SIONERS TO EXTEND TTS REGULATION OF
FOR -HIRE VEHICLES BY ENACTING ORDT-
NANCES WHICH WOULD INCLUDE THE REGULA-
TTON OF HUMAN -POWERED FOR-HTRE VFHTCLES.
WHEREAS, in recent months the Citv of Miami has been requested
to authorize and regulate the operation of for -hire, human -powered
passenger vehicles within the City's limits: and
WHEREAS, the City of Miami does not presentiv regulate any
for -hire vehicles, said authority having been pre-empted by Metro-
politan Dade County Ordinance No. 81-85: and
WHEREAS, it would appear that similar requests will be made
of other municipalities located in Dade County; and
WHEREAS, regulation of such public conveyances should be
uniform throughout Dade County;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Metropolitan Dade County Board of County
Commissioners is hereby urged to extend its regulation of for -hire
vehicles by enacting ordinances which would include the regulation
of human -powered for -hire vehicles.

limousine operators, chauffeurs and for -hire vehicles) to
include the regulation of Human powered for -hire vehicles.
BACKGROUND
On December 8, 1983 Mr. David Gates representing the DA-BAR
Pedicab Service, Inc., appeared before the City Commission to
request a six month trial period for his pedicab service; i.e.
the right to operate the service for six months in the downtown
area. Also present but not listed on the agenda was Mr. Paul
Freedman of Royal Rickshaw. This matter was referred to the City
Manager for further review.
On December 15, 1983 a meeting was held with Mr. Freedman and his
attorney, Mr. Gates and staff of the Planning and Law Departmgnts
to discuss how such services would operate. Royal Rickshaw has
been issued an occupational license by the City of Miami and is
presently operating a for -hire rickshaw service in the downtown
Coconut Grove area; Royal Rickshaw's operating premise is
attached. DA-BAR has pending an application for an occupational
license to operate a pedicab service in the downtown Miami area.
A formal review of DA-BAR's proposal was performed and a
recommendation by the Planning Department was distributed for the
December 8, 1983 City Commission meeting.
It is the opinion of City staff that this type of service could
work in the City of Miami and would be a desirable feature in
certain areas such as Coconut Grove, Downtown Miami and Little
Havana. However, it is my opinion, formulated after several
discussions with the Law Department and other City staff, that
the City of Miami should not become involved in the regulating
and licensing of either rickshaws or pedicabs, even though they
may be desired urban ammenities or features, for two reasons.

The second reason for this recommendation against City regulation
is related to the first. That is, both DA-BAR and Royal Rickshaw
have indicated their desire and intent to operate in other Dade
areas, incorporated and unincorporated. Just as other for -hire
operators should not, and are not, subjected to fractured or non-
uniform regulation, nor should these services. Regulation should
therefore be performed by Dade County on a county -wide uniform
basis.

Royal Rickshaw is proud to announce its opening; of another short
distance transportation system in Downtcom Miami.
?ick.shaw is a human powered non -motorized, two ?assen er, open
air vehicle. The char;e zor our service is 3.25 per block per
person ar when taking a ride for an extended period of time, the
char;e is $.25 per minute: per person.
ode plan to start the service officially October -0, 1983 with two
Rickshaws, expanding to as many .as thirty-five within the next two
months. The service will operate seven days a week, from 8:00 A4 -
b:00 PM, until such time that there is a demand for longer hours of
operation.
This service will pick up and deliver in the Miami Downtown area
only. We will be providing work for as many as 80 people in the
near future and hope to be providing work'for up to 250 people
in the Miami area within the next year.
Rickshaws are not here to replace any of the already existing trans-
portation systems such as bus and cab service. We are not planning
to be in competition with the cab companies. Ours is a short distance
service only.
Royal Rickshaw operates in other locations in Canada and the United
States and is in the process of opening many more locations in the
near future. We have had a good response and acceptance of our
service in these other locations and hope the same will be true of
Miami.

