COMMISSION AFTER A DI1LY ADVERTISED
PUBLIC HEARING, THE RFQIJIREMENT FOR
FORMAT_ SEALED BIDS FOR THE PURCHASE BY

AUTHORIZING THE CITY MANAGER TO INSTRUCT
THE PURCHASING AGENT TO ISSUE PURCHASE
ORDERS FOR THESE REPAIRS.
WHEREAS, the Department. of Parks and Recreation is
charged with the responsibility of swimming pool operations;
and
WHEREAS, the existing condition of nine (9) pools
mandates immediate repairs in order to open I.o the general
public by the forthcoming summer season opening dates
beginning March 31, 1984;
WHEREAS, the formal hid procedure for said repairs would
create a prohibitive time frame ultimately delaying the
openings of said pools; and
WHEREAS, funds for this purchase are available from the
Capital Improvements Program, Swimming Pool Renovations Fund;
and
WHEREAS, the City Manager has made a written finding,
that a valid emergency need exists for the herein described
repairs to the swimming pools;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. By an affirmative vote of 4/5ths of the
Members of the City Commission, after a duly advertised
public hearing, the City Manager's written finding that a
valid emergency need exists for considering the herein

Section 2. The requirement for formal sealers bids for
providing swimming pool repairs is hereby waived and the
purchase of

the Capital Improvements Program, Swimming Pool Renovations
Fund.
Section 3. The City Manager is hereby authorized to
instruct the Purchasing Agent to issue Purchase Orders for
these repairs.

It is recommended that the Citv Commissior
ratify, approve, and confirm, by an affir-
mative vote of not less than four fifths
(4/5) of its members the action of the City
Manager in authorizing the waiver of formal
bids for various emergency repairs to nine
(9) City pools, totaling an amount not to
exceed $250,000, to be an emergency; and
in authorizing the use of emergency pur-
chase procedures for the implementation of
said projects; in accordance with ordinance
No. 9572, adopted on February 10, 1983,
which ordinance established nrocedures for
emergency purchases, as ner the attached
resolution.
An evaluation of current conditions of the City's swimming pools
determined the facilities to be in immediate need of repairs prior
to their scheduled seasonal dates targeted for March 31, 1984.
These repairs may be initiated as prioritized in the attached re-
ference memorandum for $250,000.
In that swimming pool activities are an essential ingredient in the
summertime pursuits of the City of Miami youth, this department re-
quested and subsequently received authorization from the City Mana-
ger for emergency purchase orders for repairs. This action of
waiving the competitive bidding process prevented the creation of
a prohibitive time frame for completion of work, which ultimately
would have delayed the opening of the pools.
Funding for this project is available from contributions from the
Debt Service Fund into the Capital Improvement Program.

I have found that an emergency need exists for waiving formal bid-
ding procedures for swimming pool repairs in a total amount of
$250,000, based on information provided to me by the Director of
Parks and Recreation and Building and Vehicle Maintenance.
Background:
The City's swimming pools are scheduled to open on March 31 for the
1984 summer season. The following nine of the City's ten pools
need plumbing, electrical and building repairs before they can be
opened:
Curtis Pool Shenandoah Pool
Gibson Pool Virrick Pool
Hadley Pool West End Pool
Morningside Pool Williams Pool
Range (Edison) Pool
The funding for these repairs was appropriated by Emergency Ordinance
No. 9804 on February 9, 1984.
