AN EMERGENCY ORDINANCE AMENDING SECTION 1, OF
ORDINANCE NO. 9534, ADOPTED DECEMBER 9, 1982,
THE EXISTING CAPITAL IMPROVEMENT APPROPRIATIONS
ORDINANCE, AS AMENDED, BY INCREASING APPROPRIA-
TIONS IN THE ORANGE BOWL STADIUM ENTERPRISE
FUND FROM ANTICIPATED RESORT TAX REVENUES IN AN
AMOUNT OF $549,700, TO COMPLETE THE IMPROVEMENTS
TO THE FIELD LIGHTING SYSTEM AT A COST OF
$464,700 AND TO BEGIN A SEAT MODERNIZATION PROGRAM
AT A COST OF $85,000 FOR THE INITIAL ORDER OF
SEATS AT THE ORANGE BOWL STADIUM PRIOR TO THE 1984
FOOTBALL SEASON; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9534 on
December 9, 1982, establishing resources and appropriations for the
implementation of Capital Improvements in the City of Miami; and
WHEREAS, the City's Department of Public Works has recommended
the completion of the renovation and improvement of the Orange Bowl
Stadium field lighting system which was approximately 40% completed
during the 1982 football season using Resort Tax funds; and
WHEREAS, the Department of Public Works has determined that the

j lighting renovation can be completed with new lighting fixtures
installed on existing light towers for $464,700; and
WHEREAS, Resolution 84-471 accepted the bid of Frank J. Moran,
Inc. subject to the availability of funds; and
WHEREAS, the Departments of Building and Vehicle Maintenance
and of Public Works have determined the fiberglass covered bench
seating in the Orange Bowl Stadium is severely deteriorated and that
replacements are not available; and
WHEREAS, a molded bottom plastic bench type seat similar to one
used in other NFL and major league baseball stadiums has been
specified as a replacement; and
WHEREAS, chairback seats of the same molded plastic were evaluat-
ed but could not be used without a significant reduction in the
seating capacity of the Orange Bowl Stadium; and

WHEREAS, an initial purchase of $85,000 worth of said plastic
seats is proposed for installation before the 1984 football season;
and
WHEREAS, the City of Miami plans to request Resort Tax funding
over the next several years until this seating renovation project
is completed; and
WHEREAS, the Tourist Development Council at its May 31, 1984,
meeting approved $464,700 for the lighting project and $85,000 for
the seating project from Anticipated Resort Tax Revenues; and
WHEREAS, the total amount of $549,700 is available from
Anticipated Resort Tax Revenues and can be appropriated in the
Orange Bowl Stadium Enterprise Fund;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
"Section 1. Section 1 of Ordinance No. 9534 adopted December 9,
1982, is hereby further amended in the following particulars: 1/

previously authorized projects and fund ap-
propriations for implementation of all municipal
capital improvements of the City of Miami,
Florida. The sources of revenues to support the
herein appropriations are hereby identified by

Section 2. All ordinance] or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph, clause,
phrase or word of this ordinance is declared invalid, the remaining
provisions of this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of
peace, health, safety and property of the City of Miami, and upon the
further ground of the necessity to make the required and necessary
payments to its employees and officers, payment of its contracts,
payment of interest and principal on its debts, necessary and required
purchases of goods and supplies, and to generally carry on the
functions and duties of its municipal affairs.
Section 5. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than
fourfifths of the members of this Commission.

The Office of Stadiums recommends the adoption
of an emergency ordinance amending the Capital
Improvement Appropriation Ordinance No. 9534,
adopted December 9, 1982, the existing capital
improvements appropriation ordinance, as
amended, by increasing appropriations in the
Orange Bowl Stadiums Enterprise Fund and the
Anticipated Resort Tax Revenues resource by an
amount of $549,700 to complete the improvements
to the field lighting system at a cost of $464,700
and to begin a seat modernization program at a cost
of $85,000 for the initial order of seats at the
Orange Bowl Stadium prior to the 1984 football
season.
In June 1982 the Tourist Development Council committed $154,000 in
Resort Tax Funds for new Orange Bowl field lighting to replace 40%
of the old deteriorated fixtures with "quick -start" metal halide
lights on the main light towers.
—' On May 31, 1984 the T.D.C. approved the funding of Phase II, the
completion of the Orange Bowl field lighting, replacing the remainder
of the deteriorated light fixtures with "quick -start" metal halide
lights, central switching system and structural repairs to the towers
in the amount of $464,700.
Also in May 1984 the T.D.C. was notified of the need to replace
deplorable and unsafe seating in the Orange Bowl.
On May 31, 1984 the T.D.C. approved the funding to replace approxi-
mately 3,400 seats with plastic, molded bottom type, bench seats
in the amount of $85,000.
At the April 26, 1984, City Commission meeting a resolution was
passed which accepted the bid of Frank J. Moran, Inc. in the proposed
amount of $400,601, base bid plus additive items "A" and "B" of the

proposal, for Orange Bowl Field Lighting Improvements 1984; with
monies therefor allocated subject to the availability of funds in
the amount of $400,601 to cover the contract cost; allocated the
amount of $56,084 to cover the cost of project expenses; allocated
the amount of $8,015 to cover the cost of such items as advertising,
testing laboratories, and postage; and authorized the City Manager
to execute a contract with said firm subject to the availability of
funds. The total project cost is $464,700.
The Public Works Department has prepared bid specifications for
the Purchasing Department for the approximately 3,400 replacement
seats. Bids for these seats are to be received in June 1984 and a
contract is anticipated to be awarded in July 1984.
It is requested that this ordinance be scheduled on the City Commission
meeting of June 28, 1984.
