HomeMy WebLinkAboutO-097863-84-ZK 1/2s/84 rr/D-01 ORDINANCE.NO:` 9 7 AN ORDINANCE PROVIDING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION IN THE CITY OF MIAMI, FLORIDA, ON MARCH 13, 1984, WITH RESPECT TO THE ISSUANCE OF $10,0009000 SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT BONDS. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notice of the special municipal election heretofore called by Ordinance No. 9785 to be held on Tuesday, March 13, 19849 shall be published in THE MIAMI NEWS, THE MIAMI REVIEW, THE MIAMI TIMES, DIARIO LAS AMERICAS AND PATRIA, newspapers of general circulation published in the City of Miami, Florida, at least twice, once in the fifth week and once in the third week, prior to the week in which said election is to be held, the date of the first publication in each of said newspapers to be at least 30 days before said election, which notice shall be substantially in the following form: NOTICE OF SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, MARCH 13, 1984 IN THE CITY OF MIAMI, FLORIDA As provided by Ordinance No. 9785 , duly adopted by the Commission of the City of Miami, Florida, an election will be held on Tuesday, March 13, 19840 for the purpose of submitting to the qualified electors of the City of Miami, Florida, the following question: Shall the City of Miami, Florida, issue Bonds in an aggregate principal amount not exceeding $10,0009000 under Ordinance # 9785 to pay for redevelopment of Southeast Overtown/Park West Community Redevelopment Area, at one time or from time to time and to mature in annual installments 2 to 25 years, inclusive, after the date of issuance of the respective bonds, with interest at lawful statutory rates, payable from unlimited ad valorem taxes? Ordinance No. 9785 provides that for the prompt payment of the principal of and the interest on such bonds there shall be levied and collected annually an ad valorem tax upon all taxable property within the City of Miami, Florida, over and above all other taxes authorized to be levied by said City, sufficient to pay such principal and interest as the same respectively become due and payable. The City of Miami shall be authorized to issue said bonds if the question for the issuance of said bonds shall be approved by a majority of the votes cast by the qualified electors of the City of Miami voting on such question. Said special municipal election shall be held at the polling places in the City of Miami, in the several election precincts designated by the Board of County Commissioners of Dade County, as set forth below. The registration books and records, which pertain to election precincts wholly or partially within the City of Miami and which the City is adopting and desires to use for holding such special municipal election, are described as follows: All registration cards, books, records and certificates pertaining to electors of the City of Miami and established and maintained as official by the Supervisor of Elections of Dade County, Florida, in conformity with the provisions of the general laws of the State of Florida, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of such City. Section 3. Since the City of Miami has established the permanent registration system under State law, and the general election laws of the State require 14 days prior approval by the Board of County Commissioners of Dade County for acceptance of branch office registration and the closing of registration books 30 days prior to the date of such special municipal election, registration for such election shall be at the Office of the Supervisor of Elections of Dade County, 1440 Biscayne Boulevard, Miami, Florida. Section 4. Said special municipal election shall be held at the polling places in the several precincts, respectively, in the City of Miami, Florida, as set forth in the foregoing NOTICE OF SPECIAL MUNICIPAL ELECTION. Not fewer than 20 days before said election the City Commission shall designate the Inspectors of Election and the Clerk of Election for each precinct and shall publish the names of such Inspectors of Election and Clerks of Election in a newspaper of general circulation published in the City of Miami 15 days before the date of election. -6- Section 5. All qualified electors of said City shall be permitted to vote in said special municipal election and the Supervisor of Elections of Dade County is hereby requested, authorized, and directed to furnish, at the cost and expense of the City of Miami, a list of all qualified electors residing in the City of Miami as shown by the registration books and records of the Office of said Supervisor of Elections and duly certify the same for delivery to and use by the election officials designated to serve at the respective polling places in said election precincts. Section 6. RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the Commission of the City of Miami, in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said special municipal election. Section 7. Section B. Electors desiring to vote for the bonds, in approval of said