HomeMy WebLinkAboutO-097850 . 1 b J-84-21 Revised 1/12/84 ORDINANCE NO. - 9 7 8 rJ AN ORDINANCE AUTHORIZING THE ISSUANCE SUBJECT TO THE ELECTION HEREIN PROVIDED FOR $10,000,000 SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AREA BONDS OF THE CITY OF MIAMI, FLORIDA, FOR THE PURPOSE OF PAYING THE COST OF LAND ACQUISITION, RESIDENTIAL AND BUSINESS RELOCATION, DEMOLITION, SITE AND INFRA- STRUCTURE IMPROVEMENTS, FINANCIAL ASSISTANCE FOR THE CONSTRUCTION OF LOW AND MODERATE INCOME HOUSING, HISTORIC PRESERVATION, AND THE CONSTRUCTION OF REPLACEMENT HOUSING FOR RESIDENTIAL DISPLACEES; AND PROVIDING FOR THE LEVY AND COLLECTION OF AD VALOREM TAXES TO PAY SUCH BONDS. 9E IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. For the purpose of paying, with any other available funds, the cost of REDEVELOPMENT OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AREA in the City of Miami, Florida, hereinafter referred to as "CITY", including activities properly appurtenant thereto, the acquisition of land for the construction of low and moderate income housing, ancil- lary commercial, and public facilities, the demolition of blighted structures, the relocation of residents and businesses displaced by public acquisition, the construction of site and infrastructure improvements, the provision of financial assis- tance for the construction of low and moderate income housing, the preservation of structures of historic and architectural significance and the construction of replacement housing for residential displacees from the project area within the Overtown i ,T Community Development Target Area if suitable relocation resources are not available. There shall be issued, under the authority of the Constitution and laws of the State of Florida, a including particularly the Charter of the CITY and the Municipal Home Rule Powers Act (Chapter 166 of the Florida Statutes, as amended), and subject to the election hereinafter provided for, bonds of the CITY in an aggregate principal amount not exceeding Ten Million Dollars ($10,000,000) such bonds to be issued at one time or from time to time and to mature in the years and princi- pal amounts, respectively, as follows: Years After Date or Dates Principal of Bonds Amount Years After Date or Dates of Bonds Principal Amount 2 $105,000 14 $ 350,000 3 115,000 15 385,000 4 130,000 16 4259000 5 145,000 17 470,000 6 1609000 18 520,000 7 1759000 19 575,000 8 1959000 20 635,000 9 220,000 21 700,000 10 235,000 22 770,000 11 260,000 23 855,000 12 285,000 24 940,000 13 315,000 25 1,035,000 it being estimated and declared by the CITY Commission that the probable life of said facilities to be developed is more than twenty-five (25) years after the completion of acquisition and construction of said facilities. Such bonds shall be in the denomination of $5,000 each or any integral multiple thereof, shall bear interest at a rate or rates not exceeding the rate provided for by stat- utes of the State of Florida, shall be in such form and shall be i executed by such officers of the CITY or any financial institu- tion and in such manner, as the Commission shall provide by z - 2 - resolution adopted prior to the issuance of the bonds. The bonds shall be issued as fully registered bonds; provided, however, that if the Federal law, which presently subjects to Federal income tax the interest on municipal bonds that are not in fully registered form, should at any time be repealed or nullified, the bonds may then be issued as coupon bonds or as bonds registered as to principal only or as to both principal and interest, or in any other form, consistent with applicable law, as the commission shall provide by resolution prior to the issuance of the bonds. Section Z. The Commission reserves the right to make all or a part of such bonds redeemable prior to their respective maturities at such times and prices and under such terms and conditions as may be fixed by resolution prior to the sale of any of the bonds. Section 3. For the prompt payment of the principal of and the interest on such bonds, there shall be levied and col- lected annually an ad valorem tax upon all taxable property within the CITY, over and above all other taxes authorized to be levied by the CITY, sufficient to pay such principal and interest as the same respectively become due and payable. Section 4. A special municipal election is hereby called to be held on Tuesday, the 13th day of March, 1984, for the purpose of submitting to the electors of the CITY, authorized by law to participate in such election, the question whether such bonds shall be issued. Section 5. Pursuant to applicable provisions of law, this ordinance shall go into effect immediately upon its passage and shall not be subject to the right of referendum. - 3 T PASSED ON FIRST READING BY TITLE ONLY thist-t, ia clay of 1984. BaileyAgenda Assistant City Manages crc,.osuRIs, (2) "It is rec,-1- nded that the City Commission approve the attached two ordinances which will enable the City to place a $10,000,000 Bond issue on the ballot for the March 13, 1984 special election for the purpose of funding redevelopment activities within the Southeast Overtown/Park West Comonunity Redevelopment Area." On October 25, 1983, the Miami City Commission approved the Phase I Redevelopment Program for the Southeast Overtown/Park West Community Redevelopment Program (R83-972). and a series of implementing resolutions which establishes a $25,000,000+ public investment program, for the initial nine -block redevelopment area.. The thrust of this redevelopment will be the development of affordable housing for low - and moderate -income families.* The majority of the housing to be developed will be geared for moderate -income families --the downtown employee population. The recently completed market study of the -project area by Hammer,. Siler, George Associates, economic consultants,. supports a strong market for =derate-income housing within the project area but points out. the need for a continued strong commitment on behalf,of the City to reverse the general public perception -of the area asbeing: unsafe and physically blighted. This perception can be changed through the development of quality projects and the • eradication of . the blighting conditions within the area, and through effective promotional activities. The commitment of the City is crucial to this process. According to Hammer, Siler, George, it is mandatory for the city to locate funding sources to provide incentives to developers and or purchasers of the initial units which will catalyze the redevelopment process. The Southeast Overtown/Park West Redevelopment Plan approved by the City C omission (R-82-755) calls for a public commai.tment of at least $72,0001,000 to implement the redevelopment program, the bulk of the money to be generated through tax increment financing.• Based N • �f H. Lowrey & Co., financial consultants, the first Tax Increscent -' Revenue bond issue would not occur until 1988 and will be utilized to x repay a HUD Section 108 Loan. The issuance of remaining Tait Increment Revenue bonds will not be feasible until later stages of the project. In order to hasten the redevelopment program and expand it beyond the presently funded nine -block Phase I Redevelopment Area, there is a need for additional -capital infusion into this project during the next few years. Of special concern is the need to expand redevelopment within the Overtown portion of the project area and to ensure the provisions of adequate replacement housing for low-income families that will be displaced through redevelopment. The proposed $10,000,000 bond issue for redevelopment of the Southeast Overtown/Park West Community Redevelopment Area is recommended to be utilized for the following activities: o the acquisition of land for the construction of low and moderate -income housing, ancillary commercial -development and public facilities, o the demolition of blighted structures, o the relocation of residents.and.husinesses displaced by public acquisition, o the construction of site and infrastructure improve- . ments , o the provision of financial.assistance.for the construc- tion of loan-- and moderate -incase. housing including mortgage financing, - o the preservation of structures of historic and archi- . tectural significance, o the construction of housingfor residential displacees from the project area within the. Overtown• Community Development Target .Area. If suitable relocation resources are not available --the City, as outlined in the redevelop- ment plan, is committed to -construct 208 units of "last Resort" housing for residents who will be displaced.by redevelopment. that takes place within the -area from N.W. 8th-11th Street west of lst Avenue.
