WHEREAS, Article 28 of Ordinance No. 95009 the Zoning
Ordinance of the City of Miami, Florida, requires developers of
Major Uses, as defined in Section 2801 of said article, to apply
for, and receive, a Major Use Special Permit before applying for
a building permit; and
WHEREAS, the Bayside Project, located at approximately 499
Biscayne Boulevard, meets the criteria for Major Use designation,
as set forth in said Ordinance and Article at Section 2801; and
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 6, 1984, by a 5 to 2 vote, after reviewing the Pre-
liminary Application for Major Use Special Permit, recommended
that the developer be permitted to proceed with filing of a Final
Application for Major Use Special Permit; and
WHEREAS, the City Commission has reviewed the Preliminary
Application for Major Use Special Permit and considered any
additional conferences, referrals, or materials that may be
required prior to consideration of the Final Application for
Major Use Special Permit;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The applicant for the Bayside Project,
located at approximately 499 Biscayne Boulevard, is hereby
authorized to file a Final Application for Major Use Special
Permit with the Director of Planning.
Section 2. No right or privilege is conferred on the
applicant by the City Commission in granting permission to
proceed to Final Application. This resolution is not to be

ENCLOSURES:
All of Miamarina Parkway Drive, certain portions
of Bayfront Park designated as upland areas of
Miamarina, the site of City -owned Bayfront
Municipal Auditorium, a 2.06 acre portion of the
Northerly Section of Bayfront Park and portions of
the new Port Bridge right-of-way altogether
comprising approximately 16± acres as per map.
Documents on file with the Planning and Zoning
Boards Administration Department.
It is recommended that the Commission review the
Preliminary Application and permit the applicant
to file a Final Application for Major use special

9500, Article 28 MAJOR USE SPECIAL PERMITS per the
attached resolution.
The Planning Advisory Board on June 6, 1984 is expected to
recommend that the applicants, Paula Raphel for The Rouse
Company, Howard V. Gary for the City of Miami, be permitted to
file a Preliminary Application for a Major Use Special Permit
for the Bayside Project; further recommending that the City
Commission establish a Public Hearing on June 28, 1984, for
consideration of the Final Application for Major Use Special
Permit.
This is a public meeting item, not a public hearing; no public
notice is required.
It is requested that the item be placed on the City Commission
agenda of June 14, 1984.

REQUEST To review the Preliminary Application for Major
Use Special Permit and reconmend that the
applicant be permitted to file a Final
Application for Major Use Special Permit.
BACKGROUND Certain amendments to Article 28 - Major Use
Special Permits - Detailed Requirements which
would have deleted extraneous 'preliminary
procedures were recommended in Amendment "F" to
Zoning Ordinance 9500. Amendment F expired
May 12, 1984, because of the 90-day time limit
within which the Commission must legislatively
decide an item. Therefore, it is necessary to
follow the existing preliminary procedures.
Zoning Ordinance 9500 establishes a Major Use
Special Permit process (Article 28) whereby
defined major uses require recommendation by the
Planning Advisory Board and consideration and
authorization by the City Commission (both
preliminary and final) before construction can
be undertaken. This process encompasses
Developments of Regional Impact and other
projects (as the Major Use Special Permit

Major Use Special Permit to include, in one
action, any changes in the comprehensive plan,
zoning district classifications, other Zoning
actions, and other City ordinances that would be
necessary for a building permit application to
be considered.

it is intended that major use special permits be required where specified uses and/or
occupancies involve matters deemed to be of city-wide or area -wide importance.
The City Commission shall be solely responsible for determinations on. applications
for major use special permits. (See Article 28.)
The City Commission shall refer all applications for major use special permits to the
Planning Advisory Board and to the director of the Department of Planning for
recommendations, and may make referrals to other agencies, bodies, or officers,
either through the Department of Planning or directly, for review, analysis, and/or
technical findings and determinations and reports thereon. (Section 2301.5.)
