HomeMy WebLinkAboutO-09860J-84-571 6/18/84 ORDINANCE NO. 9 8 6 O AN ORDINANCE AMENDING THE CODE OF THE CITY OF MIAMI, AS AMENDED, BY ADDING A NEW SECTION 54-17 PROVIDING THAT VEHICULAR ACCESS TO A PARTICULAR STREET BE PROHIBITED AT AN INTERSECTION WHERE SUCH PROHIBITION IS FOUND TO BE IN THE BEST INTEREST OF THE PUBLIC; PROVIDING A PROCEDURE TO OBTAIN SUCH PROHIBI- 'PION; AND, PROVIDING FOR A CUL-DE-SAC OR OTHER TURN AROUND ON STREETS WHERE VEHICULAR ACCESS IS PROHIBITED; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The Code of the City of Miami, Florida, as amended, is hereby further amended by adding a new Section 54-17 providing for prohibition of vehicular access as follows:l 1 "Chapter 54 STREETS AND SIDEWALKS ARTICLE I. IN GENERAL Geer-54-14---- 54-R5r-----Reaerved- Sec. 54-17. Prohibition of Vehicular Access. (a) The Commission shall have the power, after a properly aTv-ertise3 public hearin2r to require that vehicular access to a particular street be Erohibite3 at an intersection where such ro i ition is founa to be in t -e es interest of the public. (b) The request for prohibited access shall be initiated the De artment ot Public Works or through said Department by petition o property owners within 1000 teet ot the affected intersection, c C When the Director of Public Works deems it necessary, a traffic stud is to be conducted 'an resented at said public hearing. Prior to thepublic hearing, the proposed prohibited access shall a reviewed the Departments of Po ce, Fire, Rescue an Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Section 2. All ordinances, Code Sections, or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordi- nance be declared by a court of Competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. Pierce- REFERENCES: Access Assistant City Manager (Acting) ENCLOSURES: The attached ordinance has been prepared by the Law Department in response to a request by the City Commission to provide a procedure for prohibiting vehicular access to certain streets when such actions would be in the public's interest. This ordinance was passed on first reading on June 14, 1984 and is scheduled for second reading on June 28, 1984. Presentation to the City Commission at this time is in line with the Commission's request that it be considered on the same date as the Harold White (Sander's Hardware) zoning application regarding property located on the southeast corner of S.W. 27 Avenue and Coral Way. To provide further information for the City Commission and the City Manager; also attached is a memorandum prepared by the Director of Public Works which describes three (3) instances where streets have been closed to vehicular traffic. It is important to note that in each instance the request was brought to the City via petitions by citizens; this is consistent with the procedure proposed in this ordinance. City Manager %OBJECT: Street Closures at Intersections FROM: REFERENCES: Do a h Director of Public Works ENCLOSURES: As you requested at our meeting on June 7, my staff has researched the closing of certain streets at intersections pursuant to Commission action. Taluga Drive at South Dixie Highway was closed to vehicular traffic by Resolution 78-680, October 24, 1978, after a public hearing before the Commission. Natoma Street at South Dixie Highway was closed to vehicular traffic by Resolution 74-4, January 10, 1974, after a public hearing before the Commission. Brickell Avenue (South) at Rickenbacker Causeway was closed to vehicular traffic by Resolution 39428, February 14, 1968, after a public hearing before the Commission. An appeal was made to the Commission to re -open the intersection. The Commission deferred _ action on February 29 and March 13, 1968. The Commission held another public hearing on March 28, 1968, and reaffirmed their previous action by Resolution 39527. All of the above items were brought to the attention of the Commission and this Department through petitions from property owners. The decisions by the Commission were all based on consideration of safety for the general public and the neighborhood, not the convenience of a few.
