Miami gives county OK to partially demolish playhouse

Miami -Dade County has been
given the green light from the City
of Miami to proceed with plans
to partially demolish the Coconut
Grove Playhouse.
The city approved the county's
application for a special waiver to
permit deviations from the zoning
code and allow partial demolition
of the historic theater. Activists
fighting to preserve the landmark
filed an appeal requesting that the
city's zoning office reverse its final
decision.
On Jan. 27, the city granted the
waiverwithconditions. his vandfor
two years during which a building
permit or certificate of use must be
obtained.
Conditions ofthewaiver stipulate
that it is solely for partial demolition
of the existing structure, does not
constitute approval for subdivision
ofthe land, and requires that Article
17 of the city code for tree protec-
tion be adhered to. Additionally, a
full review is required at the time of
building permit application by the
zoning office, and any substantial
changes may require a new waiver.

Early Notice and Public Review of a Proposed
Activity in a 100-Year Floodplain and Wetland

This is to give notice that City of Miami, FL under 24 CFR Part 58 has determined that the
following proposed action under the Community Development Block Grant -Mitigation Pro-
gram (CDBG-MIT), grant MT048 is located in the 100-year floodplain and wetland, and the
City of Miami will be identifying and evaluating practicable alternatives to locating the ac-
tion in the floodplain and wetland and the potential impacts on the floodplain and wetland
from the proposed action, as required by Executive Order 11988 and 11990, in accordance
with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on
Floodplain Management and Protection of Wetlands. The grant, labeled as Jose Marti Park
Flood Mitigation is within an overall adaptive redesign of the entire park and will be titled the
Jose Marti Waterfront Adaptation Project. Jose Marti Park is a 13-acre multi use recreation-
al space along the Miami River. Jose Marti Park is in flood zone AE. This flood mitigation
project will focus on shoreline stabilization and drainage improvements in the Park, so that
it may act as a both a buffer and sponge for incoming water. The project which will increase
the resilience of the Park and the East Little Havana neighborhood that surrounds it against
flooding, natural hazards, and climate change. This project will consist of retrofitting exiting
seawalls in some locations, building new ones in others, and constructing living shorelines/
living seawalls in remaining spaces; creating a floating boardwalk and view platforms on the
river; developing a Riverwalk and parking lot with pervious pavement and underground water
retainment infrastructure; refurbishing an existing building into community gathering pavilion;
sculpting uplands and integrating native tree canopy with proper subtraction to maximize the
capture and filtration of water into the river/water table. It is important to note that out of the
13 acres of the park, 4.08 acres of floodplain will consist of the waterfront adaptation project,
with approximately 0.33 acres of wetland and surface water impacts. The proposed project is
located 362 SW 4 Street in the City of Miami within Miami -Dade County.
There are three primary purposes for this notice. First, people who may be affected by activi-
ties in floodplains and those who have an interest in the protection of the natural environment
should be given an opportunity to express their concems and provide information about these
areas. Commenters are encouraged to offer alternative sites outside of the floodplain and
wetland, alternative methods to serve the same project purpose, and methods to minimize and
mitigate impacts. Second, an adequate public notice program can be an important public ed-
ucational tool. The dissemination of information and request for public comment about flood -
plains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts
associated with the occupancy and modification of these special areas. Third, as a matter of
faimess, when the Federal government determines it will participate in actions taking place
in floodplains and wetlands, it must inform those who may be put at greater or continued risk.
Written comments must be received by the City of Miami at the following address on or
before March 6, 2023 at 5:00 PM. A minimum 15 calendar day comment period will begin
the day after this publication and end on the 16" day after the publication. The City of Miami

