WHEREAS, in recent months the Citv of Miami has been requested to authorize and regulate the operation of for -hire, human -powered passenger vehicles within the City's limits: and WHEREAS, the City of Miami does not presentiv regulate any for -hire vehicles, said authority having been pre-empted by Metro- politan Dade County Ordinance No. 81-85: and WHEREAS, it would appear that similar requests will be made of other municipalities located in Dade County; and WHEREAS, regulation of such public conveyances should be uniform throughout Dade County; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Metropolitan Dade County Board of County Commissioners is hereby urged to extend its regulation of for -hire vehicles by enacting ordinances which would include the regulation of human -powered for -hire vehicles. BACKGROUND On December 8, 1983 Mr. David Gates representing the DA-BAR Pedicab Service, Inc., appeared before the City Commission to request a six month trial period for his pedicab service; i.e. the right to operate the service for six months in the downtown area. Also present but not listed on the agenda was Mr. Paul Freedman of Royal Rickshaw. This matter was referred to the City Manager for further review. On December 15, 1983 a meeting was held with Mr. Freedman and his attorney, Mr. Gates and staff of the Planning and Law Departmgnts to discuss how such services would operate. Royal Rickshaw has been issued an occupational license by the City of Miami and is presently operating a for -hire rickshaw service in the downtown Coconut Grove area; Royal Rickshaw's operating premise is attached. DA-BAR has pending an application for an occupational license to operate a pedicab service in the downtown Miami area. A formal review of DA-BAR's proposal was performed and a recommendation by the Planning Department was distributed for the December 8, 1983 City Commission meeting. It is the opinion of City staff that this type of service could work in the City of Miami and would be a desirable feature in certain areas such as Coconut Grove, Downtown Miami and Little Havana. However, it is my opinion, formulated after several discussions with the Law Department and other City staff, that the City of Miami should not become involved in the regulating and licensing of either rickshaws or pedicabs, even though they may be desired urban ammenities or features, for two reasons. 84"w'136 0 First, until October 1, '?3; the City of Miami licensed and regulated all for -hire vehicles which picked up passengers within the City's boundaries. Cn that date Dade Count; Ordi^.ance #81-35 became effective, usurping all municipal regulatory jurisdiction of for -hire vehicles within Dade County. The enactment of the County Ordinance was resisted and appealed but the City but was ultimately unsuccessful in itc effort to retain jurisdiction. The second reason for this recommendation against City regulation is related to the first. That is, both DA-BAR and Royal Rickshaw have indicated their desire and intent to operate in other Dade areas, incorporated and unincorporated. Just as other for -hire operators should not, and are not, subjected to fractured or non- uniform regulation, nor should these services. Regulation should therefore be performed by Dade County on a county -wide uniform basis. 84-36 a r pI�V1.. FREEDMAN Royal Rickshaw is proud to announce its opening; of another short distance transportation system in Downtcom Miami. ?ick.shaw is a human powered non -motorized, two ?assen er, open air vehicle. The char;e zor our service is 3.25 per block per person ar when taking a ride for an extended period of time, the char;e is $.25 per minute: per person. ode plan to start the service officially October -0, 1983 with two Rickshaws, expanding to as many .as thirty-five within the next two months. The service will operate seven days a week, from 8:00 A4 - b:00 PM, until such time that there is a demand for longer hours of operation. This service will pick up and deliver in the Miami Downtown area only. We will be providing work for as many as 80 people in the near future and hope to be providing work'for up to 250 people in the Miami area within the next year. Rickshaws are not here to replace any of the already existing trans- portation systems such as bus and cab service. We are not planning to be in competition with the cab companies. Ours is a short distance service only. Royal Rickshaw operates in other locations in Canada and the United States and is in the process of opening many more locations in the near future. We have had a good response and acceptance of our service in these other locations and hope the same will be true of Miami. i Not only do we supply a transportation service, but also get involved in many of the community fund raising efforts. In the past, we have been involved in raising money for the Northern Alberta Children's Hospital Fund, Terry Fox Miles For Millions and the United Way. We hope that we can get involved as much if not more with these kinds of projects here in the City of Miami. ANALYSIS The pedicab service could be a novel and practical