HomeMy WebLinkAboutO-09781i 84y-27 ORDINANCE NO. 9781 AN ORDINANCE AUTHORIZING THE ISSUANCE SUBJECT TO THE ELECTION HEREIN PROVIDED FOR, OF $30,000,000 STORM SEWER IMPROVE- MENT BONDS OF THE CITY OF MIAMI, FLORIDA, FOR THE PURPOSE OF PAYING THE COST OF STORM SEWER IMPROVEMENTS IN THE CITY OF MIAMI, INCLUDING THE CONSTRUCTION OF STORM SEWERS, PUMPING STATIONS AND OUTLETS, CUL- VERTS OVER OR ENCLOSING STREAMS, WELLS, OTHER TYPES OF LOCAL DRAINAGE FACILITIES, THE RELAYING OF ANY DAMAGED STREETS OR SIDE- WALKS, AND THE ACQUISITION OF ANY NECESSARY LAND, PROVIDING FOR THE LEVY AND COLLECTION OF AD VALOREM TAXES TO PAY SUCH BONDS. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. For the purpose of paying the cost of storm sewer improvements in the City of Miami, Florida (the "City"), including the construction of storm sewers, pumping stations and outlets, culverts over or enclosing streams, wells, other types of local drainage facilities, the relaying of any damaged streets or sidewalks, and the acquisition of any necessary land, there shall be issued, under the authority of the Constitution and laws of the State of Florida, including particularly the Charter of the City, and the Municipal Home Rule Power Act (Chapter 166 of the Florida Statutes, as amended), and subject to the election hereinafter provided for bonds of the City in an aggregate principal amount not exceeding Thirty Million Dollars, ($30,000,000), such bonds to be issued at one time or from time to time and to mature in the years and principal amounts respectively as follows: Years after Date or Dates of Bonds Years after Principal Date or Dates Principal Amount of Bonds Amount 2 $320,000 14 $1,050,000 3 350,000 15 1,160,000 4 390,000 16 1,280,000 5 430,000 17 1,410,000 6 480,000 18 1,560,000 7 530,000 19 1,720,000 8 580,000 20 11900,000 9 640,000 21 2,100,000 10 710,000 22 2,310,000 11 780,000 23 2,560,000 12 860,000 24 2,820,000 13 950,000 25 3,110,000 it being estimated and declared by the Commission of the City (the "Commission") that the probable life of said facilities is more than twenty- five (25) years after the completion of construction of said improvements. Such bonds shall be in the denomination of $5,000 each or any integral multiple thereof, shall bear interest at a rate or rates not exceeding the rate provided for by statutes of the State of Florida, shall be in such form and shall be executed by such officers of the City or any financial institution and in such manner, as the Commission shall provide by resolution adopted prior to the issuance of the bonds. The bonds shall be issued as fully registered bonds; provided, however, that if the Federal law, which presently subjects to Federal income tax the interest on municipal. bonds that are not in fully registered form, should at any time be repealed or nullified, the bonds may then be issued as coupon bonds, or as bonds registered as to principal only or as to both principal and interest, or in any other form, consistent with applicable law, as the Commission shall provide by resolution prior to the issuance of the bonds. Section 2. For the prompt payment of the principal of and the interest on such bonds, there shall be levied and collected annually an ad valorem tax upon all taxable property within the City, over and above all other taxes authorized to be levied by the City, sufficient to pay such principal and interest as the same respectively become due and payable. Section 3. A special municipal election is hereby called to be held on Tuesday, the 13th day of March, 1984, for the purpose of submitting to the electors of the City, authorized by law to participate in such election, the question of whether such bonds shall be issued. Section 4. Pursuant to applicable provisions of law, this ordinance shall go into effect immediately upon its passage and shall not be subject to the right of referendum. In order to provide for adequate storm drainage in the City of Miami, it is necessary to provide for the funding of appropriate facilities through the issuance of General Obligation Bonds. The Program consists of 27 major drainage districts, three of,which will have new pumping stations, two waterway dredging projects, pumping station renovations and an ongoing local drainage program for a total of $30,000,000. To construct, where feasible, a positive outfall system for all new proposed storm sewer and highway districts. A positive storm sewer system is defined as a network of pipes directly connected to a body of water by means of a storm outfall line for - direct flow (positive) purposes. New positive outfall systems under this pro- gram will be modified in order to comply with regulations regarding retention of run off pollutants. To raise our 1-year storm design criteria on local City streets to a 3-year storm design and on City . arterial streets to a 5-year storm design. A 3-year storm, for example, is one that is severe enough to cause temporary flooding due to pipe size, inlet capacity and other factors, once every three years. (A maintenance function) . . . . . . . . . $ N/A TOTAL: • $30,000,000 The major storm sewer districts shown on the attached map have been selected to address repeated and serious problems. Approximately 19 of the 29 districts shown will be'served with a positive outlet. By far the most serious areas of flooding occur -in the Flagami region of the City. The northern boundary of this area is the Tamiami Canal and Blue Lagoon waterways which are controlled by a salinity damp located on the Tamiami Canal approximately 600 feet east of LeJeune Road. Numerous culverts and drainage districts discharge to the Page 2 of 3 Howard V. Gary January 17, 1984 Tamiami Canal upstream of this salinity control structure, including the drainage system for most of the Miami International Airport, a land area of approximately eight square miles. Due to the high water levels that have been reached in the canal during previous storms, we believe that the most effective way to drain some of the low areas within the Flagami region will be through the con- struction of several storm pumping stations. We presently have one of these pumping stations under design to serve the area identified as the LeJeune Storm Sewer Project. It should be noted that storm sewer districts are not being shown for the area surrounding the I-95 and N.W. 36 Street Expressway Interchange. The reason for this is that many of the streets in this area either have been rebuilt recently or will be rebuilt under our Highway Improvement Program, which will include new storm sewer construction. In addition, the area west of S.W. 27 Avenue and immediately north of Coral Way, the south Coconut Grove area and localized problems throughout the City will be addressed by our local drainage program. We have set aside $6,000,000 over the next five years for the con- struction of three additional pumping stations and $500,000 for the repair and replacement of facilities beyond the scope of routine maintenance at the four (4) existing City owned pump stations. The estimated total cost of this Program is $30,000,000.
