RESOLUTION NO. 84-48 �
A RESOLUTION ACCEPTING IN PRINCIPLE ONLY
THE CONCEPT OF THE AMBASSADOR SQUARE
MARINA, AS PROPOSED BY AMBASSADOR SQUARE,
INC., PROPOSED TO BE LOCATED ON THE
WESTERN SHORE OF BISCAYNE BAY, AND ON
BISCAYNE BAY IMMEDIATELY SOUTH OF THE SE
8TH STREET BRIDGE.
WHEREAS, the Ambassador Square, Inc. is proposing
construction of a marina of 91 slips and 6 davits, all of which
will be open to the public on a first -come -first -served basis;
1,187 cubic yards of hard surface benthic habitat; riprap; sewage
pumpout system; a 650' public baywalk and a 215' 24-hour public
fishing pier; and
WHEREAS, Ambassador Square, Inc. has filed Corps of
Engineers Permit Application No. 84D-0435 and Florida Department
of Natural Resources Lease Application No. 130476846; and

Department of the Army, Corps of Engineers (COE), and the Florida
Department of Environmental Regulation (DER), along with Dade
County's Department of Environmental Resources Management (DERM),
holds among other requirements that construction projects which
will occupy publicly owned bay bottom land must demonstrate a
public interest; and
WHEREAS, a 215' 24-hour public fishing pier and a 650'
public baywalk to be designed, constructed and maintained by, and
at the expense of Ambassador Square, Inc., have been proposed as
a public interest; and
WHEREAS, procedures of the Florida Department of Natural
Resources require evidence of a) local government intent to issue
future local permits; b) no objection to the proposed plans or
{ e) no local ordinances that would necessitate changes in the
lease area or dock configuration; and
WHEREAS, the City holds title to a 300 foot wide strip of
bay bottom land, 150 feet on either side of the centerline of the

WHEREAS, the conveyance to the City from the Board of
Trustees of the Internal Improvement Fund contains a reverter
provision if the bay bottom is not used for municipal purposes;
and
WHEREAS, the City staff reserves the right to make
recommendations specific to the overall project; and
WHEREAS, approval of this resolution does not presuppose any
decision rendered by and/or as a result of the City of Miami
Zoning Board and its hearings; and
WHEREAS, approval of this resolution does not preempt the
right of the City of Miami Zoning Board to rule favorably or
unfavorably with respect to the marina, the public baywalk, the
public fishing pier and any related issues; and
WHEREAS, this and/or any other action by the City Commission
and its administration in no way alleviates Ambassador Square,
Inc. from Licquiring all federal., state, county and municipal
permits, appraisals and/or variances as may be required to carry
out any and all portions, of this project;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Acceptance is hereby given in principle only of
the concept of the Ambassador Square Marina, as proposed by
Ambassador Square, Inc. per Corps of Engineers Application No.
84D-0435; and Florida Department of Natural Resources Lease
Application No. 130476846, proposed to be located on the western
shore of Biscayne Bay, and on Biscayne Bay, immediately south of
the SE 8th Street bridge.
Section 2. Acceptance is hereby given in principle only of
the concept of a future lease between the City of Miami and
Ambassador Square, ins:. for purposes of construction of a public
fishing pier and related piers on City -owned bay bottom land;
provided that, the Board of Trustees of the Internal lmprovement
Fund releases the City from a reverter provision in the
conveyance of title that provides that said bay bottom land may
only be used for municipal purposes.

Section 3. The City Manager is hereby authorized to permit
representatives of Ambassador Square, Inc. to act as agents for
the City in acquisition of the release (Section 2 above) and
permits associated with the possible construction of the public
fishing pier.

It is recommended that the City Commission
accept in principle only the concept of the
Ambassador Square Marina proposed to be
located on the western s-Fore of Biscayne Bay,
and on Biscayne Bay, immediately south of the
SE 8th Street bridge, per the attached
resolution.
Ambassador Square, Inc. proposes to remove 24 existing slips from
a docking facility immediately in back of, and to the east of,
the Four Ambassadors Hotel. The developer then proposes to
construct 1) 91 slips and 6 davits 40 of which will preempt
public slips and all of which will be open to the public on a
first -come -first --served basis; 2) 1,187 cubic yards of hard
�i surface benthic habitat beneath the net, pier pilings; ;) ri.prap

if required, a portable systerl, for caner-t;encie: ,) a 6b0' public
baywalk; and 6) a 215' 24-hour publics fishing pier (see attached
applications).
Per the attached letter from the State of Florida Department of
Natural Resources dated February 20, 1984; evidence of a) local
government intent to issue future local permits; b) no objection
tO the proposed plans; or c) no local ordinances that would
necessitate changes to the proposed lease area or dock
configuration is necessary before the Florida Department of
Natural Resources will recommend a lease for this marina to the
Board of Trustees of the Internal Improvement Fund (Governor and
Cabinet).
The action requested at this time is only to allow the developer
to proceed with the State leasing and permitting process; no
action is being recommended which would prejudice future Zoning
Board consideration. City departments have no particular
objection to the marina, as proposed; however they do reserve the
right to critique the project more rigorously prior to required
public hearings before the City of Miami Zoning Board.

