A RESOLUTION OFFICIALLY ACCEPTING THE ATTACHED CITY CLERK'S CERTIFICATION AND DECLARATION OF THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON MARCH 13, 1984 IN WHICH THE ISSUANCE OF $3090009000 STORM SEWER IMPROVEMENT GENERAL OBLIGATION BONDS OF THE CITY OF MIAMI, FLORIDA, WAS APPROVED BY THE ELECTORATE; FURTHER AUTHORIZING AND DIRECTING THE PROPER CITY OFFICERS TO PERFORM ANY AND ALL INCIDENTAL DUTIES AND TO TAKE APPROPRIATE PROCEEDINGS IN CONNECTION WITH THE ISSUANCE OF SAID STORM SEWER I BONDS, AS REQUIRED BY LAW. I BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby officially accepts the attached City Clerk's Certification and Declaration of the results of the Special Municipal Election i held on March 13, 1984 in which the issuance of $30,000,000 Storm Sewer Improvement General Obligation Bonds of the City of Miami, Florida, was approved by the electorate. Section 2. The City Commission hereby declares: (a) with respect to said storm sewer bonds of the City of Miami, said election was duly called and properly held and notice thereof was duly given in accordance with law and Ordinance No. 9782, adopted January 26, 1984, entitled: January 26, 1984, entitled: "AN ORDINANCE PROVIDING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION IN THE CITY OF MIAMI, FLORIDA, ON MARCH 13, 1984, WITH RESPECT TO THE ISSUANCE OF $30,000,000 STORM SEWER BONDS."; (b) all steps in connection with said bond election were duly, regularly and lawfully taken and had; and all applicable provisions of the Constitution and Statutes of the State of Florida and of said Ordinance have been fully complied with; CITY COMMISSION MEETING OF MAR 29 190 RESoluiW.i iio. 84--319 RLMARKS. , ■l (c) the inspectors and clerks of election precinct in the City have duly made returns of the results of the election in each such precinct on the questioa submitted at said election; (d) at said election there was submitted to the qualified electors of the City of Miami, Florida, the following question: "Shall the City of Miami, Florida, issue Bonds in an aggregate principal amount not exceeding $30,00090OO under Ordinance #9781 to pay the cost of STORM SEWER IMPROVEMENTS, at one time or from time to time and to mature in annual installments 2 to 25 years, inclusive, after the date of issuance of the respective bonds, with interest at lawful statutory rates, payable from unlimited ad valorem taxes?" (e) the attached schedule correctly shows the number of each of the election precincts in the City of Miami, the number of electors entering the voting machine booths for the purpose of voting, the number of votes cast by qualified electors an the question for the bonds, and the number of votes cast by qualified electors on, the question against the bonds; (f) each qualified elector of the City of Miami was given the opportunity of voting for or against the issuance of said storm sewer bonds. Section 3. With respect to the question set forth above concerning the said storm sewer bonds, it is hereby found and determined that 16,978 votes were cast by qualified electors in favor of the issuance of said storm sewer bonds; that 14,892 votes were cast by qualified electors against the issuance of said storm sewer bonds; and the Commission hereby declares and certifies that the issuance of the $30,000,000 storm sewer bonds of the City of Miami was approved by the qualified electors of the City of Miami at such bond election and that the total number of votes on the question in said -2- 84-319 bond election in said voting precincts was 31,870 ; and that a majority of the votes on the j y question in said bond election in said voting precincts was in favor of approving the issuance of said storm sewer bonds. Section 4. The proper officers of the City of Miami are hereby authorized and directed to perform any and all incidental duties and to take appropriate proceedings in connection herewith as required by law for the issuance of the aforesaid storm sewer bonds.
