"lay PETITION TO THE CITY COMMISSION OF MIAMI BY PROPERTY OWNERS Ails TENNANTS ABUTTING AND IN THE VICINITY OF 3940 DOUGLAS ROAD FOR RELIEF FROM CODE VIOLATIONS, DAP'1AGE AND PUBLIC NUISANCE CREATED BY THE OWNERS OF THE PROPERTY AT 3940 DOUGLAS ROAD. We ask that Tne City Commission investigate, inspect and inquire into the activities at 3940 Douglas Road which are outlined below and apply such remedies and relief as City, County and State laws and regulations may provide. We feel that the following activities have damaged us, reduced the value of our properties, and have - and are continuing to - cause us pain, annoyance and interruption i n our normal lives- Specifically, the owners of the property at 3940 Douglas Road, or their employees or agents, have done the following : 1. Constructed a wall along most of their property line in excess of eight feet without proper permits. 2. During the wall construction, without prior notice or permission, trespassed on adjacent and abutting property, and cut down at least one tree, a Surinam Cherry having a base diameter in excess of eight inches on the property at 3941 Midway Street. 3. Failed to observe proper setbacks in their construction of buildings, additions to buildings, animas cages and other paraphernalia. 4. Installed massive night lighting ryhich shines into neighbouring homes at all hours of darkness. 5. Introduced and maintained on the property at 3940 Douglas Road all manner of ;-gild, erotic and dangerous animals not native to this region. These animals include or have included large wild animals of the cat family which appear to be lions, panthers, cheetahs, ring tailed lemurs, monkeys and apes, large snakes, and wild birds. These animals, in addition to being potentially dangerous, are constantly noisy at dawn and dusk for several hours, and some time all day when not attended. They also make a disgusting odor, especially in warm damp weather. 6. Maintained armed men on the premesis who, at least on one occasion, threatened neighbours across the wall with guns. 84-572 mor) O1v //1.4Ly mL4urllvy PAGE ONE OF THREE PAGES E Attempts to contact the owners have been unsuccessful, The only gates to the property at 3940 Douglas Road are kept: locked and there is no call bell or intercommunications system. The listed property owner, A Mr. Mario Tabraue, maintains an unlisted telephone number and is not present on the property. More than forty calls to the police since August 1983 have produced no relief from our complaints. The Miami Police Case Number for orb of these complaints is 124-3793-I. A complaint by letter to His Honor Mayor Ferre dated 7 April 1984 was responded to quickly and efficiently by Miami City Inspection Services Division Chief Luis M. Jimenez, who replied to one of the abutting property owners by letter 1 May 1984. But Mr. Jimenez` letter is disturbing because it includes the following, "4.- We must have copies of all the required documentation allowing them to maintain exotic animals on their peoperty." We believe it is against the public interest to allow the exotic animals above -cited to be allowed in a residential area of Miami.