Not only do we supply a transportation service, but also get involved
in many of the community fund raising efforts. In the past, we
have been involved in raising money for the Northern Alberta Children's
Hospital Fund, Terry Fox Miles For Millions and the United Way. We
hope that we can get involved as much if not more with these kinds of
projects here in the City of Miami.
You haven't been in Downtown Miami unless we have given you the
Royal Runaround.

bounded by I-95 on the west, the Miami River on the south,
.1 6th Street on the north and "Eiscayne Boulevard on the

ANALYSIS
The pedicab service could be a novel and practical service for
visitor and employees in the downtown area. Viewed in the
context of recent efforts to introduce a more human scale,
tourist oriented flair to activities downtown, this proposal can
be seen as a positive image factor in a core area often perceived
as harsh, rushed, and lacking in amenity.
The central issue in this proposal, however, is the question of
safety, and secondarily, disruption to traffic. Safety of
passengers is largely a function of the pedicabs ability to move
with traffic and avoid streetside hazards such as buses, trucks,
and turning vehicles. Since core area traffic averages less than
11 miles per hour, the pedicabs should be able to maintain
reasonable pace with traffic. By requiring all pedicab drivers
to hold motor vehicle drivers licenses and observe certain
operational precautions (listed above), it can be presumed that
acceptable safety standards can be maintained. Notable
exceptions, however, would be high speed traffic on Biscayne
Boulevard (especially north of 6th Street) and Brickell Avenue,
and the narrow Miami River bridges with steep approach grades.
These hazardous areas would dictate confining the suggested trial
operations to the immediate core area.
It should be noted that Downtown Orlando has permitted for
several months an identical pedicab service to operate in
conjunction with the Church Street historic district. No
problems have resulted to our knowledge.
The Departments of Public Works and Police have no objection to
the trial period provided all safety conditions are met.

Commissioners. Its primary purpose is to provide an overall view
of a proposed Pedicab Service and how it -rill function within the
vast growing sector of downtown Miami.

WHAT IS A PEDICAB
A Pedicab is a multi -wheeled hooded or unhooded passenger
vehicle that is moved by human power or any push -cart or ricksha -
type vehicle with two wheels pulled or propelled by a person,
k1hich is used in the movement of passengers or property for hire
on the public highways and which is directed to o destination by
the passenger for hire or on his behalf and whic:i operates on

HOW IS IT MANUFACTURED

Each pedicab is made with the finest materials available.
All steel tubing is heavy gauge and painted with DuPont Imron
polyurethane enamel. Seats are high-grade nouaahyde
upholstery, the top is made of :-)ecvv-duty convertible
material. The bodies are molce Fiberglas.

The pedicab has dual 6" hydraulic disc brakes in front. The
combination of front and rear braking power is sufficient to
stop the pedicab in all situations. Front and rear tires are
26 x 175.

Transmission
The transmission is a wide -ratio five speed derailleur -type
system, which allows ease of peddling under most situations
and virtually maintenance free operation.
Electrical System
Standard parts of the electrical system are turn signals,
headlights, and brake lights in addition to reflectors on all
sides.
Safety Equipment
Each cab has a horn, turn signals and brake lights to worn
other vehicles. A serial number is permanently marked on
every pedicob.
Pedicabs are as safe as any transportation vehicle. They are
made with the necessary safety equipment and are fully
ref lectionized. One owner stated that he can recall only a
couple of minor accidents during his years in business.

Pedicabs can be utilized in a large capacity. Below is a

As an added attraction or convenience, pedicab(s) can be
rented by motels/hotels or an individual upon request for a
given period of time. Fee will be paid in advance, with no
refund for cancellations. Renter will sign an agreement
stating that he/she will at all times follow all rules and
regulations. If he/she is the cause of harm/danger,
regardless of nature, will at such time become liable for all
costs.
One pedicab can safely transport two (2) adults, one (1)
adult and two (2) small children or three (3) children. For
larger occupancy, one would request a larger seat as an
option when ordering from the manufacturer.

MAINTENANCE

Maintenance on pedicabs would only require a car or bicycle
mechanic and should maintain the usual maintenance check for
good operating performance. However, the manufacturer does
recommend tips on repair.

