THEREFOR TO BE PROVIDED FROM LOCAL DRAINAGE
PROJECTS APPROPRIATION
WHEREAS, James A. Cummings, Inc., contractor has for his
own interest in dewatering, a building site at Mary Street and
Florida Avenue (known as Grove Square Development) constructed a
36-inch storm sewer in Mary Street from a point approximately 100
feet north of Florida Avenue to Grand Avenue, and replaced an
existing 24-inch storm sewer in Mary Street between Grand Avenue
and South Bayshore Drive with a 36-inch storm sewer; and
WIIEREAS, the aforementioned work was done with the
approval of the Director of the Department of Public Works and
with the understanding that the improvements would become the
property of the City of Miami; and
WHEREAS, the improvements provided by the work will be
utilized as a necessary part of the Coconut Grove Storm Sewer
Project planned for construction in fiscal year 1985-86; and
WHEREAS, James A. Cummings, Inc., has requested reimburse -
meet in the amount of $16,306.71 for the cost of the materials for
doing the work in accordance with an agreement with the Director of
the Department of Public Works; and
WHEREAS, it is estimated that it would have cost the City
$90,000 to provide the Labor and materials to do the same work as
part of Coconut Grove Storm Seiner Project; and
WliERI:AS, the City Manager and the Director of the Depart-
ment of Public Works recommend that the requested reimbursement be
authorized;

CITY OF MIAMI, FLORIDA:

The Department of Public Works recommends adoption
of a resolution authorizing the City Manager to
reimburse James A. Cummings, Inc., in the amount
of $16,306.71 for the cost of materials only for
the construction of a 36" storm sewer in Mary
Street between South Bayshore Drive and Florida
Avenue, said sewer to be utilized as part of
Coconut Grove Storm Sewer project to be constructed
in Fiscal Year 1985-86; funds therefor to be
provided from Local Drainage Projects Appropriation.
James A. Cummings, Inc., to facilitate dewatering a building site at
Mary Street and Florida Avenue, asked and was permitted to construct
a 36" storm sewer in Mary Street between Grand Avenue and Florida
Avenue, and to replace an existing 24" storm sewer in Mary Street
between Grand Avenue and South Bayshore Drive with a 36" storm sewer.
This department approved the work, with the understanding that the
storm sewers would become the property of the City of Miami; they
will be incorporated into the Coconut Grove Storm Sewer project,
which is planned for construction in Fiscal Year 1985-86.
When the contractor asked permission to construct the improvements,
since the City would be receiving part of a new storm sewer, he asked
that we reimburse him for the cost of the materials. lve agreed that
at the time of the completion of the work, we would ask the Commis-
sion to consider a reimbursement. We estimate that it would have
cost the City $90,000 in 1984 dollars to construct the improvements
we will be receiving for $16,306.71. Therefore, we recommend
approval of the resolution authorizing the reimbursement.