was filed on Feb. 10 and is to be

The appeal contends that the
decision is void because of exist-
ing code violations and liens on
the property. According to Miami's
zoning code, the city is prohibited
from issuing a waiver approval if
the property is subject to ongoing
code enforcement action, which the
playhouse site is.
The appeal also states the waiver
approval wasbasedupon an incom-
plete application that lacked sig-
nificant pieces ofinformation about
the project, without which a legally
appropriate review is impossible.
As part of the ongoing battle to
save the historic theater from de-
molition, Coconut Grove residents
are trying to block the county from
using $23.6 million in bonds that
voters dedicated for restoration of
the playhouse.
In 2004, Miami -Dade County
voters approved a ballot measure
for bonds, some of which were
expected to fund the reconstruction
ofthe Coconut Grove Playhouse to
restore its structural integrity and
add to its performance and educa-
tional capabilities.

includes demolishing over 80%
of the Coconut Grove Playhouse,
reducing theater seating from
1,130 to 300 and replacing 60% of
the performance space with leased
commercial space.
Some Coconut Grove residents
said they were outraged upon learn-
ing that over $20 million allocated
for the restoration of the playhouse
would be put toward its destruction
instead.
In August 2022, Mr. Winker
filed a complaint onbehalfoftbose
residents seeking a declaration
that the county acted unconstitu-
tionally and outside its statutory
powers as well as an injunction
prohibiting the county from using
bond funds for the demolition. The
lawsuit is still in progress.

Plan would fund affordable homes

fourth district if the commission
approves the project today (2/9).
Commissioner Manolo Reyes,
who represents the district, is
sponsoring a project to build six
affordable single-family homes
funded by Miami Forever Afford-
able Housing Bonds to the tune of
52,515,787. The resolution before
the commission would allocate the
funds and replace two properties
originally selected for the project.
Mr. Reyes is requesting the
properties at 632 SW 63rd Ave.
and 700 SW 63rd Ave. replace
the properties at 2293 SW 17th

received by the commission in
July 2021.
If approved, six affordable
single-family homes would rise at
12 SW 47th Ave., 2601 SW 13th
St., 130 SW 5lst Place, and the
two properties on Southwest 63rd
Avenue. The property at 130 SW
51 st Place would have two homes
built on the 12,582-square-foot lot.
The city purchased the prop-
erties at 632 and 700 SW 63rd
Ave. in 2019 for $383,538.56 and
5396,020.50, respectively. These
properties would replace the two
homes originally proposed to be
built on Southwest 17th Terrace.

Brickell's condo market
2023 strength is forecast

Brickell's booming condo mar-
ket is expected to remain strong in
2023 as the urban mecca continues
to attract new residents.
Pending condo sales in Brickell
decreased during the last quarter
of 2022, but an increase in Janu-
ary indicates improved market
activity. "Easing interest rates and
returning foreign buyers are likely
to result in continued positive ap-
preciation ofaverage sold prices,"
Joseph Biscaha, a Miami -based
realtor with Compass Real Estate,
told Miami Today.
As of January, the Multiple
Listing Service showed 829 ac-
tive condo listings in Brickell
with an average asking price of
5758,044. The average number of
days on the market is down 15%
from last year. In 2022, the dos-
ing price to original listing price
ratio was 98%, meaning that on
average there was only 2% room
for negotiation. Compared to
4% in 2021 and 8% in 2020, the
shrinking room for negotiation
and fewer days on market indicate
the Brickell condo scene isbecom-
ing increasingly competitive, Mr.
Biscaha said.
During the pandemic, new-
comers flocked to South Florida
to take advantage of the state's
looser restrictions. Condo sales
in Brickell dropped 9e/ at the
onset of the pandemic in 2020
from the previous year. But in
2021, pent-up demand and easing
Covid-19 restrictions resulted in
a 185% surge in the number of
condos sold.
In the three years post -pandem-
ic, the average sale price increased
roughly 70%, from 5444,158
in January 2020 to 5758,044 in
January 2023.
Mr. Biscaha said that while
it's difficult to precisely predict
what will happen in the real estate
market, a few factors suggest
that Brickell will continue to be
successful. Brickell's location,
lifestyle offerings and business
opportunities explain the neigh-
borhood's attraction, he said.
"Brickell is a popular and
convenient location with easy
access to downtown Miami, the
beaches, and public transportation
options. This is a major selling