To insure a successful pedicab operation, chauffeurs must be
competent, at least 18 years of age and possess a valid
Florida drivers license . . .
Each pedicab will be registered and tagged
f-',ours of operation for proposed areas will be
according to flow of traffic.
Pedicabs will operate in slow lanes of traffic --
cooperating fully with transit buses.
` All chauffeurs will be required to take a pedicab
operators training course.
. To exemplify the rapport that DA-BAR PEDICAB SERVICES will
generate within the community every chauffeur must at all
times while performing his duties as a chauffeur, comply
with all responsibilities and regulations governing them.
Below is a sample of a few proposed CHAUFFEUR
REGULATIONS:
. No chauffeur will solicit passenger
. No chauffeur will refuse or neglect to transport
any passenger regardless of race, sex, religion,
national orgin, age or physical disability.

on their bodies or in their vehicle

MANAGEMENT/OPERATION (CONTINUED)
Central pick-up location will be established along the
proposed routes as shown in figure 1 and 11. Proposed hours
of operation will be Monday through Friday mornings from 6:30
to 10:00 a.m., afternoons from 3:30 to 7:00 p.m. Exact times
for weekends and holidays are not definite.
A manager will be on call during business hours to handle
complaints, maintenance, towing and emergences, etc.
Fees will be determined by distance to be travelled in
accordance with the rate schedule. To insure that accurate
fees are charged on a consist basis each pedicab will be
equipped with a pedimeter to show the exact distance
travelled as well os exact cost.
Should the passenger request the chauffeur to wait, the
passenger will pay the waiting fare in accordance with rate
schedule. At the time of wait request the passenger will
give the chauffeur a return time, not to exceed five (5)
minutes. However, the chauffeur will extend the courtesy of
waiting five (5) minutes beyond wait time.

on a daily basis, to insure and keep abreast with the
business as well as the activities of each driver.
Should a pedicab become disabled, chauffeur will stop
immediately and make arrangements for the passenger(s).

In compliance with Dade County and the City of Miami
insurance requirements, ample coverage will be obtained to
cover the pedicabs, as well as the chauffeurs, passengers and
personal property.
We have weighed the pros and cons of this business and feel
confident as professionals to successfully manage and operate
a pedicab business. Our business experience has been in
direct sales and marketing of household and commercial
products.
There are areas in which we lack specific information
regarding the proper procedure for establishing a business of
this type. We solicit your recommendations and guidance in
the proper direction, i.e., types of permits, existing state
and county laws regarding this type of transportation.

PROPOSAL
The data for this proposal was gathered from pedicab owners and
manufacturers. This data was supplied through correspondence and
telephone calls to Oakland, California, Knoxville, Tennessee,
Spokane, Washington and Honolulu, Hawaii.
This investigation reveals that Pedicab services are being used

inquiring about our Pedicab Insurance Program. We have been issuing policies
to corer pedicab operations for liability insurance to conform with the City &
County of Ecnolulu, using regulations wUch mandate that insurance be covered
on pedic:abs cFerated via permit within the City and County of Honolulu.
We are attaching a specimen copy of a policy which has been issued within our
office and hope that this will be of assistance to you.
Our premium for each pedicab is $250 and we should have the following

We are able to fume the City & County of Miami or other governmental agencies
as an additional insured to this policy if ttfere is reason to do so. We will

to endorse the policy to substitute other units onto the some policy upon
receiving the information required.

meeting the standards set in Section 12-5.6(c) herein -
above, to determine the fitness of the applicant to
continue as a pedicab operator for hire by the [Chief
of Police] Director of Finance. A new set of unre-
touehed photographs showing a reasonable likeness of
the operator shall be furnished with each application
for renewal.
(e) Whenever the operator's certificate of any
pedicab operator is suspended or revoked, the (Chief
of Police) Director of Finance shall require that the
pedicab operator's certificats be surrendered to and
certificate and ONE DOLLAR ($1.00) for each
duplicate operator's certificate which will

side to or abreast of each other at any time, except
when passing.

