N 3-1121 A RESOLUTION RATIFYING AND CONFIRMING THE ACTION OF THE CITY MANAGER BY AN AFFIRMATIVE VOTE OF NOT LESS THAN 4;'5T115 OF THE MEMBERS OF THE I'[ TY COMMISSION IN APPROVING THt_ EMERGENCY PURCHASE OF 1,250 COPIES OF F L 0 R I D A LAW ENFORCEMENT HANDBOOKS FROM THE METROPOLITAN DADE COUNTY POLICE DEPARTMENT, THE SOLE SOURCE OF THE HANDBOOKS, FOR THE CITY OF HIAMI POLICE DEPARTMENT; WAIVING THE REQUIREMENT FOR SEALED BIDS; ALLOCATING FUNDS THEREFOR IN THE AMOUNT OF $5,812.50 FROM THE 1982-83 OPERATING BUDGET OF SAID DEPARTMENT. WHEREAS, the Florida Law Enforcement. Handbook published by Metr000litan Dade County and which is copyrighted, therefore making this a single sole source, is purchased by the Miami Police Department yearly with State Second Dollar Funds (Code No. 290501-760) and WHEREAS, this handbook was developed in 1975 by the Police Legal Unit of the Dade County Public Safety Department for use as a ready reference text for all law enforcement officers; and WHEREAS, said book contains selected penal sections of the Metropolitan Code of Dade County, as well as sections of that Code on traffic offenses not covered by state statutes; and WHEREAS, in addition, there is a section on guidelines for specific procedures of particular relevance to the everyday operations of law enforcement officers; and WHEREAS, since the said book is reproduced and updated annually, every year a new handbook must be purchased to keep the officers updated as to the changes in statutes; and CITY COMMISSION MEETING OF DEC a 1983 IRESOLUNj, iw.83-112 IRENLARKS ___.. 4 WHEREAS, the Miami PoIirp Department has already purchased these handhonks under a st and i n(I order it has w i t h Metropolitan Dadp County, and this year there was an increase in cnst. due to an increase in raw matPrials anti labor needed to produce this handhook; and WHEREAS, the Miami Police Department was required to purchase a larger amoc.int, of handbooks due to its new Auxiliary Police Public Service Aides, and Police Officers; and WHEREAS, the City Manager has made a written finding that a valid emergency existed For the immediate purchase of 1,250 Florida Law Enforcement Handbooks from Metropolitan Dade County, the single sole source of said handbooks; NOW, THEREFORE, RE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager's written finding that - there was an emergency need for the purchase of 1,250 copies of the Florida Law Enforcement Handbook from the Metropolitan ' Dade County Police Department, the single sole source of said handbooks, is hereby ratified by an affirmative vote of not less than 4%5ths of the members of the City Commission. Section 2. The City Manager's action in approving the emergency purchase of 1,250 copies of the Florida Law Enforcement Handbook for the Department of Police from the Metropolitan Dade County Police Department at a total cost of $59812.50 is hereby ratified, and confirmed, with funds therefor hereby allocated from the 1982-83 Operating Budget of said Department. O !T� A resolution authorizing the pur- chase of 1,250 copies of Florida Law Enforcement Handbooks at a to- tal cost of $5,812.50 from Metro- politan Dade County Police Depart- ment, for the City of Miami Depart- ment of Police, waiving the require- ments for sealed bids; Allocating funds therefore from the 1982-83 Operating Budget of said Depart- ment; authorizing the City Manager and Purchasing Agent to issue a pur- chase order for this publication. This year there was an increase in cost due to an increase in raw materials and labor needed to produce this handbook. The Miami Police Department was required to purchase a larger amount of handbooks due to our new Auxiliary Police,'Public Service Aides, and Police Officers. We respectfully request that you approve the purchase of these 1,250 books @$4.65 each, making a total of $5,812.00 as shown in purchase requisition #31957, which is attached as being sole source purchase.