The Proposed Action includes the construction of a new ATCT ranging from 172 feet to 202 feet
above ground level in total height and an associated parking lot adjacent to the tower. The new
ATCT site will have an approximate area of 3 to 4 acres. The new ATCT is expected to have a
control cab area (located atop the ATCT where the best unobstructed view is provided for air
traffic controllers) of between 450 and 550 square feet The proposed tower at either location
would facilitate a safe operating environment for aeronautical activity at TMB well into the fu-
ture. and the two sites under consideration are the best available locations for visibility of Airport
Traffic Control.

remained vacant for more than a
decade in Brickell is setto become
a major mixed -use residential
development, with the owner -
developer celebrating the open-
ing of its sales gallery and model
residence.
Cipriani Residences Miami,
the first ground -up Cipriani resi-
dences in the US, has opened its
sales gallery and model designed
by 1508 London, located at 1421
S MiamiAve., just across from the
project site at 1420.
Developer Mast Capital says
the sales gallery is a showcase of
the quality of the Cipriani brand
and the strength of the developer's
vision. The sales gallery demon-
strates the sophisticated lifestyle
that residents at the forthcoming
80-story condo tower will enjoy,
says Mast Capital.
"The demand for Cipriani

overwhelming given the tower's
authentic interpretation of the
brand and its central location
in the heart of Miami's financial

Skyrocketing construction materials
costs stabilize, begin return to earth

to local construction developing
experts.
In mid-2020 construction mate-
rial costs skyrocketed to a 25%
increase but in the past 12 months
it has decreased to around 8%, said
Peter Dyga, president and CEO of
AssociatedBui lders and Contractors
Florida East Coast Chapter.
Those materials includedlumber,
concrete, petroleumnatuial gas, iron,
steel, fabricated metal products, and
even plumbing fixtures, he said,
"Overall, it's still pretty significant"

"That's obviously a hugeinput for

Kennedy said. "Thera are still some

ago. That's general ly encouragi ng on
the material side."

tracts (GMP) are now being used
less in the construction market, said
Beatriz Azcuy, a partner at Sidley
law firm and head of the firm's real
estate and construction group.

despite a city review board's denial

Jungle Island now features new
elevated nature treks, zip lines and
more. The park reopened following
a seriesofrenovations afterdamages
by FIuricane Irma.
Amajorplanned expansion is the
construction of a hotel, along with
several associated uses.
In 2020, ESJ requested approvals
for a hotel and garage as a Special
Area Plan, or SAP, under Miami
21 zoning.
The original plan submitted by
ESJcalledforan 11-story hotel with
up to 300 guest rooms, and a garage
for 783 vehicles, topped by green
space, landscaping and civic space.
Two existing conference build-
ings were to be incorporated into
the new construction, and an
existing parking garage was to be
demolished.
The UDRB recommended ap-
proval of the original plan with
conditions, in October 2020.
Ina letter to the city, Nicholas J.
Barshel, an attorney representing
ESJ, wrote of the latest plan: "The
Hotel Project involves complete
demolition oftheexisting, outdated
parking garage and construction of
a new hotel building and garage
separated by an expansive ground-
levelpublicplaza. Thedevelopment
program includes 300 hotel rooms
in a 12-story building on the east
side" and the new garage on the
west.
He continued, "Applicanthas de-
signed the new garage to have better
circulation and to contain additional
parking capacity within a smaller
footprint. Loading and serviceareas
will be internalized at ground -level
in the hotel."
Jungle Island is on the northeast
side of Watson Island, bordered to
the east by Parrot Jungle Trail and
to the south by the Ichimura-Miami
Japanese Gardens.
Warehouse space demand
high, vacancy arecord low