Any driver, owner, or operator of a pedicab or
pedicab stand may charge or cause to be charged,
any fare for the use of a pedicab, for purposes of
hire on an elapsed time basis provided that all
fares shall be posted and be visible from within
and from outside t..e c [prominently displayed

order that any potential passenger for hire may be
aware of the fares before a commitment is made to
hire the pedicab. Specific information on the
subject matter is contained hereinbelow.
(b) Flat Fees and Tours.
As as alternative, a passenger for hire may be
given a choice of tours instead of time charges
but the passenger shall be informed of which
alternative the passenger will be charged for,
before the trip is started.
A scale map showing the exact routs or
itinerary of each tour shall be provided to each
potential passenger for hire by the pedicab
operator. The p*dicab operator may demand the
return of the map at the and of the tour.

hire. No other charges shall be made for the use
of a pedicab for hire except as provided herein.
T.he collaction of any charge may, at the

waived.
f. Section 12-3.10 is hereby amended to read as
follows:
Sec. 12-5.10. Establishment Of Road Pedicab Stands.
The City Council shall establish road pedicab
stands on public streets and City -controlled
facilities upon recommendation of the Director of
Transportation Services. The Director of Transpor-
tation Services shall study and recommend to the
City Council the site placement of such stands. The
[Chief of Police] Director of Finance shall issue
pedicab operator certificates under another section
of this article which will automatically include
pedicab stand permits. The fees for such pedicab
stand permits shall be established pursuant to law.
q. Section 12-5.12 is hereby amended to read as
follows:
Sec. 12-5.12. Condition Of Pedicabs For Hire.
No vehicle shall be operated as a pedicab for
hire unless it is in a reasonably clean and safe
condition inside, as well as externally, so as not
to injure or damage.the person, clothing or pos-
sessions of a passenger. The vehicle's exterior
shall be reasonably clean and shall be essentially
free from cracks, breaks and major dents. It shall
be painted to provide adequate protection and a
neat and clean appearance. Repairs done to comply
with this section shall be done within a reasonble
time based on availability of parts and labor.

Sec. 12- 5.1 Definitions.
As used in this Article, unless the context otherwise
requires:
(a) 'Chief of Police" shall mean the Chief of
Police of the City and County o+ Honolulu, or
his duly authorized subordinates.
(b) 'Council' shall mean the Council of the City
and County of Honclula.
(c) 'Director of Finance" shall meant the Director
of Finance of the City and County of Honolulu or
his duly authorized representative(s).
(d) 'Director of Transportation Services" shall mean the
Director of the Depa.-tment of Transportation Services
of the City and County of Honolulu or his duly-',
authorized representative(s).
(a) 'Pedicab" means a multi -wheeled hooded or un-
hooded passenger vehicle that is moved by human
power or any push -cart or ricksha -type vehicle
with tac wheels pulled or propelled by any person,
which is used in the movement of passengers or
property for hire on the public highways and whic:
is directed to a destination by the passenger !or
hire or en his behalf and which operates on call,
demand or on a schedule.

(f) "Pedicab Operator" shall mean a person duly
licensed as the operator of a pedicab who has
obtained a valid pedicab operator's certificate.
;q) 'Passenger for sire" shall mean a perscn transported
in a pedicab for consideration.
(h) 'Property for Sirs" shall mean property transported
in a pedicab for consideration.

Sec. 12-5.2 . Business License for Pedicab.
(a) Issuance. The Director of Finance shall issue business
licenses for pedicabs for hire and collect the required
fees in accordance with the provisions of this Article
and a:y other applicable provisions of the law.
The issued business licenses shall not be transferable
and shall be mounted within the cab so that it is
readily visible to all passengers.
(b) Fees.
(1) The annual fee for a business license for
pedicab shall be TIAM= FOUR DOLLARS ($24.00) per
vehicle: provided that, when a business license
fee has already been paid on a vehicle and that
vehicle is, within the year, replaced by another
vehicle, the unexpired pc--.. ion of the business
License fee paid on the vehicle so replaced shall
be credited to the business license fee payable
for the substitute vehicle. For the purposes here-
of, the unexpired portion of the business license
fee paid on the vehicle which has been replaced
shall be that portion of the annual fee which is
equal to 8-1/3 per cent of said fee multiplied by
the number of full. months remaining during the
cw=rent licensing year. The business licensing
year shall start on July 1 and te-=inate on Jrne 30,
year following.