service for visitor and employees in the downtown area. Viewed in the context of recent efforts to introduce a more human scale, tourist oriented flair to activities downtown, this proposal can be seen as a positive image factor in a core area often perceived as harsh, rushed, and lacking in amenity. The central issue in this proposal, however, is the question of safety, and secondarily, disruption to traffic. Safety of passengers is largely a function of the pedicabs ability to move with traffic and avoid streetside hazards such as buses, trucks, and turning vehicles. Since core area traffic averages less than 11 miles per hour, the pedicabs should be able to maintain reasonable pace with traffic. By requiring all pedicab drivers to hold motor vehicle drivers licenses and observe certain operational precautions (listed above), it can be presumed that acceptable safety standards can be maintained. Notable exceptions, however, would be high speed traffic on Biscayne Boulevard (especially north of 6th Street) and Brickell Avenue, and the narrow Miami River bridges with steep approach grades. These hazardous areas would dictate confining the suggested trial operations to the immediate core area. It should be noted that Downtown Orlando has permitted for several months an identical pedicab service to operate in conjunction with the Church Street historic district. No problems have resulted to our knowledge. The Departments of Public Works and Police have no objection to the trial period provided all safety conditions are met. All steel tubing is heavy gauge and painted with DuPont Imron polyurethane enamel. Seats are high-grade nouaahyde upholstery, the top is made of :-)ecvv-duty convertible material. The bodies are molce Fiberglas. Brakes 8� Tires The pedicab has dual 6" hydraulic disc brakes in front. The combination of front and rear braking power is sufficient to stop the pedicab in all situations. Front and rear tires are 26 x 175. Electrical System Standard parts of the electrical system are turn signals, headlights, and brake lights in addition to reflectors on all sides. Safety Equipment Each cab has a horn, turn signals and brake lights to worn other vehicles. A serial number is permanently marked on every pedicob. Pedicabs are as safe as any transportation vehicle. They are made with the necessary safety equipment and are fully ref lectionized. One owner stated that he can recall only a couple of minor accidents during his years in business. -3- 840M* 36 DA-BAR PEDICAB SERVICE PROPOSAL Pedicabs can be utilized in a large capacity. Fee will be paid in advance, with no refund for cancellations. Renter will sign an agreement stating that he/she will at all times follow all rules and regulations. If he/she is the cause of harm/danger, regardless of nature, will at such time become liable for all costs. One pedicab can safely transport two (2) adults, one (1) adult and two (2) small children or three (3) children. No chauffeur will refuse or neglect to transport any passenger regardless of race, sex, religion, national orgin, age or physical disability. . Proposed hours of operation will be Monday through Friday mornings from 6:30 to 10:00 a.m., afternoons from 3:30 to 7:00 p.m. Exact times for weekends and holidays are not definite. A manager will be on call during business hours to handle complaints, maintenance, towing and emergences, etc. Fees will be determined by distance to be travelled in accordance with the rate schedule. To insure that accurate fees are charged on a consist basis each pedicab will be equipped with a pedimeter to show the exact distance travelled as well os exact cost. Should the passenger request the chauffeur to wait, the passenger will pay the waiting fare in accordance with rate schedule. At the time of wait request the passenger will give the chauffeur a return time, not to exceed five (5) minutes. As as alternative, a passenger for hire may be given a choice of tours instead of time charges but the passenger shall be informed of which alternative the passenger will be charged for, before the trip is started. A scale map showing the exact routs or itinerary of each tour shall be provided to each potential passenger for hire by the pedicab operator. Section 12-3.10 is hereby amended to read as follows: Sec. 12-5.10. Establishment Of Road Pedicab Stands. The City Council shall establish road pedicab stands on public streets and City -controlled facilities upon recommendation of the Director of Transportation Services. The Director of Transpor- tation Services shall study and recommend to the City Council the site placement of such stands. The [Chief of Police] Director of Finance shall issue pedicab operator certificates under another section of this article which will automatically include pedicab stand permits. The fees for such pedicab stand permits shall be established pursuant to law. q. Section 12-5.12 is hereby amended to read as follows: Sec. 12-5.12. Condition Of Pedicabs For Hire. No vehicle shall be operated as a pedicab for hire unless it is in a reasonably clean and safe condition inside, as well as