RESOLUT ION NO. N3' 1144
A RESO!_UTION AUTHORIZING THE CITY
ATTORNEY TO CONTINUE 1E4E EMPLOYMENT OF
THE LAW FIRM OF STEEL HECTOR At DAVIS AS
SPECIAL COUNSEL REGARDING CLAIMS AGAINST
THE CITY ARISING FROM THE CONSTRUCTION OF
THE MIAMI CONVENTION CENTER; AUTHORIZING
ADDITIONAL PAYMENT FOR THESE SERVICES IN
THE AMOUNT OF $25,000 ON A RETAINER
BASIS; AUTHORIZING PAYMENT FOR THE
AFORESAID SERVICES FROM FUNDS ALLOCATED
FOR ADMINISTRATIVE EXPENSES OF SAID
CENTER CONSTRUCTION; FURTHER PROVIDING
THAT NO MONIES IN EXCESS OF THE HEREIN
AUTHORIZED SUM BE EXPENDED FOR SUCH
SERVICES UNLESS EXPRESSLY AUTHORIZED BY
THE CITY COMMISSION.
WHEREAS, Frank J. Rooney, Inc., the City's general
contractor for the construction of the Miami Convention
Center had placed
the
City on
notice
as
to possible
litigation concerning
the
completion
date of
the
said Center;
and
WHEREAS, Florida Steel Corporation, as the subcontractor
for Frank J. Rooney, Inc. furnishing and erecting the
structural steel, had also placed the City on such notice;
and
WHEREAS, the complexities of this project required the
City of Miami to have expert advice in the field of contract
litigation to best serve the interests of the City; and
WHEREAS,
since March,
1981 the
City Commission has
authorized the
City Attorney
to employ
the law firm of Steel,
Hector & Davis as special counsel; and
WHEREAS, claims by the general contractor and the
electrical subcontractor are still pending;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

payment for the aforesaid services from funds allocated for
administrative expenses of said Center's construction.
Section Z. No monies in excess of the above authorized
sums are to he expended for such services unless expressly
authorized by the City Commission.

It is recommended that the herein
resolution be adopted providing for the
continued employment of the law firm of
Steel, Hector & Davis as special counsel
to represent the City in connection, with
claims and controversies involved in the
construction of the City of Miami/
University of Miami/James L. Knight
International Center (Miami Convention
Center)
Since March, 1981, the City has authorized employment of the
law firm of Steel, Hector & Davis as special counsel to
represent the City in connection with claims and
controversies involved in the construction of the Miami
Convention Center. On account of the pending nature of
claims by the general contractor and the electrical
subcontractor, the continued employment of this firm is
recommended. The herein proposed resolution will authorize
payment of $25,000 for these services from currently
allocated funds.
