RESOLUTION NO. 84"-500
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE A CONTRACT WITH THE URBAN LEAGUE OF
GREATER MIAMI, INC., GIBSON INSTITUTE FOR
SOCIAL, CHANGE, IN AN AMOUNT NOT TO EXCEED
$50,000, TO PREPARE A REPORT DOCUMENTING THE
EXTENT OF ['MINORITY (HISPANIC AND BLACK)
VENDOR PROCUREMENT WITH THE CITY OF MIAMI FOR
THE TEN YEAR PERIOD PRECEEDING THE PASSAGE OF
THE CITY'S FIRST MINORITY PROCUREMENT
ORDINANCE, ADOPTED IN OCTOB ER, 1981; FURTHER
DIRECTING THE CITY MANAGER TO RECOMMEND TO
THE CITY COMMISSION NEW GOALS TO BE
IMPLEMENTED AND THE POLICY TO BE FOLLOWED BY
THE CITY BASED UPON THE AFORESAID RESULTS.
WHEREAS, the citizens of the City of Miami have authorized
the City Commission to remedy any historical discrimination
against minority businesses in which the City may have partici-
pated, by intent or effect; and
WHEREAS, this Commission has taken aggressive and construc-
tive action to address any such historical exclusion of minority
businesses from City procurement; and
WHEREAS, this Commission is now aware of the recent court
ruling requiring local governments to be guided in setting
race -conscious procurement goals and in adopting race -conscious
policy by a statistically determined disparity that existed prior
to the enactment or adoption of such race -conscious measures;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to
negotiate a contract in an amount not to exceed $50,000 with the
Urban League of Greater Miami, Inc., Gibson Institute for Social
Change, to conduct an historical investigation of minority vendor
procurement by the City of Miami for the ten year period pre-
ceeding the passage of the City's first Minority Procurement
Ordinance, adopted in October, 1981.
Section 2. The City Manager is hereby directed to report
back to this Commission at the end of this fiscal year on the
results of this study together with the results of FY 1982-1984

Attached is a resolution scheduled for the April 26, 1984
Commission meeting. The proposed resolution addresses the
concerns of the recent U.S. District Court decision, South
Florida Chapter of the Associated General Contractors of
America, Inc. v. Metro -Dade County, which requires historical
documentation of discrimination by a local government as a
requisite basis for formulation and adoption of race -conscious
procurement policies.
This approved resolution replaces the draft previously forwarded
to the City Manager under a cover memorandum from Adrienne
Macbeth dated April 6, 1984.

BACKGROUND
At the October 25, 1983 Commission Meeting, the City Commission
authorized the City Manager to solicit proposals for a study to
assess and investigate the extent to which minority businesses
had procured goods and services awards and contracts from the
_ City of Miami. Such documentation became needed to justify the
fifty percent (50�) Minority Procurement Goal set by the
Commission in Ordinance 9775 (Minority Procurement Program
Ordinance). Additionally, the U.S. District Court had set the
precedent, South Florida Chapter- of the Associated General
Contractors of^America, Inc. vs. Metro -Dade County, for requiring
such documentation as the basis for race -conscious procurement
policies.
A Review Committee has evaluated the five proposals responding to
the City's February 16, 1984 request for the same. The
Committee's recommendations are incorporated in the attached
Resolution.

BACKGROUND
We agreed earlier, that the total cost of the contract would be
negotiated between ,you and the awardee. For purposes of
evaluating and assisting in this aspect, a committee consisting
of Gary Houck, Manny Alvarez and myself reviewed the proposals.

Each proposal was evaluated based upon:
1. Proposer's qualifications,
2. Study design/proposed implementation and
reporting scheme, and
3. ;finority participation.

[Loft & Cellar was rated low -medium on qualifications, low on
design, because both their Project Manager and Research Assistant
are full-time employees elsewhere, and medium on minority
participation; no Hispanic involvement indicated.]
Advertising; Marketing Associates, Inc.
[The consultants' (5) consortium was rated medium on
qualifications, low -medium on design and rnedium on minority
participation. The qualifications of several of the consultants
were irrelevant to the proposed tasks and the proposal content
for the final report does not follow the U11.1
Inter -Governmental Relations, --Inc.
[Inter -Governmental Relations, Inc. was rated medium on qualifi-
cations, low-rnedium on design, and rnedium on minority participa-
tion; no Hispanic participation noted.]

was not responsive to the RFP and it is a minority -owned firm
which identified one Hispanic surnamed staff associate who would

RECOMMENDATION
It is recommended that the Gibson Institute for Research, Urban
League of Greater Miami, Inc. be awarded the contract to study
and produce a report documenting the extent to which minority
(Black and Hispanic) businesses were involved it) the City of
Miami's 19'13 -19H3 procurement. It is further suggested that tine
City Mama er negotiate the contract cost, the involvement of
Hispanic invcsti.g,atars, and the date and format for submission of
the final report.
