HomeMy WebLinkAboutO-09865J--84-751 Amendment No. 40 to Ordinance No. 9534 ORDINANCE NO.(,) f3 rk AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 9534, ADOPTED DECEMBER 91 19829 THE EXISTING CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, AS AMENDED, BY ESTABLISHING A NEW CAPITAL IMPROVEMENT FUND ENTITLED: "AIRPORT SEVEN OFFICE BUILDING (UDAG)I" AND APPROPRIATING FEDERAL FUNDS FOR ITS OPERATION IN THE AMOUNT OF $11407006; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. a - WHEREAS, the City Commission adopted Ordinance No. 9534 Ifn N x December 9, 1982, establishing resources and appropriations fdp ro c the implementation of Capital Improvements in the City of Miam, o �► and WHEREAS, on January 19, 1984, the City Commission adopted a Resolution No. 84-29 approving in principle the application of the Airport 5040, Limited Partnership, as the developer for construction of a nine -story commercial and office building with the support of an Urban Development Action Grant (UDAG); and i WHEREAS, on January 31, 1984, the City of Miami submitted an application to the United States Department of Housing and Urban ? Development requesting UDAG funding to support the aforementioned j project; and WHEREAS, the purpose of urban development action grants is to assist distressed cities and urban counties which require increased public and private investment in order to strengthen their economic, employment, and tax base; and WHEREAS, the United States Department of Housing and Urban Development has awarded the City of Miami a $1,407,306 Urban Development Action Grant to cover part of the estimated $9.2 million cost to construct the nine story office building; and WHEREAS, the project site is located on the South side of N. W. 7th Street approximately 370 feet East of N. W. 51st Avenue; and WHEREAS, the City of Miami shall loan the project developer a sum not to exceed $1,407,306 in conformance with the contract between the City of Miami and the United States Department of Housing and Urban Development and the loan agreement between the City of Miami and Airport 5040, Limited Partnership; and WHEREAS, the project developer must spend $1.5 million in private funds before receiving any loans from the UDAG funds; and WHEREAS, after the $1.5 million expenditure, the project developer shall be eligible to receive UDAG funds in the form of a loan in the ratio of $1 in UDAG funds to $4 in private funds; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,FLORIDA: "Section 1. Section 1 of Ordinance No. 9534, adopted December 90 1984, is hereby further amended in the following particulars: 1/ -, "Section 1. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Gary City Manager DATE: July 23, 1984 FILE: SUBJECT: UDAG Grant Airport 7 Office Building FRow Dena Spillman, Director REFERENCES: City Commission Agenda Department of Community Development July 30,.1984 ENCLOSURES: It is recommended that the City Commission approve the attached Ordinance and Resolution, appro- priating the sum of $1,407,306 and authorizing the City Manager to execute on behalf of the City the attached Grant Agreement as amended, with the United States Department of -Housing and Urban Development to receive an Urban Development Action Grant (UDAG) which will provide. $1,407,306 to Airport 5040 Limited Partnership in the form of a loan for the development of an office building in the Flagami Area and authorizing the City Manager to accept the UDAG and execute an agreement with the Developer base on the term of the grant. This project entails the construction of a nine (9) story 90,686 sq. ft. building for commercial and office use located at N.W. 7th street and N.W. 51st Avenue. Total cost of the project $8,982,306 UDAG Loan $1,407,306. (See attached Fact Sheet). The Airport Seven Office Building UDAG application, was approved by the City Commission on April 27, 1984. The application received preliminary approval by the U.S. Department of HUD on April 4, 1984 and final approval on June 18, 1984. The Developer and the U.S. Department of Housing and Urban Develop- ment are in agreement with the term of the contract, as amended as is the City Staff. r El Howard V. Gary July 23, 1984 Page 2.
