AN RESOLUI ION CALLING AND PROVIDING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION IN THE CITY OF MIAMI, FLORIDA, ON MARCH 13, 1984, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED FLECTOR S OF THE CITY OF MIAMI FOR THEIR APPROVAL OR DISAPPROVAL, MEASURE KNOWN AS "CHARTER AMENDMENT No. 2 " , AMENDING SUBSECTION 23-A.1(b) OF THE CHARTER 01' THE CITY OF MIAMI, FLORIDA, BY PROVIDING THAT THE NUMBER OF MEMBERS ON THE OFF-STREET PARKING BOARD BE INCREASED FROM 5 TO 7 MEMBERS AND THAT, TO THE EXTENT PERMITTED BY LAW, THE COMPOSITION OF SAID BOARD REFLECT THE INTERESTS OF ALL SEGMENTS OF THE POPULATION OF THE CITY; DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED COPY HEREOF TO BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF DADE COUNTY NOT LESS THAN 45 DAYS PRIOR TO THE DATE OF SAID SPECIAL 14LJNICIPAL ELECTION. WHEREAS, any proposed amendment to the City Charter shall become effective in the event that it is approved by a majority of the qualified electors of the City of Miami voting at a special municipal election held for the purpose of enabling said electors to register their approval or disapproval of said proposed amendment; and WHEREAS, it is appropriate and necessary that the City Commission make timely provisions for holding said special municipal election; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A special municipal election is hereby called and directed to be held in the City of Miami, Florida, from 7:00 A.M. until 7:00 P.M. on Tuesday, March 13, 1984, for the purpose of submitting to the qualified electors of the City of Miami for their approval or disapproval a measure known as "Charter Amendment No. 2119 amending Subsection 23-A.1(b) of the Charter of the City of Miami, Florida, by providing that the number of members on the Off -Street Parking Board be increased from 5 to 7 members and that, to CITY COMMISSION MEETIDIG OF JAN ?G 1984 RESOLD CJ"i ;+o. 8 i� Rf MARKs 3 4 the extent permitted by law, the composition of said Hoard reflect. the interests of all segments of the population of the City. Section 2. In compliance with §100.342, Florida Statutes, the City Clerk is hereby authorized and directed to publish notice of the adoption and the provisions of the herein resolution, at least twice, once in the fifth week and once in the third week prior to the week in which the aforesaid special municipal election, as herein set forth, is to be held in the following newspapers published within the City of Miami, Florida: THE MIAMI NEWS THE MIAMI REVIEW THE MIAMI TIMES DIARIO LAS AMERICAS P A T R I A which notice shall be substantially as set forth in the following form: NOTICE OF SPECIAL MUNICIPAL ELECTION TUESDAY, MARCH 13, 1984 IN THE CITY OF MIAMI, FLORIDA A special municipal election will be held on Tuesday, March 13, 19841 from 7:00 A.M. until 7:00 P.M. in the City of Miami, Florida, at the polling places designated and set forth herein, for the purpose of submittinq to the qualified electors of the City of Miami, Florida, the following question: "CHARTER AMENDMENT NO. 2: Shall Subsection 23-A.1(b) of the Charter of the City of Miami, Florida, be amended to provide for an increase from 5 to 7 members of the Off -Street Parking Board of the City of Miami and also to provide that, to the extent permitted by law, the Board's composition shall reflect the interests of all segments of the City's population?" -2- 84-122 The Charter of the City of Miami shall he so amended if the question For the amendment shall he approved by a majority of the votes cast by the qualified electors of the City of' Miami vt-)tinq on such quest. ion. The registration hooks and records, which pertain to election precincts wholly -)r partially within the City of Miami and which the City is adopting and desires to use f n r holding such special municipal election, are described as follows: All registration cards, books, records and certificates pertaining to electors of the City of Miami rind established and maintained as official by the Supervisor of Elections of Dade County, Florida, in conformity with the provisions of the general laws of the State of Florida, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of such City. Section 4. Since the City of Miami has established the permanent registration system under State Iaw, and the general election laws of the State require 14 days prior approval by the Board of County Commissioners of Dade County for acceptance of branch office registration and the closing of registration books 30 days prior to the date of such special municipal election, registration for such election shall be at the Office of the Supervisor of Elections of Dade County, 1440 Biscayne Boulevard, Miami, Florida. Section 5. Said special municipal election shall be held at the pollinq places in the several precincts, respectively, in the City of Miami, Florida, as set forth in the foregoing NOTICE OF SPECIAL MUNICIPAL ELECTION. Not fewer than 20 days before said election the City Commission shall designate the Inspectors of Election and the Clerk of Election for each precinct and shall publish the names of such Inspectors of Election acid Clerks of Election in a newspaper of general circulation published in the City of Miami 15 days before the date of election. Im 84-122 f Section 6. All qualified electors of said City shall be permitted to vote in said sper,iai municipal election and the Supervisor of Elections of Dade County is hereby requested, authorized, and directed to furnish, at the cost and expense Of the City of Miami, a list of all qualified electors residing in the City of Miarni as shown by the registration books and records of the Office of said Supervisor of Elections and duly certify the same for delivery to and use by the election officials designated to serve at the respective polling places in said election precincts. Section 7. RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the Commission of the City of Miami, in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said special municipal election. Section 8. The official ballot to be used at. said election shall be in full compliance with the laws of the State of Florida with respect to absentee ballots and to the use of the Computer Election System (CES), and shall be in substantially the following form, to wit: OFFICIAL BALLOT SPECIAL MUNICIPAL ELECTION TUESDAY, MARCH 13, 1984 FOR APPROVAL OR DISAPPROVAL OF THE FOLLOWING QUESTION: CHARTER AMENDMENT NO. 2 PROVIDING FOR ENLARGEMENT AND RESTRUCTURING OF CITY'S OFF-STREET PARKING BOARD "Shall Subsection 23-A.1(b) of the Charter of the City of Miami, Florida, be amended to provide for an increase from S to 7 members of the Off -Street Parking Board of the City of Miami and also to provide that, to the extent permitted by law, the Board's composition shall -7- 84-122 f t reflect the interests of all segments of the City's population?" Section 9. The City Clerk shall cause to be prepared absentee ballots containing the Question set forth in Sect ion 8 above for the use of absent electors entitled to cast such ballots in said election. Section 10. The proper officials of the City of Miami and Dade County are hereby authorized and directed to submit said question to the electorate at the March 13, 1984 special municipal election and to certify the result thereof to the Commission of the City of Miami, Florida, and all acts pertaining to said election heretofore performed by said officials are hereby ratified and confirmed. Section 11. The City Clerk shall deliver a certified copy of this resolution to the Supervisor of Elections for Metropolitan Dade County not less than 45 days prior to the date of the herein special municipal election.
