A RESOLUTION APPROVING IN CONCEPT THE ESTABLISHMENT OF RESTAURANT ARCADES ALONG DOWNTOWN STREETS, SPECIFICALLY, FLAGLER STREET; FORMALLY REQUESTING THAT FLAGLER STREET NO LONGER BE DESTGNA T ED AS A STATE HIGHWAY; AUTHORIZING AND DIRECTING THE CITY MANAGER TO PROCEED TO OBTAIN REQUIRED AMENDMENTS TO THE SOUTH FLORIDA BUILDING CODE TO ALLOW THE CONSTRUCTION OF THE ARCADES; FURTHER DIRECTING THE CITY ATTORNEY TO PREPARE THE NECESSARY AMENDMENTS TO THE CITY CODE AND ZONING ORDINANCE TO PERMIT SUCH ARCADES. WHEREAS, the City Commission adopted Motion No. 82-32 in January 13, 1983 expressing, among other matters, its desire to have arcades along certain sections of Flagler Street; and WHEREAS, Section 54-100 of the City of Miami Code was amended in March of 1983 to allow restaurant arcades by revocable permits granted by the City Commission in the Flagler Street special overlay district after approval. by the City Manager and recommendations from various departments; and WHEREAS, Flagler Street is now functionally designated as part of the State highway systems; and WHEREAS, 5339.301, Florida Statutes, prohibits commercial use of the right-of-way of any state road; and WHEREAS, the South Florida Building Code prohibits struc- tures or encroachments within the public right-of-way; and WHEREAS, the City Commission has determined that a public need exists for restaurant arcades in the downtown area to improve pedestriaii traffic; NOW, `l'HE'REFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The concept of the establishment of restaurant arcades in the downtown streets, specifically Flagler Street, is hereby approved. Section 2. It is hereby formally requested of the State %..ii 1 1.V1vi1v1n:;sjQlj MEETIi 'Cl or r of Florida that Flagler Street no longer be designated as a State Highway. Section 3. The City Manager is hereby authorized and directed to attempt to obtain the necessary amendments to the South Florida Building Code which will allow the construction of the proposed arcades. Section, 4. The City Attorney is hereby authorized and directed th-creifter to prepare the necessary legislation to amend the City Code and the Zoning Ordinance to permit the proposed arcades.