The demand for warehouse
space in Miami -Dade County
continues to be competitive and
property is scarce, according to
local industrial real estate experts.
The county's warehouse in-
dustry is currently in a land -con-
strained market and that continues
to really fuel the price increases
because it puts a strain on the
supply, said Conner Milford, vice
president for Lee & Associates.
"Developers love to come
down here and throw up million -
square -foot buildings," he said.
"There's just no room unless you
go up north to St. Lucie and Fort
Pierce, which we're certainly
seeing that as well."
Since 2020, rents have grown
considerably depending on the
space, added Dalton Easton from
The Easton Group. "It's in the
mid to upper teens per square
foot. In some cases, depending
on the size of the space you're
seeing $20 per square foot rents
or more. It just depends on size
and location."
The direct asking rate for in-
dustrial space was up 41.4% to
an average of $15.16 per square
foot during the last quarter of
2022, even when excluding the
under -construction inventory that
helps drive rates up, according to
an Avison Young 2022 fourth-
quarter Miami industrial real
estate market report.
Total vacancy in the fourth
quarter was 2.1%, the lowest
ever recorded. The direct vacancy
has plummeted in recent years as
South Florida continues attract-
ing institutional tenants in search
of large blocks, the report said.
Logistics and freight -for-
warding companies are the main
tenants that are absorbing the
county's warehouse space, Mr.
Easton added.
"I don't see rates going back-
wards," he said. "We're still
under -supplied. The space we're
delivering is a fair amount this
year, but it seems to have activity
on it and it seems like it's going
to be absorbed,"
Any company that wants to
work with the Port of Miami re-
ally has gone out to the Beacon
Logistics Park, which is the
latest logistics and distribution
built -to -suit park in Hialeah, Mr.
Milford said. "They are 32-foot
clear industrial buildings, even
though that's almost filled up
now as well,"
There are still a few small
spaces left at the Beacon Lo-
gistics Park, said Ana Codina-
Barlick, CEO ofCodina Partners,
the developer that manages
the logistics and distribution
build -to -suit park. "It has been
extremely successfid. Our first
two buildings were delivered
last year and will have tenants
moving in in the next 90 days.
Even the last two buildings that
we just started construction on
are pre -leased."
The last two buildings are
expected to be completed in the
first quarter of 2024, Ms. Codina-
Barlick added.

Wynwood set to get reprieve from Miami noise regulations

An experimental pilot program that ex-
empts Wynwood from Miami's usual noise
ordinance is expected to be renewed for
a second year to further study the effects.
Today (2/9), the Miami City Commis-
sion is to vote on the second reading of an
ordinance to extend the pilot program for
noise disturbances within the Wynwood
Neighborhood Revitalization District,
NRD-1, for one more year.
The city initiated the pilot program in
September 2021 to study noise pollution
emitted from Wynwood's nightclubs that
operate until the early hours of the morn-
ing. The program aims to maintain the
burgeoning nightlife community while
preserving the standard ofliving for those
who reside in the area.
Potential time restrictions and noise
ordinances affecting the vibrant Wynwood
Arts District have been debated for years
and business owners petitioned the city
to amend outdated regulations and allow
for more leniency.
Bruce Fischman, principal advisor to
developer Moishe Matta, and Phillippe
Kalifa, owner of El Patio, expressed
that they were in favor of the proposed
changes to the noise ordinance within the
NRD-1 when the matter was discussed
at the Wynwood Business Improvement
District (Wynwood BID) meeting in
September 2020.
The Wynwood BID commissioned a
noise study in 2020 with the assistance of
Brooks Acoustic Corporation to identify
appropriate noise standards for the area.
Brooks conducted sound level tests to
measure the potential for compliance with
the proposedNRD-1 noise ordinance. The
corporation provided acoustical engineer-
ing guidance, studied the potential effects
on the neighborhood and compared the
proposal with similar city ordinances in
popular nightlife destinations like Fort
Lauderdale and New York City.
After completing the initial study, the
Wynwood BID suggested to the city that
Wynwood should be exempt from the
standing ordinance that restricts noise
between 11 p.m. and 7 a.m. the follow-
ing day.
The pilotprogram reduces those restric-
tive hours to between 3 a.m. and 9 a.m.
and allows for music to be played during

