City manager's Emoluments
At the February 28, 1984 meeting, the City Commission adopted the
following Motion 84-225:
A MOTION DIRECTING THE CITY MANAGER
TO SCHEDULE A DISCUSSIO14 ITEM AT THE
MEETING OF MARCH 8, 1984, AT 9:30 A.M.,
REGARDING THE MATTER OF DEFINITION OF
BE14EFITS AND EMOLUME14TS THAT CITY
MANAGER HOWARD V. GARY IS TO RECEIVE
FROM THAT DATE FORWARD; AND FURTHER,
TO DISCUSS THE QUESTION OF REIMBURSEMENT
BY THE CITY MANAGER OF ALL COSTS IN-
VOLVED IN REPAIRS WHICH WERE MADE TO HIS
PRIVATE CARS.
Subsequent to the adoption of that motion, Commissioner Carollo
requested "a full accounting, year by year, since he has been our
City Manager, of all the money, of all the benefits, the
emoluments that he has received from the City of Miami, including
the reimbursement that he has received fro►n the City that he has
had."
This memorandum is intended to respond specifically to Motion
84-225 and to the specific request of Commissioner Carollo. For
reference, minutes of the February 28, 1984 Commission meeting
are included as Exhibit I. Additionally, individual attachments
(I-XVI)are provided that specifically respond to the Commission's
request. These attachments are identified as follows:
Attachment I - Actual Salary Payments
Actual salary payments made to the City Manager by fiscal year.
Attachment II - Salary History
All salary increases for the City Manager since his appointment
in April, 1981.

Attachment III - Projected Base Salary of P. W. Andrews
Projected salary of P. W. Andrews thru October 2, 1983, had he
remained City Manager and continued to receive cost of living
and anniversary increases in accordance with the then Commission
policy of granting to the City Manager the same increases as
provided in collective bargaining agreement covering general
employees.
Attachment IV - Projected Base Salary of Joseph R. Grassie
Projected salary of Joseph R. Grassie thru October 2, 1983, had
he remained City Manager and continued to receive cost of living
and anniversary increases in accordance with the then Commission
policy of granting to the City Manager the same increases as
provided in collective bargaining agreement covering general
employees.
Attachment V - Summary of Base Salary of City Managers
Base salary of City Managers P. W. Andrews, Joseph R. Grassie and
Howard V. Gary as of October 2, 1983.
Attachment VI - FICA Cost
Actual City portion of FICA for the City Manager for each fiscal
year. The same formula is applied to all City employees covered
by FICA.
Attachment VII - Pension Cost
Actual pension cost to the City for the City Manager by fiscal
year. Pension contribution is on the same basis as that for
general employees on a percentage of payroll as determined
annually by the City's actuarial report for the Pension Plan.
Attachment VlII - Insurance Cost
The City expense for group health, life and accidental death, and
whole life and disability insurance. The City is a co -
beneficiary of the whole life policy.
Attachment IX - Expense Allowance
Actual payments to the City Manager by fiscal year. The annual
allowance ($2500) is the same as for the former City Manager.

Attachment X - Travel Expenses (including airfare)
Shown are actual travel costs. Airfare is paid directly to a
carrier and other documented travel expenses reimbursed to the
City Manager. Both City Managers were reimbursed for all
documented travel expenses.
Attachment XI - Professional Fees, Dues and Memberships
Cost of professional fees, dues and memberships on behalf of the
City Manager. The basis of this expense is consistent with that
of prior City Managers.
Attachment XII - City Attorney's Memorandum
City Attorney's memorandum of April 15, 1982 advising that the
City Manager ma provide his own vehicle stating that "...in such
event the City is r?sponsi�le for purchase„ insurance maintenance
and repairs."
Attachment XIII - Personal Car Maintenance Expense
Actual cost and available work orders as provided by the
Department of Building and Vehicle Maintenance for maintenance
performed on personal vehicles operated by the City Manager in
lieu of a City owned vehicle.
Attachment XIV - Personal Car Expenses
Payments made to the City Manager for use of his personal
vehicle. Also included are charges made to the Office of the
City Manager's budget for City vehicle(s) when utilized by the
City Manager.
Attachment XV - Auto Insurance Cost
Amount by fiscal year paid by the City for automobile insurance
coverage for the personal vehicle utilized by City Manager for
City business.
Attachment XVI - Personal Protection
Documented incidents creating concern for t►le City Manager's
safety and the associated expense of providing coverage.

In summary, the requests of the City Commission relative to
emoluments provided the City Manager have been outlined in a
manner to provide the City Commission with this information in a
practical format. I trust this satisfactorily responds to the
City Commission's request.

