ORDINANCE NO. 9 7 8.0--
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY 5040
NORTHWEST 7TH STREET MIAMI, FLORIDA, (MORE
PARTICULARLY DESCRIBED HEREIN) FROM RG-3/6
GENERAL RESIDENTIAL AND FROM RG-1/3 GENERAL
RESIDENTIAL TO CR-2/7 COMMERCIAL -RESIDENTIAL
(COMMUNITY); MAKING FINDINGS; AND BY MAKING
ALL THE NECESSARY CHANGES ON PAGE NO. 31 OF
SAID ZONING ATLAS MADE A PART OF ORDINANCE
NO. 9500 BY REFERENCE AND DESCRIPTION IN
ARTICLE 3, SECTION 300, THEREOF; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of November
7, 1983, Item No. 8, following an advertised hearing, adopted
Resolution No. ZB 169-83, by a 5 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 5040
Northwest 7th Street, Miami, Florida, more particularly described
as the west 1/2 of the east 1/2 of the northeast 1/4 of the
northwest 1/4 of the northeast 1/4 of Section 6, Township 54S,
Range 41E less the south 100 feet thereof, UNPLATTED a/k/a Tracts
"A" and "B", Tentative Plat #1164B, "AIRPORT SEVEN," of the
Public Records of Dade County, Florida, from RG -3/6 General
Residential and from RG-1/3 General Residential to CR-2/7
Commercial -Residential (Community).
Section 2. It is hereby found that this zoning classi-
fication change:

Is in conformity with the adopted Miami Comprehensive

Neighborhood Plan;

(b)
Is not contrary to the established land use pattern;

(c)
Will not create an isolated district unrelated to
adjacent and nearby districts;
(d)
Is not out of scale with the needs of the neighborhood
or the City;
(e)
Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f)
Is necessary due to changed or changing conditions;

(g)
Will not adversely influence living conditions in the
neighborhood;
(h)
Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i)
Will not create a drainage problem;
(j)
Will not seriously reduce light and air to adjacent
area;
(k)
Will not adversely affect property values in the
adjacent area;
(1)
Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m)
Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 31 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section
300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

DECLARATION OF RESTRICTIONS
KNOW ALL MEN BY THESE PRESENTS that the undersigned, being
the owners of the following described property, lying, being and
situated in Dade County, Florida, to -wit:
The west 1/2 of the East 1/2 of the N.E. 1/4
of the N.E. 1/4 of Section 6, Township 54
South, Range 41 East, less the South 100
feet thereof. All lands described herein
being in Dade County, Florida.
in order to assure the Zoning Board and City Commission of the
City of Miami, Florida, that the representations made to them by
the owners will be abided by, voluntarily make the following
Declaration of Restrictions covering and running with the above -
described real property:
1. That the portion of the subject property designated
Tract "B" as shown on the survey prepared by Lannes & Garcia, Inc.
dated January 12, 1984, a copy of which is attached hereto as
Exhibit "A", shall only be used for parking and such portion shall
not have right of ingress or egress from N.W. 5th Street and shall
be landscaped on the south and west, all landscaping and any tree
removal being subject to the approval of the Miami Planning
Department, in conjunction with development on Track "A".
It is understood and agreed by the undersigned that any
official inspector of the City of Miami Building Department or any
agents duly authorized by the Director of that Department may
have the privilege at any time during normal working hours or
entering and investigating the use of the premises to determine
whether or not the requirements of the building and zoning
regulations and the conditions herein -agreed to are being
fulfilled.
These restrictions during their lifetime shall be a
restriction and limitation upon, all present and future owners of
the above described real property and for the public welfare.
This Agreement shall constitute a covenant running with the
land and shall be recorded in the public records of Dade County,
Florida, and shall remain in full force and effect and be binding
upon the undersigned, it successors and assigns until such time
as the same is modified or released.
These covenants shall continue for period of 30 years from
the date of recordation, after which they shall be extended
automatically for successive periods of ten years, unless an
instrument signed by a majority of the then owner(s) of the real
property has been recorded which changes or releases the covenants
in whole, or in part, provided that the covenants have first been
released or the changes approved by the City of Miami Commission.

This Declaration of Restrictive Covenants may be modified,
amended or released as to the land herein described, or any
portion thereof, by a written instrument executed by the current
owners of the fee simple title to the lands to be affected by such
modification, amendment or release, provided that the same has
first been approved by the City Commission o �I

modified, amended or released, the Director of the City of Miami
Building and Zoning Department, or his successor, shall forthwith

Change of Zoning Classification in the Zoning Atlas of
Zoning Ordinance 9500, of the proposed Tracts "A" and -'B"

PLANNING DEPT. DENIAL. There is no indicated need for additional commercial
zoning in the area. Ample commercially zoned land exists to
the east of the subject area and a shopping center exists to
the west at 57th Avenue. Except for the commercially zoned
areas, the predominant land use is multiple family residential.
The proposed change of zoning is not in accord with the
Comprehensive Plan which indicated multiple family development
for this area. In particular, the rezoning of Tract B would
be an adverse encroachment into a low density residential
neighborhood.
PUBLIC WORKS Dedication is required by plat.
ZONING BOARD At its meeting of November 7, 1983, the Board adopted
Resolution ZB 169-83 by a 5 to 0 vote, recommending approval
of the above.
