A RESOLUTION ACCEPTING THE F-LAT E;NTI'ILE:D "AIRPORT SEVEN", A SUBDIVISIO14 IN THE CITY OF MIAMI; ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT AND PROVIDING FUR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF DADE COUNTY", FLORIDA. biHEREAS, the Department of Public Works has recommended the acceptance of the plat entitled "Airport Seven"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The plat entitled "Airport Seven", a sub- division of the West 1/2 of the East 1/2 of the N.E. 1/4 of the N.W. 1/4 of the N.E. 1/4, Section G, Township 54 South, Range 41 East, less the South 100 feet thereof, less the North 35 feet thereof, all lands described herein being in City of Miami, Dade County, Florida, which plat by reference is made a part hereof as if fully incorporated herein, is hereby accepted; and the dedications shown thereon together with the dedications to the perpetual use of the public of all existing and future planting, trees and shrubbery on said property, are also hereby accepted and confirmed by the City of Miami, Florida. Section 2. The City Manager and City Clerk are hereby authorized and directed to execute the plat and cause the same to be recorded in the Public Records of Dade County, Florida. The proposed record plat entitled Airport Seven is a subdivision of the West 112 of the East 112 of the N.E. 1/4 of the N.W. 1/4 of the N.E. 1/4, Section 61 Township 54 South, Range 41 East, less the South 100 feet thereof. All lands described herein being in City of Miami, Dade County, Florida, less the North 35 feet thereof. The plat consists of two tracts having a total area of 1.76 *_ acres. It is zoned RG-3/6 . This plat is being forwarded to your office for City Commission action. Also attached are the following itemized papers necessary to present the Plat to the City Commission of Miami: (1) Resolution accepting the Plat (2) Print of proposed Record Plat (3) Agreement form pertaining to subdivision improvements (4) Opinion of Title (5) Memorandum from the Miami -Dade Water and Sewer Authority pertaining to water mains and appurtenances (6) Portion of City Zoning Sheet No. 31 showing property platted colored in red. /n %If B : t d �l 84-,219 r THE CITY OF MIAMI, FLORIDA DEPARTMENT OF PUBLIC WORKS January 27, 1984 I' REPORT OF PROPOSED RECORD PLAT OF AIRPORT SEVEN LOCATED AT N.W. 7 STREET BETWEEN N.W. 51 AVENUE AND N.W. 49 AVENUE A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA The accompanying Plat entitled Airport Seven was prepared by Lannes and Garcia Inc. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: (1) The property platted is a subdivision of the West 1/2 of the East 1/2 of the N.E. 1/4 of the N.W. 1/4 of the N.E. 1/4, Section 6, Township 54 South, Range 41 East, less the South 100 feet thereof. All lands described herein being in City of Miami, Dade County, Florida, less the North 35 feet thereof. The plat consists of two tracts having a total area of 1.76 acres # It is zoned RG-3/6. (2) The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami,.Florida. (3) As cerbified to by Roman Lannes, Registered Land Surveyor, this Plat complies with the plat filing laws of the State of Florida. (4) The attached Certificate of Title Examination dated January 18, 1984, signed by Leslie Alan Schere, Attorney, indicates that the fee simple title to the property platted is correctly vested in Airport Seven Associates Joint Venture and the Plat has been correctly executed. (5) The area platted is encumbered by a mortgage and the mortgage holder has executed the Plat and joined in its dedications. j 84-21S (6) In accordance with the requirements of Chapter 54, Section 54-30, of The Code of The City of Miami, Florida, a Letter of Credit #740 in the amount of $22,000 has been executed by Airport Seven Associates Joint Venture, principal, and Consolidated Bank, N.A. In accordance with the provisions of said Chapter 54, Section 54- 30, THE CODE OF THE CITY OF ,r11.k%1I, FLORIDA, the Principal !j herewith tenders to the City a Letter of Credit in lieu of a Perform- ance Bond or Cashier's Check, duly executed by .the �CCNSOLIDATID BANK N.A. -- , in the amount of $22,000.OQ which amount is not less than one hundred (100i:) percent of the estimated cost of the const-ruction of the improvements listed in the attached Exhibit "B", plus twenty-five (25:) percent for en,,ineerino and contingent costs and damages, and upon completion of the construction of said improvements and subse- quent to the submission by the Principal to The City of Miami Depart- ment. of Public Works of a letter from a Registered Land Surveyor certifying that the Permanent Reference Monuments indicated on the Plat have been installed and properly placed; said Letter of Credit shall be released. 