AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 95009 THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION OF APPROXIMATELY 2226 SOUTHWEST 25TH AVENUE AND 2511-75 SOUTHWEST 22ND TERRACE, MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN) FROM RS-2/2 ONE FAMILY DETACHED RESIDENTIAL TO CR-2/7 COMMERCIAL -RESIDENTIAL (COMMUNITY) BY MAKING FINDINGS; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 43 OF SAID ZONING ATLAS MADE A PART OF ORDINANCE NO. 9500 BY REFERENCE AND DESCRIPTION IN ARTICLE 39 SECTION 3009 THEREOF; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, Miami Zoning Board, at its meeting of February 139 1984, Item No. 2, following an advertised hearing, adopted Resolution No. ZB 15-84, by a 4 to 3 vote RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of approximately 2226 Southwest 25th Avenue and 2511-75 Southwest 22nd Terrace, Miami, Florida, more particularly described as Lots 26-32 inclusive, Block 1, SILVER BLUFF ESTATES SEC A (10-59) of the Public Records of Dade County, Florida, from RS-2/2 One Family Detached Residential to CR 2/7 Commercial -Residential (Community). 0 Section 2. It is hereby found that this zoning classi- fication change: (a) Is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) Is not contrary to the established land use pattern; (c) Will not create an isolated district unrelated to adjacent and nearby districts; (d) Is not out of scale with the needs of the neighborhood or the City; (e) Will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) Is necessary due to changed or changing conditions; (g) Will not adversely influence living conditions in the neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent area; (k) Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or develop- ment of adjacent property in accord with existing regulaticns; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare; Section 3. Page No. 43 of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by these amendments. Section 4. All ordinances, code sections, all parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 5. Should any part or provision of this Ordi- nance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance ,3 a r2 y as a whole. The present zoning classification for'the property for which the rezoning from RS 2/2 to CR 2/7 is sought is inappropriate. The property which is bounded by Coral, Way on the North; S. W. 25th Avenue on the_ East; S. W. 22nd Terrace on the South; and S. W. 27th Avenue on the West is totally within the CR 2/7 classification, except for the seven (7) lots which are the subject of this appli- cation, one of which is presently used as a parking area in association with the commercial development which abuts it. The applicant is seeking to develop a phased office/ commercial development within the entire area described above, and to place a parking structure within the area sought to be rezoned. Since grade level parking would normally be permitted within such area and since the chance in zoning classification would not materially affect the uses within the block, the change in zoning of only a small percentage of the block would materially enhance the overall aesthetics and functional relationship of the proposed pro- ject and would improve the development potential for this important intersection, without adversely affecting abutting properties. 10. The recuested zoning change is appropriate due to the unique location of the property as part of a megablock which runs between S. W. 25th Avenue and S. W. 27th Avenue from Coral Way to S. W. 22nd Terrace. Virtually the entire block is zoned in the CR 2/7 classification and the rezoning of the balance of the block would enhance the opportunities for the developer to design 4n integrated multi -use project with proper aesthetics, landscaping and traffic control. The intersection of S. W. 27th Avenue and Coral Way is and will remain one of the major intersections within the City of Miami. Supplementing the current importance of this intersection will be the effect on the area of the new Coco- nut Grove Mass Transit Station several blocks to the South at the intersection of 27th Avenue and U. S. #1. It has been-anticipated'that the commercialization of areas near mass transit stations would tend to increase the ridership on the mass transit system and would increase the demand for office and commercial space near the mass transit stations. In response we would like to state that: 1. In 1988 the unacceptable levels of service that the County cites will result at C(.):.-al Way ana S.W. 27th Avenue even without the Project. 2. The solution at the intersection, even without the Project, is to provide three (3) through lanes' in all directions. This can be accomplished by minor construction and parking removal along the outside edge. If that were done Level of Service "D" could be achieved even with the Project. 3. White Office Plaza has agreed to improve the portions of S.W. 27th Avenue and Coral Way that are under their control in that manner. That includes northbound S.W. 27th Avenue and eastbound Coral Way. This portion of the improvements, while not solving the full. intersection, does completely mitigate the White office traffic. 4. If adequate levels of service are the City of Miami's only criteria, and those other S.W. 27th Avenue and Coral Way improvements are delayed, then S.W. 22nd Terrace would have to serve as a parallel route even without the White Office Plaza. With only White Office Plaza's improvement, and 14% diversion in 1988, Level of Service "D" could be achieved at the intersection. The level of service on S.W. 22nd Terrace in the area of the Project is controlled by the proposed traffic signal at S.W. 27th Avenue. The level of service, with White Office Plaza's improvements, is well above Level of Service "D". When we first undertook this study we quickly recognized the need for improvement to the Coral Way Corridor regardless of any development at White Office Plaza. The projections of traffic indicated a need for six lane capability along Coral Way under any circumstances. We also recognized that the trees within the median of that road are well worth preserving. Therefore, the two solutions available to the City are: 1. As a minimum create three (3) east and westbound lanes on Coral Way at each major intersection. This would be accomplished by removal of the parking along both sides, reconstruction, and restriping. (Ultimately the six-laning would be continuous.) OR 2. Using S.W. 22nd Terrace as a parallel route and protecting the neighborhoods from traffic infiltration. (Presently, even though illegal, many vehicles already use S.W. 22nd Terrace as an alternate route.) We hope this will resolve anyambiguities regarding the traffic at White Office Plaza. yours, S. Plummer DSP/vl s y • May 9, 1984 Sergio Rodriguez, Director Planning Department City of Miami 275 N.W. 2nd Street Miami, Florida 33128 Re: "Traffic Impact Study, White Office Plaza" Dear Mr. Rodriguez: On review of the referenced traffic report dated January, 1984, which you submitted to us, plus a few meetings with the applicant's traffic consultant and a subsequent report by the consultant dated March, 1984, ve recommend denial of the proposed development based on the projected unacceptable level of service conditions on the adjacent road system in 1988. While the methodology and other technical aspects of the report are acceptable, the consultant, we feel erroneously, assumes S.W. 22nd Terrace, will be converted to a collector route parallel to Coral Way by 1988. Based on this assumption, he has diverted a significant percentage (14%) of the projected Coral Way traffic to S.W. 22nd Terrace. Since this developer is only committed to signalization and minor modifications to the S.W. 27th Avenue/S.W. 22nd Terrace intersection, there is no reason to believe that by 1988 other improvements to establish S.W. 22nd Terrace as a parallel collector route, i.e. construction of three lanes on S.W. 22nd Terrace between S.W. 17 and 37 Avenue and signalization of the S.W. 22nd Terrace/22 Avenue and S.W. 22nd Terrace/32nd Avenue intersections, will be accomplished. Therefore, it is unrealistic to divert this high percentage of Coral Way Traffic. Without this diversion. the projected level of service operation of the Coral Way/S.W. 27th Avenue intersection Would be unacceptable.