externally, so as not to injure or damage.the person, clothing or pos- sessions of a passenger. The vehicle's exterior shall be reasonably clean and shall be essentially free from cracks, breaks and major dents. It shall be painted to provide adequate protection and a neat and clean appearance. The Director of Finance shall issue business licenses for pedicabs for hire and collect the required fees in accordance with the provisions of this Article and a:y other applicable provisions of the law. The issued business licenses shall not be transferable and shall be mounted within the cab so that it is readily visible to all passengers. (b) Fees. (1) The annual fee for a business license for pedicab shall be TIAM= FOUR DOLLARS ($24.00) per vehicle: provided that, when a business license fee has already been paid on a vehicle and that vehicle is, within the year, replaced by another vehicle, the unexpired pc--.. ion of the business License fee paid on the vehicle so replaced shall be credited to the business license fee payable for the substitute vehicle. For the purposes here- of, the unexpired portion of the business license fee paid on the vehicle which has been replaced shall be that portion of the annual fee which is equal to 8-1/3 per cent of said fee multiplied by the number of full. months remaining during the cw=rent licensing year. The business licensing year shall start on July 1 and te-=inate on Jrne 30, year following. 84-' 136 9 Whenever a.vehicle licensed as a pedicab is re- placed by another vehicla under the provisions of this Article, the sum of FIVE DOLLARS M- 00) in addition to the business license fee shall be assessed against the owner of the vehicle so replaced to defray the administrative costs incurred by the City. (1) The holder of a business license for a pedicab shall immediately surrender said license to the Director of Finance: a. If in the interim, the vehicle is taken out of service permanently for any reason. (2) Upon surrender, the license for a pedicab shall be cancelled. Sec. 12-5.3 Pedicab Business License Decal. The Director of Pinion shall annually furnish the owner of a pedicab a business license decal similar to that currently issued in the licensing of taxis and buses upon the payment of ONE DOLLAR ($1.00) which shall be valid until the 30th day of June next following the date of issue. The sums ccU&cted shall be deposited in the General Fund. The decal is partly for identification of the ped:cab. Zt shall be large enough to be legible from a reasonable distance. The decal shall be fastened or displayed on the rear of the vehicle for which it was issued. Sec. 12- 5.5 0 Evidence of Financial Responsibility. The Director of Finance shall require evidence of financial responsibility from the owner and/or operator of the pedi- cab for hire before issuing a business license and decal to engage in a pedicab for hire. The owner and/or operator shall have insurance in force or other evidence of financial responsibility so long as the pedicab is used in business. Such evidence of financial responsibility may be in one of the following two methods: (a) Insurance Policy. The Director of Finance shall retain the original insurance policy issued by a company licensed to do business in the State of Hawaii. The policy shall be duly countersigned by its authorized Hawaii agent complete with. all endorsements and attachments or a certified copy thereof. Such policy shall provide for prima_-y public liability insurance coverage in the amount of ONE HUNDRED THOUSAND DOLLARS ($100,000.00) because of bodily injury to or death of one person in any accident, and is the amount of rPTO HUNDRED TSOUSANJ DOLLARS (52000000.00) because of bodily inj=y to or death of L-oa or more persons in any one accident, and property damage insurance in the amount of TWENTY THOUSAND DOLLARS ($20,000.00) because of damage tc or destruction of property of others is any one accident for each pedicab for hire. Such security shall be held by and made payable to the Director of Finance and shall not expire for a period of two (2) years a+ter the te_- .- nation of the business license for the secured pedi- cab carrying passengers or property for hire. The licensee shall not receive interest for such deposit. Upon expiration of such two-year period, the licensee shall be refunded the deposit or balance thereof, provided no suit against the proceeds of such security has been commenced during such period. The conditions of liability for the security in this subsection shall be the same as specified for policy of insurance contained hereinabeve. The Director of Finance shall satisfy from the proceeds of such security any Judgment against the licensee and/or operator arising from the operation of a pedicab for hire. (a) whenever the operator's certificate of any pedicab operator is suspended or revoked, the Chief of Police shall require that the pedicab operator's certificate be surrendered to and be retained by the Chief of Police, except that at the and of the period of suspension the certificate so surrendered shall be retux-ned to the licensee. Sec. 12-5_ 7 Compliance