AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY
3930 - 4024 NORTHWEST 7TH STREET, MIAMI,
FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN)
FROM RG-2/4 GENERAL RESIDENTIAL TO CR-2/7
COMMERCIAL RESIDENTIAL (COMMUNITY) BY MAKING
FINDINGS; AND BY MAKING ALL THE NECESSARY
CHANGES ON PAGE NO. 32 OF SAID ZONING ATLAS
MADE A PART OF ORDINANCE NO. 9500 BY
REFERENCE AND DESCRIPTION IN ARTICLE 3,
SECTION 300, THEREOF; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of May 21,
1984, Item No. 1, following an advertised hearing, adopted
Resolution No. ZB 36-84, by a 7 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately
3930 - 4024 Northwest 7th Street, Miami, Florida, more particu-
larly described as Lots 1 through 12 inclusive, Block 2, DURHAM
TERRACE (44-55) of the Public Records of Dade County, Florida,
from RG-2/4 General Residential to CR-2/7 Commercial Residential
(Community).
Section 2. It is hereby found that this zoning classi-
fication change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to

(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not he a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 32 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

Members of the Board:
We, the undersigned, property owners, and neighbors of the proposed
zoning change on the abobe captioned property believe that:
1- The block on the south side of the N.W. 7th Street between 39th Ave.
& 40th Court is presently an RG 2/4 zoning, the last remaining pocket
of density residential zoning on this heavily commercial which runs fran
Downtown Miami to 72nd Avenue.
2- The requested change by the petitioners CR 2/7, will bring this
piece of property to conform with the rest of this street as well as
all other main arteries in the City of Miami.
3- Eventhough there are good neighbors in the surrounding blocks, it
is still a very mixed area. In the five blocks fran 37th Avenue to Le
Jeune Road there is: a Dog Track, a Shopping Center, a Bank, (2) two
Gas Stations, a Warehouse, Restaurants, a Fire Station, a Funeral Herne,
Stores a (2) two stores Office Building, and housing. It is our believe
that buildings on that block being changed with'its'broad'fror_tage .
will give nothing but a lift to this section of N.W. 7th Street.
4- The concept of a mixed zone use will be a blessing to the parking
situation, since during daytime hours while tenants are out to work
there will be additional parking for commercial use an viceversa during
nightime. Parking will be provided underground, thus minimizing the
volume of the structure to be built to conform with the rest of the
neighbors.
5- New building or buildings will give a great lift to the image
of the neighborhood, considering the rapid deterioration of the present
old buildings on the subject property and the kind of questionable
tenants that these blighted buildings will bring to the area.
6- Dade County and particularly the City of Miami are enjoying a
_ raFdd graWth, and this property should be a part of that growth
thus increasing the tax base as well as the value of surrounding properties,
both residential and canmercial.

The proposed zoning designation, CR-2/7 commercial residential/
general, is appropriate for this property because it encourages
a redevelopment vitality for mixed uses in line with current
zoning trends for this area while yet very much in character and
scale with its surrounding environment. It is felt that the
strength of this street is at its two ends, 37th Avenue and Le
Jeune Road, but that this proposed zoning designation and sub-
sequent project will do much to pull together the middle of this
five block area.

KNOW ALL MEN BY THESE PRESENTS that the under-
signed, being the owners, or having some right, title or
interest in the following described property, lying, being
and situated in Dade County, Florida, to -wit:

in order to assure the City Commission of Miami, Florida,
that the representations made to it by the owners will be
abided by, voluntarily made the following Declaration of
Restrictions covering and running with the above -described

1. For the purposes hereof, the following defini-

quested supplemental landscaping shall be
submitted by Owners and approved by the City
Miami Planning; Department, as to type, height
and size of wall and trees at time of plan-
ting.
As further part of this agreement, it is hereby:
understood and agreed that any official tnsp-�,_tor of the
City of Miami Building and Zoning Department, or its agents
duly authorized, may have the privilege at any time during
normal working hours of entering and investigating the use
of the premises to determine whether or not the requirements
of the building and zoning reguiattons'and the conditions
herein agreed to are being; fulfilled.'
These Restrictions during their lifetime shall
be for the benefit of, and limitation upon, all present
and future owners of the real property and for the public
welfare.
This Agreement on the part of the owner shall
constitute a covenant running with the Land and shall be
recorded in the public records of Dade County, Florida,
and shall remain in full force and effect and be binding
upon the undersigned, and the heirs, successors and assigns
until such time as the same is modified or released.

These covenants are to -run with the land and
shall be binding on all parties and all persons claiming
under them for a period of twenty (20) years from the date
these covenants are recorded.
This Declaration of Restrictive Covenants may
be modified, amended or released as to the land herein des-
cribed, or any portion thereof, by a written instrument
executed by a majority of the then owners of the fee simple
title to the lands to be affected by such modification,
amendment or release, provided that the same is also approv-
ed by the City Commission or the Zoning Board of Miami,
Florida,(whichever by law has jurisdiction over such
matters) after public hearing. •
Should this Declaration of Restrictive Covenants
be so modified, amended or released, the Director of the
City of Miami Building; and Zoning Department, or his suc-
cessor, shall forthwith execute a written instrument effect-
uating and acknowledging such modification, amendment or
release.
Enforcement shall be by action at law or in equity
against any parties or persons violating, or attempting
to violate, any covenants, either to restrain violation
or to recover damages. The prevailing party shall be en-
titled to recover, in addition to costs and disbursements
allowed by law, such sum as the Court may adjudge to be
reasonable for the services of his attorney.
Invalidation of any one of these covenants, by
judgment or Court, in no way shall affect any of the other
provi'sLons which shall remain in full force and effect.