that time if it doesn't exceed 85 decibels
when measured 25 feet from the property
line or 65 decibels maximum when mea-
sured from within a closed structure and
a 70-decibel bass limit.
The pilot program includes a provision
that it will be reviewed after one year and
then on an annual basis, with adjustments
made as needed. The city manager or a
designee has the authority to decrease
the allowable levels by up to ten decibels
based upon the recommendation of the
Wynwood BID,
The city commission adopted the pro-
posed pilot program on Sept. 23, 2021,
and it was scheduled to sunset on Sept.
9, 2022. If commissioners vote to extend
the program, Wynwood's noise exemption
status will be in effect through Jan. 26,2024.
Miami Beach bids to curb untaxed commercial boat operators

Miami Beach is to evaluate an
ordinance that would increase
fee violations for commercial
boat operators without a busi-
ness tax receipt and establish
suspensions to try to curb the
number of commercial viola-
tions issued.
Previously, a commercial boat
operator who was issued a viola-
tion for not having a business tax
receipt (BTR) would be charged
a $1,000 violation fee. Any
subsequent violation would be
for $500, said Manny Marquez,
assistant director of Miami
Beach's Finance department.
Commissioner Alex Fernandez
is bringing a proposed ordi-
nance to the city commission
that would establish a higher
violation fee than the first one
issued, and establish suspen-
sions to reduce the mmuber of
commercial use of the marinas
and possible violations of busi-
ness tax.
According to a committee
memorandum from City Man-
agerAlina Hudak to the Finance
and Economic Resiliency Com-
mittee, more licensed charter
boats now operate in the city's
waterways. In 2018, there were
13 charter business tax receipts
and 47 vessels. In 2021, there
were 52 BTRs issued and 125
vessels. As ofJan. 27, there are
80 BTRs issued and 155 ves-
sels. This increase in charter
boat businesses has reached
full capacity for new permanent
businesses.
Last October, the Public
S afety and Neighborhood Qual-
ity of Life committee proposed
modifications to vetting busi-
ness tax receipt renewals for
businesses that routinely violate
safety or code enforcement.
Those modifications would
increase the fines for business
tax violations. No new BTR
application slips would be ap-
proved unless a marina slip for
docking was available. Landing
slip agreements would have to
be obtained for charter boats
without a permanent docking
slip before dropping off or pick-
ing up passengers.

tained, charter boat businesses

quarter last year, we issued 42
[violation notices], this year,
so far, we've only issued one."
Commissioner Fernandez
also pushed to include priority
use for residents versus com-
mercial use.
"It's a taxpayers' marina," he
said. "Our residents should have
the preference in the use and the
lease of the slips in the marina.
We have limited waterfront
homes in this city, but we are
a dense, vertical city, and the
individuals who live in condos
may want to use those marinas
as well. If you fill the residential
use, and then you have vacant
spaces, you go out commercial."

