HomeMy WebLinkAboutR-84-01012 01 J-84-9 1/11/84 RESOLUTION NO. ° t-1.0� A RESOLUTION CLOSING, VACATING, ABANDONING AND DISCONTINUING THE PUBLIC USE OF THAT PORTION OF NORTHEAST 2ND COURT LYING SOUTH OF THE SOUTH RIGHT-OF-WAY LINE OF NORTHEAST 22ND STREET FOR A DISTANCE OF + 319.94', AND THOSE PUBLIC ALLEYS LOCATED IN THE BLOCK BOUNDED BY NORTHEAST 22 AND 23 STREETS AND BISCAYNE BOULEVARD AND NORTHEAST 2ND AVENUE, ALL AS A CONDITION OF APPROVAL OF TENTATIVE PLAT #1200-B "TERRANOVA BISCAYNE". WHEREAS, the Miami Zoning Board at its meeting of December 5, 1983, Item No. 1, following an advertised hearing, adopted Resolution ZB-183-83 by a 6 to 0 vote RECOMMENDING official vacation and closure of a portion of a street and certain public alleys as hereinafter set forth, and WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to grant the vacation and closure of the portion of the street and those public alleys in question and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That portion of Northeast 2nd Court lying south of the south right-of-way line of Northeast 22nd Street for a distance of + 319.94'; and those public alleys located in the block bounded by Northeast 22nd and Northeast 23rd Streets, and Biscayne Boulevard and Northeast 2nd Avenue, all as a condition of approval of tentative Plat # 1200-B "Terranova Biscayne," are hereby closed, vacated, abandoned and discontinued for public use. Also accompanyinq this application is the traffic study entitled "Impact Study of Street Abandonment" prepared by Schimpeler Corradino Associates dated April, 1983. Submitted herewith are plans entitled "Terranova Biscayne" prepared by Zbigniew W. Jarosz, A.I.A., schematically presenting a potential development concept for the mixed -use development of these tracts according to their current zoning designations. ' The* public benefit to be derived from this project is the recapture of unneeded street and alley properties which sit virtually unused as an expense to the City for continued main- tenance, in exchange for the development of a project which will contribute to the tax base and produce a positive return to the City of Miami. The developers of the property will pay, all necessary costs for relocation of utilities and subdivision improvements appropriate for the development of this property. The vacation and closing of N.E. 2nd Court between 22nd and 23rd Streets continues the prior actions of the City in closing those portions of this avenue which previously lay to the north and south of the subject property. The closing of this remaining portion of N.E. 2nd Court to achieve the unified development of this property continues to be justified from both planning and fiscal standpoints.