The following is a summary of steps which will. be included in the
process which this resolution initiates:
1. Acceptance, by the City Commission, in principle
only of the concept of the Ambassador Square
Marina, the concept of a lease of City --owned bay
bottom land and authorization for the developer to
act as agent for the City for purposes of
permitting.
2. Issuance of a lease for bay bottom from the Board
of Trustees of the Internal Improvement Fund, as
and if recommended by the Florida Department of
Natural Resources.
3. Release by the Board of Trustees of the Internal
Improvement Fund of conditions attached to the
title for City -owned bay bottom land.
4. Completion, by Ambassador Square, Inc., of the
Corps of Engineers/Florida Department of
Environmental Regulation/Metro Dade County
Department of Environmental Resources Management
permitting process for construction of the Marina.
The public baywalk and public fishing pier would be
offered as the "public interest" which must be
demonstrated for all projects in Biscayne Bay,
according to the Biscayne Bay Aquatic Preserve
Rules.
5. Lease of City--oti.ned bay bottom land, by City
Commission.
6. Demonstration by Amba sador Squire, Inc. that they
have leases of Ci.ty and State hay bottom plus
lease/o►•rrrership/easements to r.apland property.
7. Application by Ambassador Square, Inc. to the City
r of Miami Zoning, Board for:
a) A Special Exception to construct a marina in
excess of 25' from the shoreline (Zoning
Ordinance 9500; Subsection 2024.1.3.)
--and--
b) A variance to permit the marina configuration,
offering as a "public benefit" the construction
and maintenance of a) a 650' public baywalk and
b) a 215, 24-hour public fishing pier (Zoning
Ordinance 9500, Subsection 2024.1.3.1.)

Please be advised that the Four Ambassadors, once its expanded
marina for Ambassador Square, Inc. is approved and operating, will
tie its Baywalk into the Baywalk being proposed for our neighbor
to the south, Brickell Bay Office Tower.
Even though the final design for their Baywalk has not been
completed, we will comply with the guidelines for the tie in as
proposed by the City of Miarn.i in coordination with all additional
permitting environmental agencies.
Our consultants will meet with Brickell Bav Office Tower's
consultants and r-espresentati-ves and the City of Miami planning
staff to assure that the tie in of the Baywalk is aesthetically,
structurally an(d environmentally in compliance with the City of

REQUEST: Approval of a five --year sovereignty submerged land lease
containing square feet, more or less, to be utilized as
a public access project and commercial docking facility open to
public.
DADE COUNTY: Lease No. 130476846
APPLICANT: Ambassador Square, Inc.
LOCATION: Section 38, Township 54 South, Range 41 East, in Biscayne
Bay Aquatic Preserve (Class III) and Outstanding Florida Water within
the local jurisdiction of the City of Miami and subject to`Dade County
permitting.
STAFF REMARKS: Applicant proposes to remove 24 existing slips frcim a
grandfathered docking facility to be replaced by: (1) 91 slips and 6
davits 406 of which will preempt public slips and all of which will
be open to the public on a first -come -first -serve basis; (2) 1,187
- cubic yards of hard surface benthic habitat (present habitat is
"unconsolidated silt") beneath the new pier pilings; (3) riprap at
the toe of the existing seawall; (4) sewage pumpout system and, if
required, a portable system for emergencies; (5) a 650' public
"baywalk", which the City of Miami states is an essential part o
implementing its Biscayne Bay Pedestrian Baywalk Charter Amendment
and; (6) a 215' 24 hour public fishing pier.
The project is located in an Outstanding Florida Water and pursuant
to Rule 17-4.242(l)(a), F.A.C., DER has determined the project is
clearly in the public interest and issued an intent to issue August
12, 1983. Dade Count,. Environmental Resources issued a letter of
no objection to permit issuance February 2, 1982. The project is
consistent.with City of Miami zoning ordinances 951.0 and 951.1 and
endorsed by t1le City }_)57 letters of Fel)ruary and , 1984.
The project i..s consist.ant 16Q--21, F.A.C. No dredgi.nc or filling
is proposed for the site which i:., a former }:sorrow pit:. for Claughton
Island fill. No live -aboard, x-.i.1J be permi_tted. There are no navi-
gation hazards presented by the proposed project and there have been
no manatee incidents reported in the 13 years the present docks have
)aeen in existence. A filed span bridge separates the docks from
the Miami River entrance.
The BBAPA and 16Q-18, F.A.C., apply to the project. The Act has
alternative provisions under which the Board may consider the lease
request. Leases must be in the public interest and there must be a
showing of extreme hardship,or counsel is of the opinion the Board
may, notwithstanding the public interest/extreme hardship thresholds,
enter into an agreement with Ambassador Square, Inc. for the public
and private uses of sovereignty lands as proposed by the Applicant
pursuant to §253.165(3)(e)4. and 5.
RECOMMEND: APPROVAL subject to access documents being acceptable
to the City of Miami.

