WHEREAS, the State Legislature has enacted HB-4D, entitled, Truth in Millage (TRIM Bill), which requires municipalities to establish a proposed millage rate; and WHEREAS, said law stipulates that the proposed millage rate be submitted to the Property Appraiser and the Tax Collector; and WHEREAS, said rate will reflect the levy necessary to realize property tax revenues anticipated in the FY'85 Budget; and WHEREAS, the TRIM Bill requires that proposed tax rate be included on tax notices; and WHEREAS, the proposed millage rate submitted to the Property Appraiser is not binding but is necessary for the purpose of preparation of tax notices; and WHEREAS, the City Commission also authorized under Chapter 14, Section 14-34 of the Miami Code, to levy an additional ad valorem tax on all real and personal property in the downtovrn district, not exceeding one half (1) mill on dollar valuation of such property for the purpose of financing the operation of the Downtown Development Authority; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to establish a proposed millage rate for the City of Miami, Florida for the fiscal year beginning October 1, 1984, and ending September 30, 1985 as follows: General Operating 9.8571 Debt Service 2.0520 Total i'li l l age Rate 11.9091 Section 2. The City Manager- is further authorized to submit a proposed millage rate for the DowntoG,.n Development Authority for the fiscal year beginning October 1, 1984, and ending September 30, 1985, as follows: General Operating .1429 Total Hill age Rate .1429 Section 3. Surana, Director FR°M: Department of Management & Budget 1 ' DATE: July 10, 1984 FILE: DFiB2 SUBJECT: Proposed Mill age Rates for FY'85 REFERENCES: ENCLOSURES: It is recommended that the.City Commission approve the attached Resolution establishing the fiscal year 1984-85 proposed millage rates for the City of Miami and the Downtown Development Authority (DDA). On June 30, 1980, the State Legislature enacted House Bill - 4D entitled "Truth in Millage (TRIM Bill)." This bill requires municipalities to establish a proposed millage rate and stipulates that the proposed millage rate be submitted to the -property Appraiser for inclusion in the City's tax notices mailed to property owners. This is a proposed millage rate and may be changed at the time the final budget is adopted. The City Commission is authorized under Chapter 14, Section 14-34 of the Miami Code to levy a special ad valorem tax on all real and personal property in the Downtown district not exceeding one half (1) mill for the purpose of financing the operations of the DDA. The proposed FY'85 millage rates for the City of Miami (General Operating and Debt Service) and the DDA as compared to FY'84 rates are outlined below: City of ;1iami FY'84 FY'85 Diff. Change General Operating 9.5514 9.8571 .3057 3.2 The increase in the millage rate for the general operating budget is to offset revenue losses in Federal Revenue Sharing, State Revenue Sharing, Franchise Fees (i.e., Southern Bell) and to pay for the additional cost of government. Increased requirements per the debt repayment schedule in FY'85 for authorized and outstanding General Obligation Bond issues and a reduction in available fund balance revenues. 2 Page 2 RE: Proposed Miliage Rates for FY'85 July 10, 1984 Downtown Development FY184 FY185 Au on ty General Operating .4486 .1429 Diff. % Change (.3057) (68.1) According to an opinion from the State of Florida Department of Revenue with which the City Attorney's Office concurs, the combined millage rates of the City of Miami (General Operating) and the Downtown Development Authority cannot exceed the State -mandated cap of 10 mills. Therefore, the reduction in DDA's millage rate is to offset increased budgetary requirements in FY'85 for the City of Miami. However, the City will contribute to DDA the difference between the property tax revenue limit and the revenue to be generated by the DDA millage levy. On July 30, 1984, the City Commission must also establish meeting dates and times of the first and second public hearings in connection with the City and DDA FY'85 proposed millage rates and budgets. Outlined below are the Public Hearing Dates which are available to the City for the first and second public hearings to adopt FY'85 budget and millages. These dates have been developed by strict adherence to the rules and regulations as set forth in the State's Trim Bill. Please note that these two Public Hearings must be held after 5:00 pm.