3. In the event the Principal shall fail or neglect to Fulfill his obligations under this Agreement, the conditions of said Letter of Credit shall be such that the OCNSOLIDATED BANK N.A. shall, within thirty (30) days after receipt of written notice from the Director of the Department of Public Works of said City of the failure or of the neglect of the Principal to perform this Agreement, construct, or cause to be constructed, the imp'rovments set forth in Exhibit "D" hereof, pay to the City a sum up to the aggregace amount of $22,000.00 4. The City shall have the right to collect the sum estimated to construct or complete the improvements set forth in Exhibit "B'.,z said sum to be estimated by the Department of Public Works of the City, which shall include engineering and contingent costs and any damages direct or indirect, not to exceed-25% thereof, plus reasonable attorneys' ft:e , -which th•2 City may sustain on account of the failu:q of the prin :i- pal to carry out and execute all of the- provisions of this Agreement; provided further that the City Commission of Miami, Florida, shall have the right to construct, or cause to be constructed, after public adver- tisement and.receipt of bids, the improvements as'provided for 'in saia Agreement, and Id the event that the City Commission of Miami, Florida exercises such right, it shall have the right to collect the final total costs of said improvements., together with any engineering and con- tingent costs, and any damages direct or indirect, not to exceed L enty-five (25%) percent thereof, plus reasonable attorneys' fees, which the City may sustain on account of the failure of the Principal to carry out and execute the provisions of this Agreement. This letter Agreement will set forth those terms and conditions under which the Miami -Dade Water & Sewer Authority Department, hereinafter called Department, will provide water and sewer service to a proposed 88,954 square foot office building. Water service can be provided from an existing 16 inch water main located in N.W. 7th Street abutting the refer- enced property. Water service lines which will be connected to existing mains must be installed by the Department per- sonnel. The property owner will pay to the Department its standard service line installation charge prior to any such installation. If the State Road Department requires a jack and bore installation, the Developer will be responsible 4 for the additional cost. Airport Seven A�-ociates January 6, 1984 Page Three In the event that the Department provides future direct retail service to any customer from the water and sewer mains installed pursuant to this Agreement on properties owned by others at the execution of this Agreement, the Department will access a construction charge equal to ter. dollars ($10.00) multiplied by the front foot lenath of each future connect_nc property. Should any corner properties owned by others abet;. the subject installation on two sides, the longer side only will be used for computing the construction connection chare_e. However, said charge will not be assessed or collected for buildinc occupied or under construction prior to the date of this Agreement. Said connection charges shall be reimbursed by the Department to you within ninety (90) days of receipt of same. The Department's 'liability for such reimbursements shall be limited to those amounts actually collected from other property owners. This reimbursement provision shall remain in effect for a period of eight (8) years after the execution of this Agreement. It shall be your responsibility to provide the Department with a current mailing address dur- ing the eight (8) year period. The Department will require a water connection charge of $6,849.15 and a sewer connection charge of $5,070.15 for a total connection charge of $11,919.30. The water and sewer connection charges will be remitted in tha following manner: a. $5,000.00 with the execution of this Agreement. b. $6,919.30 prior to setting meters. In addition, the Department will require a guarantee deposit based on the Department's Rules and Regulations in effect at the time service is requested. The terms and conditions contained herein will remain valid for a period of sixty (60) days from the date of this Agreement. Once executed, work on the project must commence within two hundred seventy (270) days from the execution date. Work shall be considered to have commenced and/or be in ac- tive progre-s when a full complement of workmen and equipment is present at the site to diligently incorporate materials and equipment into the permanent buildings of the water facil- ities throughout the day on each full working day, weather permitting. If the property owner fails to comply, then any obligations of the Department arising from this Agreement shall be deemed null and void and unenforcable.
