WRITTEN FINDING THAT THE HEREIN INCREASE
RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF TWO-THIRDS OF THE .MEMBERS
OF THE CITY COMMISSION, AND ADOPTING THE
FINDINGS AND CONCLUSIONS SET FORTH IN THE
PREAMBLE OF THIS RESOLUTION
WHEREAS, there exists a contract dated May 11, 1982
between the City of Miami, Florida and Better Construction, Inc.,
in the amount of $1,910,934 for the construction of Jose Marti
Riverfront Park; and
WHEREAS, the amount of the contract was increased
$35,000 by Resolution No. 83-704 adopted July 28, 1983, making
the total contract amount $1,945,934; and
WHEREAS, an additional increase in contract of
$11,850 is required to cover the cost of construction of a
support wall for the Rolando Lopez Dirube mural, which was
authorized by Resolution No. 83-652, adopted July 18, 1983;
and
WHEREAS, the City Manager has made a written finding
that a valid emergency exists for the work to be done at this
time; and
WHEREAS, the Directors of the Departments of Parks
and Public Works recommend the increase in contract to cover
the additional cost; and
WHEREAS, funds for the increase are available from
funds appropriated to the project by Ordinance No. 9534,
dated December 9, 1982 acid as amended November 16, 1993;

:,OW, THEREFORE, BE IT RESOLVED BY THE CO;,',tISSION
OF THECITY OF FLORIDA :
Section 1. After a properly advertised public
hearing, the finding of the City Manager set forth in the
preamble to this resolution is hereby ratified by an
affirmative vote of two-thirds of the City Commission,
and adopted as if fully set forth in this section.
Section 2. The contract between the City of
Miami, Florida and Better Construction, Inc., dated May 11,
1982 for the construction of Jose Marti Riverfront Park is
hereby increased by $11,850, with funds therefor hereby
allocated from funds already appropriated to the project
by Ordinance 'No. 9534, dated December 9, 1982 and as amended
November 16, 1983.

The Department of Public Works recommends the
adoption of a resolution authorizing an increase
in the contract amount of $11,850 in the contract
between the City of :Miami, Florida and Better
Construction, Inc., said funds to be provided
from funds already appropriated to the project;
further ratifying the City Manager's written finding
that the herein increase resulted from emergency
circumstances by an affirmative vote of two-thirds
of the members of the City Commission and adopting
the findings and conclusions set forth in the
preamble of this resolution.
A contract in the amount of $1,910,934 was awarded to Better
Construction, Inc., for the construction of Jose Marti Riverfront
Park on May 8, 1982. The contract amount was increased on July 28,
1983 by $35,000 to cover additional cost of work at the river
bulkhead.
On July 18, 1983 by Resolution No. 83-652 the Commission authorized
Orlando Lopez Dirube to create a mural for the park, and it became
necessary for the contractor working on the project to construct
the support wall for the mural. The cost of the wall is $11,850,
and no funds remained in the contract to cover the cost. Therefore
an increase in contract amount is necessary. Funds to cover the
increase in contract amount were appropriated by amendments made to
Ordinance No. 953ZA. cn November 16, 1983.
The Directors of the Departments of Public Works and Parks
recommend that the increase be authorized.
Attached to this memorandum are additional documents necessary for
an increase in contract amount greater than $10,000. They are:
1. A written finding for your signature that an
emergency situation exists.
2. A memorandum from you to the City Clerk
authorizing him to advertise for a public hearing.
3. A suggested text for the advertisement for a public hearing.

Emergency Need for Increase
in Contract Amount
REFERENCES:

of December 8, 1983)
Based on information supplied to me by the Director of the
Department of Public Works, and the Director of the Department
of Parks, I have found that there exists an emergency need for
an increase in contract amount of $11,850 in the contract
between the City of Miami and Better Construction, Inc., for
the construction of Jose Marti Riverfront Park.
The reason for the emergency need is as follows:
On November 16, 1983, the Commission authorized Orlando Lopez
Dirube to create a mural in the park. The mural required a
support wall, and it was necessary to have the contractor
working at the site construct the wall. The cost of construc-
tion was $11,850 and no funds remained in the cash allowance
to cover the additional cost.

to be held at 2:30 P.M., December 8, 1983 to hear objections
to an increase in contract amount for Jose Marti Riverfront
Park.
Suggested text of the advertisement is attached.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the
City of Miami, Florida on Thursday, December 8, 1983, at 2:30
P.M. in the City Commission Chambers at Cityd Hall, 3500 Pan
American Drive, Miami, Florida, for the purpose of considering
the ratification by the City Commission of the waiver of the
requirement of obtaining sealed competitive bids for increases
in the contract cost f=r _:e owing designated -:ubli_ works
or improvements:
JOSE MARTI RIVERFRONT PARK
An increase of $11,850 in the contract with Better
Construction, Inc. to cover the cost of the additional
work to provide a support wail for the Dirube mural.
All interested persons are invited to appear and may be
heard concerning such proposed wa:Lvers and increases. Should
any person desire to appeal any decision of the City Commission
with respect to any matter considered at this hearing, that
person shall ensure that a verbatim record of the proceedings
is made, including all testimony and evidence upon which any
appeal may be based.