Whenever a.vehicle licensed as a pedicab is re-
placed by another vehicla under the provisions of
this Article, the sum of FIVE DOLLARS M- 00) in
addition to the business license fee shall be
assessed against the owner of the vehicle so
replaced to defray the administrative costs
incurred by the City.
The sums collected shall be deposited in the
General rund.
(2) Cpcn su: -ander, the license s4ha_l be
cancelled.
(c) S=render and Cancel1atica.
(1) The holder of a business license for a pedicab
shall immediately surrender said license to
the Director of Finance:
a. Upon close out, transfer or reassicr=ent of
the business for which a license has been
issued. The Director of Finance shall be
notified in writing within thirty (30)
calendar days of such closing out, trans:er
or reassignment;
b. If in the interim, the vehicle is taken out
of service permanently for any reason.
(2) Upon surrender, the license for a pedicab shall
be cancelled.
Sec. 12-5.3 Pedicab Business License Decal.
The Director of Pinion shall annually furnish the owner
of a pedicab a business license decal similar to that
currently issued in the licensing of taxis and buses upon
the payment of ONE DOLLAR ($1.00) which shall be valid until
the 30th day of June next following the date of issue.
The sums ccU&cted shall be deposited in the General Fund.
The decal is partly for identification of the ped:cab. Zt
shall be large enough to be legible from a reasonable distance.
The decal shall be fastened or displayed on the rear of
the vehicle for which it was issued. The decal shall be
kept reasonably clean. and displayed entirely uncbscured.

The decal shall be non -transferable and shall be reaoved and
returned to the Director of Finance for destruction upon the
termination, transfer cr reassignment of the business.
No pedicab shall be operated on a public highway or other
zub?ic prcpert•_ without a pedicab decal issued to that

described in such article for two consecutive years, or

no provisions in this part shall be consrued to relieve
a redicab owner from complying with the requirements of
ERS Section 249-14, relating to Bicycle tax.
Sec. 12- 5.5 0 Evidence of Financial Responsibility.
The Director of Finance shall require evidence of financial
responsibility from the owner and/or operator of the pedi-
cab for hire before issuing a business license and decal
to engage in a pedicab for hire. The owner and/or operator
shall have insurance in force or other evidence of financial
responsibility so long as the pedicab is used in business.
Such evidence of financial responsibility may be in one of
the following two methods:
(a) Insurance Policy.
The Director of Finance shall retain the original
insurance policy issued by a company licensed to do
business in the State of Hawaii. The policy shall be
duly countersigned by its authorized Hawaii agent
complete with. all endorsements and attachments or a
certified copy thereof. Such policy shall provide
for prima_-y public liability insurance coverage in
the amount of ONE HUNDRED THOUSAND DOLLARS ($100,000.00)
because of bodily injury to or death of one person in
any accident, and is the amount of rPTO HUNDRED TSOUSANJ
DOLLARS (52000000.00) because of bodily inj=y to or
death of L-oa or more persons in any one accident, and
property damage insurance in the amount of TWENTY
THOUSAND DOLLARS ($20,000.00) because of damage tc or
destruction of property of others is any one accident
for each pedicab for hire. All policies shall be on
a fiscal year basic sndisg on June 30 of each yeas.

Insurance policies on vehicles regulated under this
article shall contain a provision that the policy
wi'' not be reduced in coverage or cancelled without
':hi..f . calendar days prior written notice to . the -
Director of Finance by the authorized Hawaii.agent for
the insurance company.
The Director of Finance shall revoke the business
license and license decal of the pedicab if the insurance
coverage required above is reduced or cancelled by
the owner and/or operator a:d met i=ediately replaced
b: securities described im its (b) below.
(::) Legal Tender or c . o _r Seca: iti es .
A deposit w4 th the : inance of legal tender,
cashier's check, bank drat, irrevocable letter o:
credit, certified check, bond or other security de-
termined to be satisfactory by the Director of Finance
in the total amount of TWO EL'NDRED THOUSAND DOLLAAS
($200,000.00). Such security shall be held by and
made payable to the Director of Finance and shall not
expire for a period of two (2) years a+ter the te_- .-
nation of the business license for the secured pedi-
cab carrying passengers or property for hire. The
licensee shall not receive interest for such deposit.
Upon expiration of such two-year period, the licensee
shall be refunded the deposit or balance thereof,
provided no suit against the proceeds of such security
has been commenced during such period. The conditions
of liability for the security in this subsection
shall be the same as specified for policy of insurance
contained hereinabeve. The Director of Finance
shall satisfy from the proceeds of such security any
Judgment against the licensee and/or operator arising
from the operation of a pedicab for hire. Neither
the City, its officers, employees, agents or appointees
shall be liable to the licensee and/or operator for
any payments made pursuant to such judgment.