MEETING
Mayor Ferre: Is that the motion?
Mr. Carollo: Including the pension, and everything else.
Mayor Ferre: Is there a second?
Mr. Carollo: I am not going to give one additional benefit to Mr.
Gary that a prior City Manager did not have.
Mayor Ferre: Is there a second to the motion? That is not a part of
the motion.
Air. Carollo: No, no. That is not a part of the motion. Those are my
personal views. The motion is to have as the first item on the Agenda,
the topic that we discussed here of Mr. Gary's...
Mayor Ferre: The definition of Mr. Gary's emoluments, besides his
salary.
Mr. Carollo: Right, and the issue of Mr. Gary reimbursing the taxpayers
of Miami for the approximate $9,000 he received in car repairs.
Mayor Ferre: Or, whatever it is.
Mr. Carollo: Whatever it is.
Mayor Ferre: Expended in car repairs.
Mr. Carollo: If it is more, it is more.
Mayor Ferre: Part of that may have been in maintenance, and we have to
get into that. Okay, is there a second to that motion?
Mr. Plummer: Is the motion just to move it over to March 8th?
Mayor Ferre: Yes.
Mr. Plummer: I second the motion. Under discussion.
Mayor Ferre: Go ahead.
Mr. Plummer: Mr. City Attorney, prior to March 8th it is a pretty well
known fact that Mr. gary has appeared at his own request at the State
Attorney's office in,this matter. I would ask you sir, to determine
from Ms..Reno whether or not this Commission, entering into such a dis-
cussion would interfere, or be construed as interfering, if that inves-
tigation is not concluded. Second of all, the Mayor touched on, and I
would like...I guess I have to ask the Manager, I can't ask the City -
Attorney that the bills of $9,000, or whatever the bills are, as
Carollo has said, $9,000 plus $400, whatever those bills are - that
a breakdown be made and some competent person, whether it is in house,
or out, trying using the City Attorney's ruling, what is maintenance
and what is repairs.
Mr. Carollo: J. L., let me say this to you.
Mr. Plummer: I don't know, okay, but I am just asking that be prepared
for the next meeting for this discussion?
Mr. Carollo: There is no way that you are going to get any City employee
giving us an honest opinion, because if you do, they are going to get a
phone call at 2:47 A.M, and they are not going to be a City employee any
longer. If you leave it up to the Manager to go to an outside counselor,
we might get George Knox again!
Mayor Ferre: Well, you are not going to recommend Norman Braman, are
you?
Mr. Carollo: No, I am not. I think the Mayor would agree to it to
greatly. (LAUGHTER) With the Mayor's money, it could do that, but I
think...
�1r. Plummer: I said in house or out, I don't care, Joe. I am not try-
ing to make a ...
"r. Carollo: J. L., I think that what we should do is when that time
comes, let's get copies of all the maintenance repairs, and I think
this Commission could pick up fairly simply what is maintenance and
what is repairs. If we can't, then let's go to someone outside, and
we pick them.
Mr. Perez: Okay.
Mayor Ferre: All right, is the motion clear? Call the roll.
The following motion was introduced by Commissioner Carollo, who
moved its adoption.

Upon being seconded by Commissioner Plummer, the motion was
passed and adopted by the following vote:

ABSENT: Commissioner Miller J. Dawkins
Mr. Carollo: Mr. Mayor, real brief - I would like from the Manager be-
fore March 8th, hopefully at least, but not before, a full accounting,
year by year, since he has been our City Manager, of all the monies, of
all the benefits, emoluments, that has received from the City of Miami,
including reimbursements that he has received from the City for any
expenses that he has had. These are things, Mr. Mayor, that are public
record...
Mayor Ferre: Wait a minute, I think you near to be clearer.
Mr. Carollo: In other words, what I am asking for - I want to know
every single penny that the City of Miami has spent on Mr. Gary either
through salary, benefits, emoluments, or reimbursements.

Mayor Ferre: Okay, that clarifies it, tecause I thin: the way you said
it before was also subject to interpretation.
Mr. Carollo: But I would just like to have it before the March 8th
meeting.
Mayor Ferre: Okay, I don't think we need a motion for that, do we?
Mr. Carollo: No, we don't need a motion for that.
Mayor Ferre: All right, is there anything else on this?
Mr. Carollo: Yes, Mr. Mayor. tor. Mayor, I think we all will acknowledge
that because of the positions that we all hold at different times, there
might be a greater risk of danger to each of us, but I think you have to
draw a line at what is reasonable and what is not - evne though at times
during election campaigns, for one or two days, at different occasions
for most of us, all of us, police protection has been extended. It
has been something that has been done in a reasonable level and for a
very short period of time. What I would like to know is, how long has
.the Manager been having body quards with him around the clock; how much
is it costinq the City of Miami, all the fonH that is heina spent when he
goes out to restaurants, the liquor tabs when he goes out to bars with
them - who is paying for that? Is it the Manager himself, or the City
of Miami? I would like to know how much it is costing the taxpayers
in the salaries and benefits that are being paid for these officers
that are guarding the Manager, and the others that are guarding his
home? And for how long a period of time has that been extended? I
understand that at times we all have had threats in our lives , for
that matter, our families. Mr. Mayor, I will say it publicly. I think
I received as many, if not more threats against me and my family than
anyone in this Commission and I am not going around like the days of
Capone in Chicago with body guards everywhere, nor do you see ... well, I
think I am making my point clear, Mr. Mayor.
Mayor Ferre: That is your second request.
Mr. Carollo: There has to be a line drawn, and the resources that we
are using that Police Department for....
Mayor Ferre: We are not dealing with that issue today - what you are
asking is for the information on the cost, as you required. Is that
correct?
Mr. Carollo: Mr. Mayor, what I am asking for is to get a full accounting
of the taxpayer's monies that are being spent on this police protection
as body guards and for how long has this been going on. Now, and at
different times in the future, any time that it has gone on for more
than three days at a time.
Mayor Ferre: All right, any other requests?

