Home My WebLink AboutR-84-0385J-84-264 RESOLUTION NO. 84-385 A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT OF $15,000 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND AAIEM CONSTRUCTION CORPORATION, DATED DECEMBER 16, 1983 FOR THE MODIFICATIONS TO FORMER FIRE STATION NO. 16 - STRESS SIMULATOR, SAID FUNDS TO BE PROVIDED FROM LAW ENFORCEMENT TRUST FUNDS APPROPRIATED TO THE PROJECT BY ORDINANCE NO. 9616 ADOPTED MAY 12, 1983, AND AS AMENDED BY EMERGENCY ORDINANCE NO. 9771 ADOPTED JANUARY 1984; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF TWO-THIRDS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDING AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated December 161 1983 between the City of Miami, Florida and AAIEM Construction Corporation in the amount of $265,500 for the Modification to Former Fire Station No. 16 - Stress Simulator; and WHEREAS, an increase in contract of $15,000 is required to cover the added cost to the project caused by removal of harmful asbestoes materials found in the building; and WHEREAS, the City Manager has made a written finding that a valid emergency exists for the work to be done at this time; and WHEREAS, the Chief of Police and the Director of the Department of Public Works recommend the increase in contract to cover the additional cost; and WHEREAS, funds for the increase are available from funds appropriated to the project by Ordinance No. 9616 adopted May 12, 1983 and as amended by Ordinance No. 9771 adopted January 19, 1984; CITY COMIAISSIOIv MFET11\ C Or' NOW, THEREFORE, BE IT RE:30 ,VF.D BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised public hearing, the finding of the City Ptanager set forth in the preamble of this resolution is hereby ratified by an affirmative vote of two-thirds of the City Commission, and adopted as if fully set forth in this section. Section 2. The contract between the City of Miami, Florida and AAIEM Construction Corporation dated December 16, 1984 for Modification to Former Fire Station No. 16 - Stress Simulator is hereby increased by $15,000, with funds therefor hereby allocated from funds already appropriated to the project by Ordinance No. 9616 dated May 12, 1983 and as amended January 19, 1984. (For Commission Meeting of April The Department of Public Works recommends the adoption of a resolution authorizing an increase in contract between the City of Miami, Florida and AAIEM Construction Corporation, dated December 16, 1983 for the Modifications to Former Fire Station No. 16 - Stress Simulator, said funds to be provided from Law Enforcen-ient Trust Funds appropriated to the project by Ordinance No. 9616 adopted 111ay 12, 1983, and as amended 1)y cmcrr<ncy ordinance No. 9771 adopted JaIlUary, 198J1; further r< t.ifyi11g the City i,,,rittcn findinf_ that the herein increase resu_1,ted from emergency circumstances by an affirmative vote of two-thirds of the members of the City Commission, and adopting the finding and conclusions set forth in the preamble of this resolution. _ A contract in the amount of $265,500 was awarded to AAIEM Construction Corporation for the Modifications to Former Fire Station No. 16 - Stress Simulator on December 19, 1983. During the work the contractor encountered harmful asbestoes material within the station that must be removed as required by federal and state regulations. The added cost of the 1 work will cause an overrun of the contract and an increase j of $15,000 is required. The increase is of an emergency nature in that the project is totally halted until the harmful material is removed. A written finding declaring the emergency is attached for your signature. The Chief of Police and the Director of the Department of Public Works recommends the increase. Funds for the increase are available from the appropriation by Ordinance No. 9616 dated May 12, 1983 and as amended by Ordinance No. 9771 dated January, 1984. The authorization of the increase in contract will require that a public hearing be held. By a separate memorandum, a copy of which is attached, we are requesting the City Clerk to advertise for the public hearing to be held at 3:30 P.M. on April 5, 1984 at Comstock Elementary School. The reason for - the crnereency aced is as follows: The contractor )ia:: encountered harmful asbestoes within the building and federal and state regulations require its removal before the halted work can be resumed.