(c) No certificate for an operator of a pedicab shall be
issued to any person unless he has:.
(1) Satisfactoriip passed an examination showing:
(a) A sufficient understanding of the
traffic laws or ordinances of the City
and County of Sonclulu� and this ordinance.
(b) A sufficient understatf,ing of the
locations of streets, x*ads, and highways
within the City and CouL.:y of Honolulu.
(c) A sufficient understanding of the

character and physical fitness of the
applicant based on prior records or

The Chief of Police shall furnish every pedicab operator
a copy of this ordinance and any other pertinent laws,
rules and regulations for information and guidance.

Sec. 12-5_ 7 Compliance With All Applicable Provisions
of the Traffic Code.
Pursuant to Section 15-4.6 of the Revised Ordinances of
Nonclulu, 1969, as amended, every person operating a
pedicab shall be subject to provisions of Ordinance No.
3744 (Traffic Code), as amended, applicable to the driver
of any vehicle, except those provisions which by their
very nature can have no application. This is not to be
interpreted to authorize pedicabs to travel at low speeds
in the fast lanes of traffic, to cut in and out of traffic
abruptly; to travel counter to the aormal flow of traffic;
to disregard traffic signals, markings, and signs; to use the
wrong side of the street; to block traffic and pedestrians;
to use sidoromlks for any pu_-pose except as specifically
authorized; to stop or park except in authorized places; to
go the wrong way oa one-way streets; or to authorize any
other uses not legally allowed the operator (driver) of any
other private vehicle. The preceedizg acts by pedicab
operators are specifically prohibited and violators shall

Every person operating a pedicab upon a roadway at a speed
less than the no=al speed of traffic moving in the same
direction at such time shall ride as near to the right-hand
curb or edge of the roadway as practicable, exercising due
care when passing a standing vehicle or one proceeding is
the same direction except under any of the following
situations:
(a) When preparing for a left turn at an intersection or
into a private road or driveway, except where pro-
hibited by official traffic control devices;
(b) When reasonably necessary to avoid conditions (including,
but not limited to, fixed or moving objects, vehicles,
bicycles, pedestrians, animals, surface hazards, etc.
or substandard width lanes) that make it unsafe to
continue along the right-hand curb or edge. For,p=-
poses of this section, a "substandard width lane` is
a lane that is too narrow for a pedicab and a vehicle
to travel safely side by side within the lane; or

Sec. 12-5. __ Prohibited Acts.
In addition to complying with various provisions contained

(d) An additional passenger shall not be picked up without
the consent of the other passenger for hire already
in the pedicab. The fare of the additional.passenger
for hire shall be dete=ined by the passengers for hire
among themselves. The total fare shall be the same as
for one passenger.
(a) Pedicabs shall not be parked on public property.

signated for the parking of vehicles. When in metered
stalls, all fees shall be paid.

(a) Time Charges
Any driver, owner, or operator of a pedicab or pedicab
stand may charge or cause to be charged, any fare for
the use of a pedicab,, for purposes of hire on an
elapsed time basis provided that all fares shall be
prominently displayed both outside and inside each
pedicab for hire in order that any potential passenger
for hire may, be aware of the fares before a commitment
is made to hire the pedicab. Specific information on
the subject matter is contained hereinbeiow.
(b) Plat Fees and Tours.
As an alternative, a passenger for hire may be
given a choice of tours instead of time charges`
but the passenger shall be informed of which
alternative the passenger will be charged for,
before the trip is started.
A scale map showing the exact route or itinerary
of each tour shall be provided to each potential
passenger for hire by the pedicab operator. The pedicab
operator may demand the return of the map at the end

