AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
SECTOR NUMBER ONLY OF APPROXIMATELY
3001 - 3099 NORTHWEST 19TH AVENUE, MIAMI,
FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN),
FROM RG-2/4: GENERAL RESIDENTIAL TO RG-2/6:
GENERAL RESIDENTIAL; BY MAKING FINDINGS; AND
BY MAKING ALL THE NECESSARY CHANGES ON PAGE
NO. 19 OF SAID ZONING ATLAS MADE A PART OF
ORDINANCE NO. 9500 BY REFERENCE AND DESCRIP-
TION IN ARTICLE 3, SECTION 3001, THEREOF;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of November
7., 1983, Item No. 3, following an advertised hearing, adopted
Resolution No. ZB 164-83, by a 5 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
s! OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately
3001 - 3099 Northwest 19th Avenue, Miami, Florida, more
particularly described as the SW 1/4 of the NW 1/4 of the SE 1/4

of the NE 1/4, less the west 25' thereof, Section 27, Township
:
53 South, range 41 East, of the Public Records of Dade County,
1 Florida, from RG-2/4: General Residential to RG-2/6: General
Residential.
Section 2. It is hereby found that this zoning classi-
fication change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood plan;
(b) Is riot contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 19 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

RESPONSE TO ITEMS #9 AND 10
The contract purchaser, Rainbow Associates, Ltd., a Florida
Limited Partnership, has contracted to purchase the -subject property.
Additionally, Rainbow Associates, Ltd. submitted an application with
the.United States Department of Housing and Urban Development and
Florida Housing Finance Agency under the Section 8 and 221(d)(4)
program for the express purpose of constructing a,five (5) story
151 unit elderly/handicap apartment complex. .•
The present zoning designation of RG2.4 is inappropriate to
meet the size and intensity of the proposed development. The present.
zoning designation in the area of'Floor Area Ration (FAR), height
limitation and parking are inadequate to satisfy the requirements
of the application -project.
The proposed zoning designation of RG2.6 would permit con-
struction of the proposed development. The intensity of the proposed
development falls squarely within the perimeters of RG2.6.

COVENANT RUNNING WITH THE LAND
WHEREAS, the FLORIDA CONFERENCE ASSOCIATION OF SEVENTH DAY
ADVENTIST CHURCH submitted a re -zoning application with the City of
Miami for the express purpose of changing the zoning classification
of approximately 300-3099 Northwest 19th Avenue, Miami, Florida, more
particularly described as the SW 1/4 of the NW 1/4 of the SE 1/4 of
the NE 1/4, less the west 25' thereof, Section 27, Township 53 South,
range 41 East, of the Public Recrods of Dade County, Florida, from
RG-2/4: General Residential to RG-2/6: General Residential;
WHEREAS, the Miami Zoning Board, at its meeting of November
7, 1983, Item No. 3, following an advertised hearing, adopted
Resolution No. ZB 164-83, by a 5 to 0 vote, RECOMMENDING APPROVAL of
a change of zoning classification;
WHEREAS, the City Commission after careful consideration of
this matter on first reading at its November 18, 1983 meeting autho-
rized a change of zoning for the subject property from RG-2/4 to
RG-2/6 subject to the applicant submitting the covenant herein;
NOW, THEREFORE, the applicant hereby covenants to:
Construct a low to moderate income elderly housing apartment
building not in excess of five (5) stories and not in excess of a
Floor Area Ratio (FAR) of 1.08.
The Covenant is intended to run with the land.

Said proposed ordinance(s) may be inspected by the public at the
office of the City Clerk, 3500 Pan American Drive, Miami, Florida,
Monday through Friday, excluding holidays, during the hours of 8:00
a.m. to 5:00 p.m.
All interested parties may appear at the meeting and be heard with
respect to the propnsed ordinance(s).
Should any person desire to appeal any decision of the City Com-
mission with respect to any matter to be considered at this meeting,
that person shell ensure that a verbatim record of the proceedings is
