A RESOLUTION RATIFYING AND CONFIRMING THE FINDING OF THE CITY MANAGER, BY AN AFFIRMATIVE VOTE OF NOT LESS THAN 4/5ths OF THE MEMBERS OF THE CITY COMMISSION, THAT FORMAL COMPETITIVE SEALED BIDS BE WAIVED AND THAT THE EMERGENCY PROCUREMENT OF DEMOLITION SERVICES AT TRINITY METHODIST CHURCH FROM TREE MASTERS, INC. AT A TOTAL COST OF $5,520.00 BE APPROVED; ALLOCATING FUNDS THEREFOR FROM THE 5th YEAR COMMUNITY DEVELOPMENT FUND. WIiEREAS, it was determined that on October 5, 1983 at approximately 5:40 p.m., at the building known as the Trinity Methodist Church, located at 1415 N.W. 2nd Avenue, the north wall of said building gave way causing ninety percent (90%) of the roof to fall through; and WHEREAS, the south wall remained upright but in critical condition, being broken and leaning precariously; and WHEREAS, City Building Inspectors of the Department of Fire, Rescue and Inspection Services were called in to investigate; and WHEREAS, said City inspectors immediately determined the position of the remaining structure to be imminently dangerous to the life and safety of City residents; and WHEREAS, said Building Inspectors issued, on an emergency basis, Demolition Order No. 112, to the building owner, Bishop George E. Johnson; and WHEREAS, City Inspectors attempted to contact three (3) wrecking companies to arrange the immediate removal and only one (1) firm responded due to the late hour; and WHEREAS, the only available firm, Tree Masters, Inc., arrived at the scene and performed the emergency demolition satisfactorily and as requested; and WHEREAS, funds for this service are available in the 5th Year Community Development Fund; and CITY COM'14ISSION MEETIIN^ OF DEC 8 1983 RES0L01;u., „,.83-113 REMARKS. WHEREAS, the Director of the Department of Fire, Rescue and Inspection Services has determined the validity of this emergency and recommends the waiver of formal sealed bids and acceptance of the work of Tree Masters, Inc.; and WHEREAS, the City Manager has made a written finding in support of said Department Director's determination. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager's written finding that formal competitive sealed bids be waived and that the emergency procurement of demolition services at the Trinity Methodist Church from Tree Masters, Inc. at a total cost of $5,520.00 be approved, is hereby ratified and confirmed by an affirmative vote of not less than 4/5ths of the members of the City Commission, with funds therefor hereby allocated from the 5th Year Community Development Fund. Brice, Chief Director of Fire, Rescue and Inspection Services Department DATE November 14, 1983 rILE SUB_E TRINITY METHODIST CHURCH Emergency Purchase for Demolition of Collapsed Structur. aFr'PE'._E= (For City Commission Meeting of December 8, 1983) It is recommended that a Resolution be passed waiving the requirement for formal sealed bids, authorizing the procurement of wrecking services from Tree -Masters, Inc., at a total cost of $5,250.00, on an emergency basis for the removal of remaining walls of Trinity Methodist Church after its roof collapsed; further ratifying the City Manager's written finding that the waiver of competitive methods resulted from emergency circumstances. On October 5, 1983, at approximately 5:40 p.m., the Trinity Methodist Church, located at 1415 N.W. 2 Avenue, collapsed. Ninety percent of the church roof fell through after the north wall gave way. The south wall remained upright but in a critical condition, being broken and leaning precariously. City Building Inspectors, called to investigate, immediately determined the emergency circumstance of remaining structure to life and safety of residents and, on an emergency basis, issue Demolition Order No. 112 to the owner, Bishop George E. Johnson, and attempted to contact three wrecking companies by telephone for removal of the remaining walls. Juelle Brothers, Inc. Cuyahoga Wrecking Corp. Tree -Masters, Inc. Due to the late hour, Inspectors were only able to reach Tree -Masters to do the demolition work, which commenced at approximately 10:15 p.m., that same evening. Funds for the wrecking service are provided by the Community Development Program, the recovery of which is subject to normal demolition lien Arocedures. Gary vErEPEN.-ES (For Commission Meeting of City Manager December 8, 1983) f.%__DS_Rrc Based on information supplied to me by the Director of the Department of Fire, Rescue and Inspection Services, I have found that there existed an emergency need for waiver of competitive bidding methods and procurement of wrecking services from Tree -Masters, Inc., in the amount of $5,250.00. The reason for the emergency need was as follows: *The emergency situation occurred on October 5, 1983, at approximately 5;40 p.m., as a result of a roof collapse of the Trinity Methodist Church, located at 1450 N.W. 2 Avenue. The life and safety of surrounding residents was jeopardized by remaining broken and leaning walls which had not yet collapsed.
