Home My WebLink AboutR-84-0743J-84-492 6/21/84 rr/D-3 RESOLUTION •Nd. 84 -3 A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL Ct_ECTION TO OE HELD ON SEPTEMBER 4, 19n4, FOR T111- PURPOSE OF SUBMITTING TO THE UUAL.IFTFD ELFCTORS OF THE CITY OF 11IAM1 F013 THEIR APPROVAL OR DISAPPROVAL_, A MEASURE KNOWN AS "CHARTER AMENDMENT N0. 1", AMENDING THE CITY CHARTER RY CORRECTING GRAMMATICAL, SYNTACTICAL., AND LINGUTSTTC ERRORS; ELIMINATING nRSnIFTF nR RFDUNDANI PROVISIONS; AND RESTRUCTURING AND RENUMBERING CHARTER SECTIONS AND PARTS THEREOF FOR CLARITY; WHEREAS, the City Commission, at a regular meeting duly called and held sccordinq to law, duly passed an Ordinance which sets forth a proposed Charter Amendment No. 1, amending the City Charter by correcting grammatical, syntactical, and linguistic errors; eliminating obsolete and redundant provisions; and restructuring and renumbering charter sections and parts thereof for clarity; and WHEREAS, said proposed amendment shall become effective in the event that it is approved by a majority of the qualified electors of the City of Miami voting at a special municipal election held for the purpose of establishing said electors to register their approval or disapproval of said proposed amendment; and WHEREAS, it is appropriate and necessary that the City Commission make provision for holding said special municipal election; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A special municipal election is hereby called and directed to be held in the City of Miami, Florida, from 7:00 A.M. until 7:00 P.M. on Tuesday, September 4, 1984, for the purpose of submitting to the qualified electors of the City of Miami for their approval or disapproval a measure known as Charter Amendment No. 1, amending the City Charter CITY COMMISSION MEET114C OP JUN 28 11.11,84 I RESOLUIIu ,�� Ll by correcting grammatical, syntactical, and linguistic errors; eliminating nbsolete or redundant provisions; and restructuring and renumherinq charter sections and parts thereof For cl1riIy. Section 2. A description of the regi.strat.ion hooks and records which pertain to election precincts wholly or partly within the City and which the City is hereby adopting and desires to use for holdinq such special municipal election is as follows: all registration cards, books, records, and certificates pertaining to electors of the City and established and main Lai ned as official by the Supervisor of Elections of Metropolitan Dade County, Florida, in conformity with the provisions of the general laws of the state; the same being hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records, and certificates of the City of Miami. Section 3. The ballot to be used in said election shall be so prepared as to comply with the laws of the State of Florida with respect to absentee ballots and to the use of mechanical voting machines or the Computer Election System (CES). Section 4. In compliance with §100.342, Florida Statutes, the City Clerk is hereby authorized and directed to publish notice of the adoption of the herein resolution and of the provisions hereof, at least twice, once in the fifth week and once in the third week prior to the week in 0*g4.743 _2_ ko which the aforesaid special referendum election, as herein set forth, is to be held in the following newspapers published within the City of Miami; Florida: which notice shall be substantially as set forth in the following form: NOTICE OF SPECIAL_ REFERENDUM ELECTION TO BE HELD ON TUESDAY, SEPTEMBER 4, 1984 IN THE CITY OF MIAMI, FLORIDA PURSUANT TO RESOLUTION NO. 84- A special referendum election will be held on Tuesday, September 4,1984, from 7:00 A.M. until 7:00 P.M. in the City of Miami, Florida, at the polling places designated and set forth herein, for the purpose of submitting to the qualified electors of t.hc City of Miami, Florida, the following question: "CHARTER AMENDMENT NO. 1: Shall the Charger of Lhe City of Miami, Florida, be amended by correcting grammatical, syntactical, and linguistic errors; eliminating obsolete or redundant provisions; and restructuring and renumbering charger sections and parts thereof for clarity.?" Section 5. The City Clerk shall cause to be prepared absentee ballots containing the question set forth in Section 4 above for the use of absentee electors entitled to cast such ballots in said election. Section 6. All qualified electors of the City shall be permitted to vote in said municipal election and the Supervisor of Elections of I;etropolitan Dade County, Florida, is hereby requested, authorized, and directed to furnish, at the cost and expense of the City of Miami, a list of all qualified electors in the City of Miami as shown by the -3- �084 -743 registration books and records of his or her office and to duly certify the same for delivery to and use of the election officers designated to serve at the respective polling places in said election precincts. Section 7. For the purpose of enabling persons to register who are qualified to vote in said special municipal election to be held on September 4, 1984, and who have not registered under the provisions of the general laws of Florida and Chapter 16 of the Code of the City of Miami, Florida, or who have transferred their legal residence from one voting precinct: to another voting precinct: in the City, they may register at the following permanent branch offices as approved by the Supervisor of Elections of Metropolitan Dade County, Florida, which are hereinafter set forth and which will be open during the following times: ELECTIONS DEPARTMENT 1444 Biscayne Boulevard, Miami, Florida Monday to Friday, inclusive: 8:00 A.M.- 5:00 P.M. METRO JUSTICE BUILDING Street, Miami, Florida Monday to Friday, inclusive: 8:00 A.M.- 12:00 Noon 1:00 P.M.- 5:00 P.M. In addition to the above times and places, said qualified persons may register at such other branch offices and may also use the mobile registration van for the purpose of registration in order to vote in the herein described election during such times and on such dates as shall be designated by the Supervisor of Elections for Metropolitan Dade County. Section 8. RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the City Commission in all -4- transactions with the Supervisor of Elections of Metropolitan Dade County in relation to matters pertaining to the use of the regi.st:ratinn hooks and the holding of said special municipal election. The election clerks and inspectors to serve at said polling places shall be those designated by the Supervisor of Elections for Metropolitan Dade County for such purpose. Section 9. The proper officials of tht; City of Miami and Dade Cntinty are herehy nuthorized and directed to submit said question to the e.l.ectoratc at the September 4, 1984 special, municipal election and to certify the result thereof to the Commission of the City of Miami, Florida, and all acts pertaining to said election heretofore performed by said officials are hereby ratified and confirmed. Section 10. The City Clerk shall deliver a certified copy of this resolution to the Supervisor of Elections for Metropolitan Dade County not less than 45 days prior to the date of the herein special municipal. election. Jose Garcia -Pedrosa Procedural Timetable City Attorney Since a possible housekeeping Charter Amendment has been the subject of several recent public hearings held throughout the City, we have prepared an attached proposed resolution directing that such an amendment be drafted in ordinance form to be considered by the City Commission on second and final reading at its June 28, 1984 meeting. In the absence of any further consideration by the City Commission of the Charter Amendment prohibiting electronic opinion polling, the housekeeping Charter Amendment has been referred to as Charter Amendment No. 1. We will also be forwarding a copy of the proposed ordinance (Charter Amendment No. 1) to be considered on first reading at the June 14, 1984 meeting if the attached Resolution is adopted. If the City Commission adopts such an ordinance on final readinq at its meeting of June 28, 1984, a resolution calling for a referendum on September 4, 1984 would also be appropriate for adoption on June 28, 1984.