Question described above, shall be instructed to punch straight down with the stylus through the hole next to the word "FOR" within the ballot frame containing the statement relating to said Question. Electors desiring to vote against the bonds, in disapproval of said Question, shall be instructed to punch straight down with the stylus through the hole next to the word "AGAINST" within the ballot frame containing the statement relating to said Question. Section 9. The City Clerk shall cause to be prepared absentee ballots containing the Question set forth in Section 7 above for the use of absent electors entitled to cast such ballots in said election. Section 10. This ordinance shall go into effect immediately upon its passage and shall not be subject to the right of referendum as an ordinance. Bailey Agenda Assistant City Manager ENCLOSURES: (2) "It is recommended that the City Commission approve the attached two ordinances which will enable the City to place a $10,000,000 Bond issue on the ballot for the March 13, 1984 special election for the purpose of funding redevelopment activities within the Southeast Overtown/Park West Comamunity.Redevelopment Area." On October 25, 1983, the Miami City Commission approved the Phase I Redevelopment Program for the Southeast Overtown/Park West Community Redevelopment Program (R83-972) and a series of implementing resolutions which establishes a $29,000,000+ public investment program for the initial nine -block redevelopment area. The thrust of this redevelopment will be the development of affordable_ housing for low - and moderate -income families. The majority of the housing to be developed will be geared for moderate -income families --the downtown employee population. The recently completed market study of the project area by Hammer, Siler, George Associates, economic consultants, supports a strong market for moderate -income housing within the project area but points out.the need for a continued strong commitment on behalf of. the City to reverse the general public perception of the area as being unsafe and physically blighted. This perception can be changed through the development of quality projects and the eradication of the blighting conditions within the area, and through effective promotional activities. The commitment of the City is crucial to this process. According -to, Hammer,•Siler, George, it is mandatory for the city to locate funding sources to provide incentives to developers and or purchasers of the initial units which will catalyze the redevelopment process. The Southeast Overtown/Park West Redevelopment Plan approved by the city Commission (R-82-755) calls for a public commitment of at le4'et $72,000,000 to implftent the redevelopment program, the,bulk of.' the money to be generated through tax increment financing. Based a. Gary i -2- January 6, 1984 on a more detailed financial analysis undertaken by staff and James J. Lowrey & Co., financial consultants, the first Tax Increment Revenue bond issue would not occur until 1988 and will be utilized to repay a HUD Section 108 Loan. The issuance of remaining Tax Increment Revenue bonds will not be feasible until later stages of the project. In order to hasten the redevelopment program and expand it beyond the presently funded -nine -block Phase I Redevelopment Area, there is a need for additional capital infusion into this project during the next few years. Of special concern is the need to expand redevelopment within the Overtown portion of the project area and to ensure the provisions of adequate replacement housing for low-income families that will be displaced through redevelopment. The proposed $10,000,000 bond issue for redevelopment of the Southeast Overtown/Park West Community Redevelopment Area is recommended to.be utilized for the following activities: o the acquisition of land for the construction of low - and moderate -income housing, ancillary commercial development and public facilities, o the demolition of blighted structures, o the relocation of residents and.businesses displaced by public acquisition, o the construction of site and infrastructure improve- ments, o the provision of financial assistance for the•construc- tion of low- and moderate -income housing including mortgage financing, o the preservation of structures of historic and archi- tectural significance, o the construction of housing for residential dLsplacees from the project area within the.Overtown-Community Development Target Area. 'If suitable relocation resources are not available --the City, as outlined in the redevelop-. went plan, is committed to 'construct 208 units of "last Resort" housing for residents who will be displaced.by redevelopment that takes place within the area from N.W. 8th-11th Street west of 1st Avenue. The availability of funding to initiate Phase II development.will greatly ensure the overall success of this project and greatly assist in attracting developers and residents to the project.area during the initial phase due to the guaranteed continued public commitment to this project.
