtown'Davelopment Authority but are not mandatory
shouldl efficient administration of the Authority or altered economic
conditions indicate that a curtailment in certain expenditures are necessary.
The Director of the Downtown Development Authority, with the approval of the
Board of the Downtown Development Authority, is specifically authorized
to withhold any of these appropriated funds from encumbrance or expenditure
should such action appear advantageous to the economical and efficient
operation of the Authority.
Section 3. The Director of the Downtown Development Authority, with
the approval of the Board of the Downtown Development Authority, is
authorized to make transfers between the detailed accounts comprising any
of the amounts appropriated by Section 1 hereof, In order that available
and required balance In any such account may be used for other necessary
and proper purposes and to transfer between any of the amounts appropriated
by Section 1.
Except as herein provided, transfers between items appropriated hereby '!
shah be authorized by ordinances amendatory hereto.

Section 4. The Director of the Downtown Development Authority is
hereby authorized to invite and advertise for bids for the purchase of any
material, equipment or service embraced to the aforementioned appropriations,
for which formal bidding is required; such bids to be returnable as required
by law.
Section 5. This ordinance shall be deemed supplemental and in
addition to the ordinance making appropriations for the fiscal year ending
September 30, 1984, for the operation of the City of Miami.
Section 6. If any section, part of section, paragraph, clause, phrase
or word of this ordinance shall be held to be unconstitutional or void, the
remaining provisions of this ordinance shall, nevertheless, remain in full
force and effect.
Section 7. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of
peace, health, safety, and property of the City of Miami.
Section 8. The requirement of reading this ordinance on two separate
days is hereby dispensed with by an affirmative vote of not less than four -fifths
of the members of the Commission

Executive Director Making Appropriations for the
Downtown Development Authority for
the Fiscal Year ending Sept. 30, 1984.
It is recommended that the City Commission
adopt the enclosed ordinance on Second Reading
on October 25, 1983, making full appropriations
for the Downtown Development Authority for the
fiscal year ending September 30, 1984.
BACKGROUND
The Fiscal 1983-1984 Operating Budget for the Downtown Development Authority was
approved by the Board of the Downtown Development Authority August 12, 1983, via
the attached Resolution No. 7-83.
The Budget Ordinance was approved on first reading by the Commission on September
12, 1983. On September 29, 1983, the Commission, by Resolution, approved
appropriations to the Downtown Development Authority in the amount of 1/12 of
the proposed Fy 1983-1984 appropriation. The Commission indicated they would
not act on the full appropriation•untii they met with me to review the proposed
budget.
I have met with the Mayor and each Commissioner to review the Budget. To the best
of my knowledge, the Commissioners are now ready.to act on the full ,appropriations
ordinance.
It is my understanding that ordinances up for second reading are automatically
advertised by the City Clerk. If this is not the case with the second reading
of the ODA budget ordinance, please adv;se me of its placement (approximate time)
on the,October 25, 1983, agenda so that DDA may provide proper notice to the
public.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF THE
DOWNTOWN DEVELOPMENT AUTHORITY, FISCAL YEAR
OCTOBER 1, 1983 THROUGH SEPTEMBER 30, 1984, REQUEST-
ING THE MIAMI CITY COMMISSION TO APPROVE AND ADOPT
SAID BUDGET: REQUESTING THE MIAMI CITY COMMISSION
TO ESTABLISH THE MILLAGE TO SUPPORT THE FINANCIAL
REQUIREMENTS OF THE BUDGET: AUTHORIZING THE
EXECUTIVE DIRECTOR AND TREASURER OF THE AUTHORITY
TO EXPEND FUNDS UNDER THE NEW BUDGET: DIRECTING
THE EXECUTIVE DIRECTOR TO FILE A DETAILED STATEMENT
OF THE PROPOSED EXPENDITURES AND ESTIMATED REVENUES
FOR THE 1983/84 FISCAL YEAR WITH THE CITY CLERK OF
THE CITY OF MIAMI, AFTER APPROVAL, ADOPTION AND
ESTABLISHMENT OF THE MILLAGE BY THE MIAMI CITY
COMMISSION; AND PROVIDING THAT A COPY OF THIS
RESOLUTION BE FILED WITH THE CITY CLERK OF THE
CITY OF MIAMI.
WHEREAS, the Downtown Development Authority of the
City of Miami has prepared a budget for the Fiscal Year
1983/84, and
WHEREAS, the Board of the Authority has reviewed the Budget,
in a Meeting of the Authority on August 12, 1983, said Budget being
based on the Estimated Tax Roll provided by Metropolitan Dade
County, and
WHEREAS, Ordinance No. 7370, as amended, of the City of
Miami, required that the City Commission make appropriations for
the operations of the Authority by ordinance, and
WHEREAS, the Board of the Authority finds that the proposed
Budget is necessary in order to further the objectives of the
Authority, as authorized by City ordinance,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF THE
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Budget of the Downtown Development Authority,
as submitted by the Director, is made a part of this Resolution and
is hereby approved and shall be known as the "Annual Budget of the
Downtown Development Authority; Fiscal Year October 1, 1983 through
September 30, 1984."
Section 2. The City Commission of the City of Miami is
requested to approve and adopt the said Budget and
establish the millage, authorized by law to fully support
the financial requirements of this Budget.
Section 3. The Executive Director and the Treasurer of
the Authority are authorized to expend funds, including new
salary rates, as provided in said Budget, after approval,
adoption and establishment of the millage by the Miami City
Commission, upon the first day of the 1983/84 Fiscal Year,
October 1, 1983.
Section 4. The Director of the Downtown Development
Authority is directed to prepare and file with the City Clerk
of the City of Miami, a detailed statement of the proposed
expenditures and estimated revenues for the Fiscal Year
1983/84, which shall be entitled "Annual Budget of the Downtown
Development Authority; Fiscal Year October 1, 1983 through
September 30, 1984."
Section 5. A copy of this Resolution and the attachment
shall be filed with the City Clerk of the City of Miami, after
approval, adoption and establishment of the millage by the
Miami City Commission.
PASSED AND ADOPTED this 12th day of August, 1983.