would require three votes out of the nine to overrule my ruling, but I
am not going to do that.
Mr. Carollo: You understand what the Mayor has stated. He stated he
does not want the attorney to appear before the Commission, so that
you have the attorney meet with our attorney to see if our attorney is
going to change his mind, and is going to admit that his knowledge of
the particular issue is not what he had represented to us that it was.
Mr. Perez: Of course, as a matter of courtesy, also, we don't have one
member of this Commission today - I would like to discuss this item as
the first issue of the next Commission meeting as a courtesy. But, I
want to ratify in the same way that I tried to have Chief Harms to have
the opportunity to be listened to by this Commission, I would like that
the attorney, whatever they want to explain or clarify - I have my own
point of view and I am very clear, but I would like to give him this
courtesy and I would like to have the opportunity to discuss this item
at the next Commission meeting.
Mr. Carollo: Well, it is a shame that so many of us were not as courteous
when it came to Harms, but it is obvious that I don't have the votes to
bring this to a head now, so Mr. Mayor...
Mayor Ferre: I don't know whether Plummer wants to ... okay, well, wait
a minute. Joe, I think it is very important now, because we are going
on very important issues now. The difference between this and the Harris
matter, is...
Mr. Garcia -Pedrosa: Mr. Mayor, may I respectfully interrupt you, There
is a lawsuit just been filed, and if you would do me the favor and not
get into that topic, I think I wouldn't.
Mayor Ferre: I am not going to do you the favor, because I am going to
make a statement very simply into the record. The City Manager works for
the City of Miami. The Police Chief works for the City Manager, and
that is a very substantial difference.
Mr. Carollo: They both work for the people of Miami.
Mayor Ferre: And ye' all work for the people of Miami.
Mr. Perez: Each member of this Commission has his right to request a
procedure that they want to clarify.
Mr. Carollo: Mr. Mayor, let me make the following motion, then, that
the next City Commission meeting of March 8th, we will put this issue
as the Number one item on the Agenda at 9:00 A.M.
Mayor Ferre: Excuse me, 9:30 A.M., because that is after the...
Mr. Carollo: 9:30 A.M., yes, right. And, to include discussion to
clearly outline the complete benefits that the Manager is to receive

Some question has arisen as to an interpretation of Section 4(c)
of the compensation agreement of City Manager Howard V. Gary.
I have read that provision and advise you as follows:
It appears that the ultimate objective of this provision
is that the City Manager have exclusive and unrestricted use of
an automobile to such an extent that his usual duties would not
be restricted by the absence of the immediate access to an auto-
mobile.

Further, that Manager Gary has the option to enjoy the
same benefits, vis-a-vis, an automobile as his predecessor enjoyed,
In the alternative, under this Agreement, Manager Gary may provide
his own car. In such event the City is responsible for the pur-
chase. -insurance. maintenance and repair.
The third alternative available to Manager Gary is that
he may rent or lease a vehicle, in which event the City is respon-
sible for the rental costs plus maintenance and gas.
There does not appear to be any restrictions on Mr. Gary's
exercise of any of the foregoing options.

The below listed incidents created a concern for the City
%tanager's personal safety.
January 27, 1984 - Four (4) threatening telephone calls were
received by the City Manager's office.
January 31, 19814 - A large rusty knife was found in a bag on the
balcony of City Hall following a public
meeting regarding the firing of Mr. Harms.
February 1, 1984 - Twenty (20) members of the news media crowded
in the City Manager's office complex to view
files. Police presence was required to main-
tain integrity of Police documents.
February 3, 1984 - A white sedan with tinted windows, followed
the Manager and Police Officers assigned to
protect him from City Hall.
A van occupied with at least two (2) persons
picked up where the sedan left off.
February 5, 1984 - Michael Stevens, a self -acknowledged member of
the Ku Klux Klan, called the Police Department
and made threats of violence against 'Mr. Gary.
The subject was arrested - Case #030-5021.
February 7, 1984 - A young muscle-bound man circled the Manager
in an intimidating manner. Police presence
aborted a confrontation.
February 8, 1984 - An unknown male telephoned the City ;tanager's
office and made threats against Mr. Gary.
February 9, 1934 - Another telephone threat against Mr. teary was
received by the City Manager's office.
February 27, 198i4 - A bomb threat was received by 1'.1r. Gar y's
office.
During the February 9, 1934 City Commission meeting, a male
attempted to approach the City Manager several times and engage
him in conversation. After the meeting, the subject confronted
the Manager and made abusive remarks. The subject appeared to be
mentally disturbed and was transported to Crisis Intervention.