Miami International Auport re-
ported a record -breaking 2022 with
more than $50 million passengers,
with the greatest number of domes-
tic passengers ever and the largest
airport seat capacity growth in the
nation, Miami -Dade County and
MIA officials announced this week.
MIA reached more than
50,638,000 overall passengers fly-
ing, making the aiport the busiest in
Florida for 2022, with 29.2 million
domestic passengers — the most in
history — and 21.3 million interna-
tional passengers, only 1 million
less than all-time reconl year 2019
with 22.3 million international pas-
sengers.
This milestone adds a 10% in-
crease over the previous record of
45.9millionin2019. "Amajor, major
achievement," said county Mayor
Danielle Levine Cava, surpassing
Orlando International Airport by
over 500,000 passengers last year,
and matching Florida's all-time re-
cord number of 50.6 million yearly
passengers in an airport, achieved
by Orlando in 2019.
"Those 50.6 million passengers
represent far more than just another
big nrunber," said Mayor Levine
Cava. "These are millions of guests
to our community who are support-
ing our hotels, our restaurants, our
shopping centers, and other busi-
nesses; and most importantly, creat-
ing jobs right here in Miami -Dade
County for our residents."
MIA, Miami -Dude's largest
economy engine, was responsible
for $32 billion in business revenue,
and nearly 300,000 local jobs, the
mayor said.
In addition, the airport has
achieved top national and intenna-
lional rankings, including first place
in international freight anduntema-
tional passengers in the country;
fifth in the nation for total cargo,
including freight and mail; ninth in
the world for international freight;
llth in the world for international
passengers; loth in the world for
total freight; and 12°i globallys for
total passenger count.
MIA is home to 100 airlines,
includingAmerican Airlines, which
established its Miami hub in 1989,
and Emirates, which stetted service
twoyears ago. "MlAwas the fastest -
growing large US airport in seat
capacity in the entire county," said
Ralph Cntre, the aipod's director
and CEO.
MIA tripled the seat capacity of
Orlando hntemationalAirpoit, which
achieved a 5%growth, and was one
oftheonlysevenairpoitsthathad any
seat capacity growth, which include
Nashville International, Hany Reid
International in Las Vegas, Chicago
Midway International, Orlando In-
ternational, Denver International,
and LaGuardia.
"In a year that global Navel was
down overall 40%, MIA's interna-
tional traffic has now made a 95%
recovery in international passen-
gers," said Mr. Cutid.
In January, the airport trended
15% over its record -breaking Janu-
ary in 2022, he added, with 4.5 mil-
lion passengers. "That's significant,
considering thatJanuary is typically
a low period for the industry."
Ralph Cute: top in global freight.
Similarly, in the first week of
February, total passenger county is
up 16%.
Juan Carlos Liscano, American
Airlines vice president who leads
the Miami hub, said 2022 was also
a record -breaking year for tine air-
line. "We are happy to say that we
sutpassed31.2 million passengers at
MIA," he said. "This is our highest -
ever passengers boarded, since we
became a hub at MIA, just under 35
years ago."
American Airlines and its sub-
sidiary Envoy served 31.8 million
passengers at MIA in 2022. This
was 63% of the airport's total pas-
senger count.
American Airlines — the larg-
est cattier at MIA, and one of the
coumty's Ingest private employers
with more than 13,500 teen mem-
bers an d 2,000 new employees hired
in 2022—surpassed its 2019 record,
whiclh tallied 30.2 million passengers
boarded.
"Since 1989, AA has had a long-
standing relationship with MIA.
That's when we established our
gateway to Latin America and the
Caribbean," said Mr. Liscano. The
results of these three decades of
work are "not only created in private
economy, [these] record number
of passengers boarded and record
number of businesses moving to
Mimi are making Miami a leading
international tech hub."
American Airlines averages 330

140 destinations, from which 80 are
uniquely served by AA, according
to communications from the airline.
Last winter; the airline resumed
service to Cuba and Managua,
Nicaragua.
Fifteen additional international
routes were added in 2022 in total,
including Vancouver; Canada; six
routes to the Caribbean: Camaguey,
Holguin, Santa Clara, Santiago de
Cuba, Varadero, and San Salva-
dor; five routes in South America:
Brasilia, Fortaleza, Manaus, Bucara-
manga, and Santa Matta; and three
in Europe: Dublin, Ireland, Paris,
and Rome.
Starting in June, according to a
press release, Amen can plans to add
services to Terrance B. Lettsome
International Airport in the British
Virgin Islands.

viced 2.6 million passengers, 2.4%