and optional tours shall be in English and Japanese and shall
be posted and be visible outside and in the cab at all times
to rassengers for hire. At the top of each sign showing fares
shall be the statement: "These far -as are not regulated by -
the Government" in bold type letters not less than 1/3 of

the fares schedule. Durinq all hours when vehicles are re-

cernible to the passengers for hire. The aforesaid schedule

Sec. 12-5.10 . Establishment of Road Pedicab Stands.
The City Council shall establish road pedicab stands on
public streets and City -controlled facilities upon re-
commendation of the Director of Transportation Services.
The Director of Transportation Services shall study and
recommend to the City Council the site placement of such
stands. The Chief of Police shall issue pedicab operator
certificates under another section of this article which
will automatically include pedicab stand permits. The fees
for such pedicab stand permits shall be established pursuant
to law.
Sec. 12- 5.11 Limitation of Pedicabs.
The City Council shall establish a limit on the number of
pedicabs used to carry fare -paying passengers for hire
operatinq in the City and County of Honolulu upon a finding
of public convenience and necessity based on the reccmmeacatior.

Said limit may be set prior to July l annually beginning
in 1979. Said recommendation shall be submitted sixty (60)
days prior thereto. The Director of Transportation Services
shall, by May 1, 1979 and each May lst thereafter, submit
to the City Council a recommendation an the limit on the
number of pedicabs for hire. Subsequent to the adoption
and approval of this ordinance, there will be no issuance
of any business license for pedicabs for hire until action
by the City Council, on the recommendation.on the limit on
the number of such vehicles, is taken.
See. 12-5.12 . Condition of Pedicabs for Hire.
No vehicle shall be operated as a pedicab fos hire unless
it is is a reasonably clean and safe condition inside`,
as well -as externally, so as not to injure or damage
the person, clothing or possessions of a passenger. The
vehicle's exterior shall be reasonably clean and shall be
essentially free from racks, breaks and major dents. it
shall be painted to provide adegzate protection and a
neat and clean appearance. Repai_s done to comply with
this section shall be done within a reasonable time based
on. availability of parts and labor.
Sec. 12- 5-_ 13 Authority of Chief of Police.

A pedicab operator may refuse to transport any item not
capable of being transported with= the confines of the
passenger comps.-t=ent of, the pedicab.
Sec. 12-5_ 15r . Disorderly Persons.
Notwithstanding any of the foregoing provisions, the
operator of a fixed stand may refuse to dispatch a
pedicab.tot and the operator may refuse to furnish
transportation to a disorderly person.
Sec. 12- 5.16 1. Soiling of Pedicab.
A pedicab operator may require a passenger for hire, .
whose condition may be likely to soil the seats of tad
pedicab, to sit upon protective material fu�-nished by
such operator. Upon non-compliance with the request,
the pedicab operator may refuse to transport such passenger.
Sec. L2- 5_1__. Penalty.
Unless otherwise provided for in this Article, any person
violating any of the provisions of this Article shall

Sec. Appeals.
(a) An applicant whose application for either a business
license or operator's certificate for pedicab for hire
has been denied, revoked, or suspended by the Director
of Finance and/or the Chief- of Police may file wi t.:ia
30 days after receipt of said revocation, suspension
or denial, an appeal for a hearing wits the Director
of Finance and/or Chief of Police, or their authorized
representatives. The appeal shall be effected by
filling out the notice of appeal in a form prescribed

applicable provisions of ERS Chapter 91.

The provisions of this Article by this ordinance are
hereby declared to*be sever able. Za accordance therewith,
if any portion of said article is held invalid for aAy
reason, the validity of any portion of this Article
shall not be affected and if the application of any
portion of this Article to any person, property or

any other person, property or circumstance shall not
be affected.

