HomeMy WebLinkAboutR-84-0149J-83-1115 12/29/83 rr/D-3 RE501.11T TON NO �j. -rl•�� A RESOLUTION WAIVING THE REQUIREMENTS AND PROHIBITION CONTAINED [N CITY CODE SECTION 2-302; BY FINDING, AFTER A DULY ADVERTISED PUBLIC NEARING, THAT IT I5 IN THE BEST INTEREST OF THE CITY TO PERMIT PATRICK WHITE, AN APPOINTED MEMBER OF THE AFFIRMATIVE ACTION BOARD, TO PARTICIPATE IN THE MULTI -FACILITY REHABILITATION PROGRAM ADMIN[STFRED BY THE HOUSING DIVISION OF THE C I I Y ' S DEPARTMENT OF COMMUNITY DEVELOPMENT THROUGH THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM OF THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. WHEREAS, the Cit.y of Miami, through the Community Development Block Grant Program of the [In ited States Department. nf" ilousincl and Urhan Development has implemented a multi -family rehabilitation program for City residents; and WHEREAS, Patrick White, an appointed member of the City of *,,liami's Affirmative Action Board, who resides within the City, liar applied for rehahiIitation assistance under this program; and WHE'ZEAS, said Patrick White qualifies in all respects for participation in said program except that he is an appointed member of the City of Miami's Affirmative Action Board and would he in technical violation of City Code Section 2-302; and WHEREAS, a waiver must be obtained before approval of Mr. White's participation in said program; and WHEREAS, in the past, City employees who have applied and qualified for participation in this program have been given a waiver; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The authorization set forth in Section 3 hereof is based upon the following findings being made by four -fifths of the members of the City Commission after a duly advertised public hearing: CITY COM USSICQA 14EETING OF F E B 9 1984 ESOLUlIOir q, e�_- REMARKS. �► L (a) Patrick White, an appointed member of the City of Miami's Affirmative Action Board, has applied and qualified For participation in the multi - family rehabilitation program administered by the Department of Community Development. (b) The City of Miami ran best avail. itself of the opportunity to benefit from the housing rehabilitation program through offering the program to all interested property owners. (c) The herein proposed participation will be in the best interest of the City of Miami. Section 2. Based upon the findings scat forth in Section 1 hereof, the requirements and prohibition contained in Section 2-302 of the City Code are hereby waived. Section 3. The City of Miami Department of Community Development is hereby authorized to allow Patrick White to participate in thf, multi -family rehabilitation program. Garv_ City Manager DATE December 12, 1983 FILE Resolution Waiving Conflict �f Interest for Patrick White Dena Spillman, Director REFERENCES City Commission Agenda Department of Communitv Dev,:iopment Item ENCLOSURES January 12, 1934 It is recommended that the Citv Commission waive the Conflict of Interest provision, Section 2-302 cf the Code of the City_ of Miami to allow Patrick White, a member of the Affirmative Action Board,to participate in the Multi-Familv Rehabilitation Program. The Multi-Familv Rehabilitation Program administered by the Department of Community Development is available to all eligible owners of multi -family buildings located within the Community Development Target Areas. Program guidelines prohibit persons involved in the direct administration of the program and members of the governing body of the City of Miami from participating in the program. City employees and/or persons who are members of City boards and who are not involved in the administration of the program are eligible for assistance if they meet the eligibility criteria. From time to time, city employees have met the eligibility criteria and have requested assistance through the Rehabilitation Program. These employees are required, by the Code of the City of Miami, Section 2-302, to obtain a waiver from the City Commission before such assistance can be approved. The program guidelines established by the United States Department of Housing and Urban Development do not allow the City to set up separate classes of citizens based on their employment as a criteria for eligibility for assistance programs. They do require, however, that program staff and members of governing bodies be ineligible for assistance from certain programs. Based on the above, it is recommended that approve the Waiver of the Conflict of Interest approval of the subject application. /wh the. City Commission provision to allow