With All Applicable Provisions of the Traffic Code. Pursuant to Section 15-4.6 of the Revised Ordinances of Nonclulu, 1969, as amended, every person operating a pedicab shall be subject to provisions of Ordinance No. 3744 (Traffic Code), as amended, applicable to the driver of any vehicle, except those provisions which by their very nature can have no application. This is not to be interpreted to authorize pedicabs to travel at low speeds in the fast lanes of traffic, to cut in and out of traffic abruptly; to travel counter to the aormal flow of traffic; to disregard traffic signals, markings, and signs; to use the wrong side of the street; to block traffic and pedestrians; to use sidoromlks for any pu_-pose except as specifically authorized; to stop or park except in authorized places; to go the wrong way oa one-way streets; or to authorize any other uses not legally allowed the operator (driver) of any other private vehicle. Every person operating a pedicab upon a roadway at a speed less than the no=al speed of traffic moving in the same direction at such time shall ride as near to the right-hand curb or edge of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding is the same direction except under any of the following situations: (a) When preparing for a left turn at an intersection or into a private road or driveway, except where pro- hibited by official traffic control devices; (b) When reasonably necessary to avoid conditions (including, but not limited to, fixed or moving objects, vehicles, bicycles, pedestrians, animals, surface hazards, etc. or substandard width lanes) that make it unsafe to continue along the right-hand curb or edge. The fare of the additional.passenger for hire shall be dete=ined by the passengers for hire among themselves. The total fare shall be the same as for one passenger. (a) Pedicabs shall not be parked on public property. except in those locations specifically designated as 'Road Pedicab Stands' or in other locations de- signated for the parking of vehicles. (a) Time Charges Any driver, owner, or operator of a pedicab or pedicab stand may charge or cause to be charged, any fare for the use of a pedicab,, for purposes of hire on an elapsed time basis provided that all fares shall be prominently displayed both outside and inside each pedicab for hire in order that any potential passenger for hire may, be aware of the fares before a commitment is made to hire the pedicab. Specific information on the subject matter is contained hereinbeiow. (b) Plat Fees and Tours. As an alternative, a passenger for hire may be given a choice of tours instead of time charges` but the passenger shall be informed of which alternative the passenger will be charged for, before the trip is started. A scale map showing the exact route or itinerary of each tour shall be provided to each potential passenger for hire by the pedicab operator. The City Council shall establish road pedicab stands on public streets and City -controlled facilities upon re- commendation of the Director of Transportation Services. The Director of Transportation Services shall study and recommend to the City Council the site placement of such stands. The Chief of Police shall issue pedicab operator certificates under another section of this article which will automatically include pedicab stand permits. The fees for such pedicab stand permits shall be established pursuant to law. Sec. 12- 5.11 Limitation of Pedicabs. The City Council shall establish a limit on the number of pedicabs used to carry fare -paying passengers for hire operatinq in the City and County of Honolulu upon a finding of public convenience and necessity based on the reccmmeacatior. by the Director of Transportation Se --vices. The Director of Tsanspor+ratioa Services shall make an annualreccaaerda tion to the City Council based upon'h3s stmedy and review which shall include, but not be limited to, the following: 84-" 136 L . The Director of Transportation Services shall, by May 1, 1979 and each May lst thereafter, submit to the City Council a recommendation an the limit on the number of pedicabs for hire. Subsequent to the adoption and approval of this ordinance, there will be no issuance of any business license for pedicabs for hire until action by the City Council, on the recommendation.on the limit on the number of such vehicles, is taken. See. 12-5.12 . Condition of Pedicabs for Hire. No vehicle shall be operated as a pedicab fos hire unless it is is a reasonably clean and safe condition inside`, as well -as externally, so as not to injure or damage the person, clothing or possessions of a passenger. The vehicle's exterior shall be reasonably clean and shall be essentially free from racks, breaks and major dents. it shall be painted to provide adegzate protection and a neat and clean appearance. A pedicab operator may require a passenger for hire, . whose condition may be likely to soil the seats of tad pedicab, to sit upon protective material fu�-nished by such operator. Upon non-compliance with the request, the pedicab operator may refuse to transport such passenger. Sec. L2- 5_1__. Penalty.
