WHEREAS, on February 9, 1984, the City Commission adopted Resolution No. 84-?46, which confirmed the assessment roll for construction of PINES SANITARY SEWER IMPROVEMENT in PINES SANITARY SEWER IMPROVEMENT DISTRICT SR-5450-C (centerline sower); and WHEREAS, said assessment roll contains an excess charge of $802,07 for sanitary sewer service built to serve property number 01-4116-12-0010; and I~iHEREAS, said property number 01-4116-12-0010 was found to have been assessed in excess of the special. benefits derived from this sanitary sewer district and was, therefore, assessed in error; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAt~1I, FLORIDA: Section 1. Sections 1 and 3 of Resolution No. 84-146, adopted February 9, 1984, which confirmed the assessment roll for construction of PINES SANITARY SEWER IMPilOVEt~1ENT in PINES SANITARY SEWER IMPROVEMENT DISTRICT SR-5450-C (centerline sewer) are I~ereby amended in the following particulars:l "Section 1. That the prima facie assessments, as apportioned and indicated on the preliminary assessment roll for 1 Words and/or figures stricken through shall be deleted. ' ~:'. ~.: FACT SHEET PINES SANITARY SE}VER IMPROVEMENT SR-5450 The subject property was oribinally assessed as follows: 81.14 feet of frontage along S.N. 25 Street, plus 2 service laterals, plus 75 feet of frontage for Lot 1 on its north side. The total came out to be $2,615.37 The property owner contacted the City to explain that there is no possible use of service other than that provided on S. W. 25 Street. In the case of an irregular lot such as this, there are many judgemental factors in computing an equitable assess- ment; following the C},arter to the letter would result in a grossly unfair amount. Therefore, according to the benefits received '~y the property from the improvement, an adjusted frontage of only 81.14 feet is proposed; this will reduce the assessment charge be $802.07 Attached is a location sketch of the subject property.