SECTION 1. Article 5 of Chapter 12, RO 1969, is hereby
amended in the following respects:
a. Section 12-5.1(j) is hereby amended to read as
fol-CW3:
( j ) "Baiting Tine" shall mean and include

the direction of or on behalf of a passenger for
hire and the time consumed due to traffic delays
while tranaporting a passenger for hire (which
time is automatically computed by the authorized
time measuring device].
b. Section 12-5.5 is hereby amended to read as
follows:
Sec. 12-5.5. Evidence Of Financial Responsibility.
The Director of Finance shall require evidence
of financial responsibility from the owner and/or
operator of the pedicab for hire before issuing a
business license and decal to engage in a pedicab
for hire. The owner and/or operator shall have
insurance in force or other evidence of financial
responsibility so long as the pedicab is used in
business.
Such evidence of financial responsibility may
be in one of the following two methods:
(a) insurance Policy.
The Director of'Finance shall retain the
original insurance policy issued by a company
licensed to do business in the State of Hawaii.
The policy shall be duly countersigned by its
authorized Hawaii agent complete with all en-
dorsements and attachments or a certified copy
thereof. Such policy shall provide for primary
public liability insurance coverage in the amount
of ONE HUNDRED THOUSAND DOLLARS ($100,000.00)
because of bodily injury to or death of one
person in any accident, and in the amount of

(b) Legal Tender or Other Securities.
A deposit with the Director of Finance of
legal tender, cashier's check, bank draft, irrev-
ocable letter of credit, certified check, bond or
other security determined to be satisfactory by
the Director of Finance in the total amount of
TWO HUNDRED THOUSAND DOLLARS ($200,000.00). Such
security shall be held by and made payable to the
Director of Finance and shall not expire for a
period of two (2) years after the termination of
the business license for the secured pedicab
carrying passengers or property for hire. The
licensee shall not receive interest for such •{
deposit. Upon expiration of such two-year period,
the licensee shall be refunded the deposit or bal-
ance thereof, provided no suit against the proceeds
of such security has been commenced during such period.
The conditions of liability for the security in this
subsection shall be the same as
specified for policy of insurance contained hereinabove.
The Director of Finance shall satisfy
from the proceeds of -such security any judgment
against the Licensee and/or operator arising from
the operation of a pedicab for hire. Neither the
City, its officers, employees, agents or appointees
shall be liable to the licensee and/or operator
for any payments made pursuant to such judgment.

(b) Within ZO working days from the filing of
such notice of appeal, the Director of Finance, or the
Chief of Police or their respective appointed hearings
officer shall conduct a hearing at which the appellant
shall be entitled to be heard in person or through
counsel and shall be given a full and fair opportunity
to present any fact showing the reason why the denial
was in error.
The Director of Finance, the Chief of police or
their respective appointed hearings officer shall have
the power to affirm, reverse, or modify the decision of
his departmental staff based uron findings of fact which

Sec. 12-5.13. Authority Of [Chief Of Police] Director
Of Finance.
(a) Denial, Suspension or Revocation of Pedicab
Operator's Certificate or Business License and License
Decal. .
The [Chief of Police] Director of Finance is
authorized to deny initial issuance or renewal or
suspend or revoke any certificate for a pedicab oper-
ator for hire and to suspend or revoke any business
license and license decal i4 an applicant cannot
meet the requirements set forth in this [ordinance]
article, or an operator viclates any of the provi-
sio— ns contained in this article. [Any applicant or
operator of a pedicab] In the case of suspension
or revocation of a certi3�cate or business license
and license decal by the Director of Finance, the
pe cab operator snail be afforded notice an, an
opportunity for a hearing [if a certificate is
denied, suspended, or revoked by the Chief of
Police] Prior to the suspension or revocation,
pursuant to the provisions of Chapter , Hawaii
Revised Statutes.
(b) Rule Making Powers.
The [Chief of Police] Director of Finance is
authorized to promulgate any ru es cr regu ations
not inconsistent with this ordinance, having the
force and effect of law, as provided for in Chapter
91, HRS, in the administration and enforcement of
this ordinance.
J. Section 12-5.18 is hereby amended to read as
follows:
[Sec. 12-5.18. Appeals.
(a) An applicant whose application for either
a business license or operator's certificate for pedi-
cab for hire has bean denied, revoked, or suspended
by the Director of r1nance and/or the Chief of Police
may file within 30 days alter receipt of said revoca-
tion, suspension or denial, an appeal for a hearing
with the Director of finance and/or Chief of Police
or their authorized representatives. The appeal shall
be effected by fillinq out the notice of appeal in a
form prescribed by the respective departments.
