PUBLIC HEARING DATE FOR CONSIDERATION OF THE
FINAL APPLICATION FOR MAJOR USE SPECIAL
PERMIT.
WHEREAS, Article 28 of Ordinance No. 9500, the Zoning
Ordinance of the City of. Miami, Florida, requires developers of
Major Uses, as defined, to apply for, and receive, a Major Use
Special Permit before applying for a building permit; and
WHEREAS, the Commodore Bay Project, located at approximately
3471 Main Highway, meets the criteria for Major Use designation,
as set forth in said Ordinance and Article 28; and
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 30, 1984, by a 7 to 0 vote, after reviewing the Prelimin-
ary Application for Major Use Special Permit recommended that the
developer be permitted to proceed to file a Final Application for
Major Use Special Permit; and

WHEREAS, the Commission has reviewed the Preliminary
Application for Major Use Special Permit and considered any
additional conferences, referrals, or materials that may be
required prior to consideration of the Final Application for
Major Use Special Permit;
NOW, `i'HEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The applicant for the Commodore Bay Project,
located at approximately 3471 Main Highway, may proceed to file a
Final Application for Major Use Special Permit with the Director
of Planning.
Section 2. No right or privilege is conferred on the
applicant by the permission to proceed to Final ypplication. This
resolution is not to be deemed approval of the development

Thursday, September 27, 19€34, as the date for a public hearing
for consideration of the Final. Application for Major LJse Special

following an advertised hearing, adopted Resolution PAB 59-84 by a 7 to 0
vote, recommending approval of the preliminary application and
consideration of recommending permission to file a final application for
Major Use Special Permit for Commodore Bay located at approximately 3471
Main Highway, legal description on file with the Planning and Zoning Boards
Administration Department, per Article 28 MAJOR USE SPECIAL PERMITS:
DETAILED REQUIREMENTS, Sections 2802.3-7 and 2803 of Zoning Ordinance 9500,
as amended; further recommending that the City Commission establish a
public hearing date for consideration of the final application for Major
Use Special Permit.
Backup information is included for your review.
A RESOLUTION to provide for the above has been prepared by the City

consideration of the Final Application for Major
Use Special Permit.
To review the Preliminary Application for Major
Use Special Permit and recommend that the
applicant be permitted to file a Final
Application for Major Use Special Permit.
Certain amendments to Article 28 - Major Use
Special Permits - Detailed Requirements which
would have deleted extraneous preliminary
procedures were recommended in Amendment "F" to
Zoning Ordinance 9500. Amendment "F" expired
May 12, 1984, because of the 90-day time limit
wi thi n which the Commission crust legi sl ati vely
decide an i tern. Therefore, it is necessary to
follow the existing preliminary procedures.
Zoning Ordinance 9500 establishes a Major Use
Special Permit process (Article 28) whereby
defined major uses require recommendation by the
P1 anni nn Advisory Board and corns i dct-ati on and
authorization by the City Commissiorn (both
preliminary and final) before construction can
be undertaken. This process encompasses
Developments of Regional Impact and other
projects (as tyre t4ajor Use Special Permit

The project proposes a mixed -use planned
development (PD-MU) with: restaurants, outdoor
cafes and shops along an open Street and Plaza;
apartments set above shops; parking and service
underground. -
The initiation of this preliminary approval does
not constitute approval in that the Planning
Department is still discussing with the
applicant the intensity of the proposed project.