WORK & PURPOSE: The applicant proposes to rebuild and expand an existing
marina facility which will provide a public pedestrian boardwalk and a total
of 91 boat slips and 6 davits. Proposed piers will extend a maximum of
256 feet. from an existing bulkhead into the bay. Approximately 1,000 cubic
yards of riprap will be placed at random under the N,aik�,,ays. Sei,+age pumpout
faci 1 i es will be provided and wi 1 1 be connected 1.0 an upland sever system.
No fueling facilities arty prolaosed. No dredging •rill be performed. The
purpose of the %';ork is to upgrade and expand an existing comm2rci al facility.
NOTE: This project was previously issued under public notice 8IL-1409,
,mod September 30, 1981, w1hich was deactivated December 1, 1982, due to
Federal , State and local objections. These objections have been resolved
and include a reduction in length of the piers and the placement of riprap
to enhance the bay bottom habitat. This public notice is being issued based
on information furnished by the applicant. This information has not been
verified.

It is recommended that the City Commission
accept in principle only the concept of the
mbassador--Square Marina proposed to be
ocated on the western s ore of Biscayne Bay,
and on Biscayne Bay, immediately south of the
SE 8th Street bridge, per the attached
resolution.
Ambassador Square, Inc. proposes to remove 24 existing slips from
a docking facility immediately in back of, and to the east of,
the Four- Ambassadors Hotel. The developer then proposes to
construct 1) 91 slips and 5 davits 40% of which will preempt
public slips and all- of which will be open to the public on a
first -come -first -served basis; 2) 1,187 cubic yards of hard
surface benthic habitat beneath the nevi pier pilings; ) riprap
at the toe of the existint; 11) sci,:age pumpout system and,
if required, a portable for emcr'r�encieS; 5) a 650' public
baywalk; and G) 151 2ra hour public fishier pier, (see attached
applicati.Oil s)I
Per the attached lcl.ter from the GL :te of Florida Depart.rncrrt of
Natural esources dated February 20, 1984; evidence of a) local
government intent to i.:>su(' future local permits; b) no objection
to the proposed plans; or c) no local ordinances that would
necessitate changes to the proposed lease area or dock
configuration is necessary before the Florida Department of
Natural Resources will recommend a lease for this marina to the
Board of Trustees of the Internal Improvement Fund (Governor and
Cabinet).
The action requested at this time is only to allow the developer
to proceed with the State leasing and permitting process; no
action is being recommended which would prejudice future Zoning
Board consideration. City departments have no particular
objection to the marina, as proposed; however they do reserve the
right to critique the project more rigorously prior to required
public hearings before the City of Miami Zoning Board.

process which this resolution initiates:

completed, we will comply with the guidelines for the tie in as
proposed by the City of 1%liami in coordination with all additional
permitting environmental agencies.
Our consultants will meet with Brickell Bay Office Tower's
consultants and respresentatives and, the City of Miami planning

REQUEST: Approval of a five ---year sovereignty submerged land lease
containing square feet, more or less, to be utilized as
a public access project and commercial. docking facility open to
public.

APPLICANT: Ambassador Square, Inc.
LOCATION: Section 38, Township 54 South, Range 41 East, in Biscayne
Bay Aquatic Preserve (Class III) and Outstanding Florida Water within
the local jurisdiction of the City of Miami and subject to`Dade County
permitting. _
STAFF REMARKS: Applicant proposes to remove 24 existing slips from a
grandfathered docking facility to be replaced by: (1) 91 slips and 6
davits 400 of which will preempt public slips and all of which will
be open to the public on a first -come -first -serve basis; (2) 1,187
cubic yards of hard surface benthic habitat (present habitat is
"unconsolidated silt") beneath the new pier pilings; (3) riprap at
the toe of the existing seawall; (4) sewage pumpout system and, if
required, a portable system for emergencies; (5) a 650' public
"baywalk", which the Cit.,, of Miami states is an essential part o
implementing its Biscayne Bay Pedestrian Baywalk Charter Amendment
and; (6) a 215' 24 hour public fishing pier..
The project is located in an Outstanding Florida Water and pursuant
to Rule 17-4.242(1)(a), F.A.C., DER has determined the project is
clearly in the public interest and issued an intent to issue August
12, 1.983. Dade County Environmental Resources issued a letter of
no objection to permit issuance February 2, 1982. The project is
consistent with City of mi,-1111i. zoning ordinances 9510 and 9511 and
endorsed by the City by 3.etters of February a nd , 3.93 4 .

been in existence. A fixed span bridge separates the docks from
the Miami River entrance.
The BBAPA and 16Q-18, F.A.C., apply to the project. The Act has
alternative provisions under which the Board may consider the lease
request. Leases must be in the public interest and there must be a
showing of extreme hardship,or counsel is of the opinion the Board
may, notwithstanding the public interest/extreme hardship thresholds,
enter into an agreement with Ambassador Square, Inc. for the public
and private uses of sovereignty lands as proposed by the Applicant
pursuant to §253.165(3)(e)4. and 5.
RECOMMEND: APPROVAL subject to access documents being 6cceptable
to the City of Miami.
