ORDINANCE NO. 9870
AN ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 9834, ADOPTED MAY 10, 19849
BY APPROPRIATING THE ADDITIONAL TOTAL
SUM OF $59 4799 910 TO THE EXISTING TRUST
AND AGENCY FUND ENTITLED "COMMUNITY
DEVELOPMENT BLOCK GRANT (LOTH YEAR)" IN
THE FOLLOWING MANNER: THE SUM OF
$2,164,910 FROM PREVIOUS YEARS' COMMUNITY
DEVELOPMENT BLOCK GRANT FUNDS (3RD
THROUGH (9TH YEARS); THE SUM OF $371,000
FROM ANTICIPATED CDBG1/ PROGRAM INCOME;
AND AN ADDITIONAL 10TH YEAR CDBG
ALLOCATION OF $2,944,000, FOR THE
EXECUTION OF APPROVED GRANT ACTIVITIES;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 8719
on October 26, 1977, establishing resources and
appropriations for grant funds anticipated by the City of
Miami; and
WHEREAS, the City Commission adopted Ordinance No. 9834
on May 109 1984, establishing a new Trust and Agency fund
entitled Community Development Block Grant (loth Year) and
appropriating $11,255,000 for the execution of same; and
WHEREAS, the Department of Housing & Urban Development
approved the reprogramming of 3rd through 9th Years Community
Development funds in the sum of $2,164,910 to provide
Community Development activities for the period commencing
June 16, 1984, and ending June 15, 1985; and
WHEREAS, the Department of Community Development
projected that income amounting to $371,000 will be generated
during the period commencing June 16, 1984, and ending June
15, 1985; and

WHEREAS, the Department of Housing & Urban Development

period commencing June 16, 1984, and ending June 15, 1985;
and
WHEREAS, it is anticipated that the Department of Housing &
Urban Development will award to the City of Miami an additional
$29944,000 to provide expanded Community Development activities
for the period commencing June 16, 1984, and ending June 15,
1985; and
WHEREAS, the herein Ordinance is a proper vehicle to
appropriate the aforesaid $2,164,910 of Community Development
funds from previous years; and
WHEREAS, the herein Ordinance is a proper vehicle to
appropriate the aforesaid $371,000 of anticipated CDBG program
income; and
WHEREAS, the herein Ordinance is a proper vehicle to
appropriate the aforesaid additional Community Development grant
of $29944, 000;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 9834, adopted
May 10, 1984, is hereby amended in the following particulars.1
"Section 1. Section 1 of Ordinance No. 8719,
adopted October 26, 1977, is hereby amended in the
following particulars:

APPROPRIATION: Community Development Block Grant

Section 2. The herein amended appropriation of
$16,734,910, from the sources as set forth in the Preamble to
this ordinance, for Community Development refers to those
publicly supported physical development activities and those
related social or economic development activities being
carried out within a reasonable period of time in accordance
with the approved Grant Program Final Statement.
Section 3. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are
hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared
invalid, the remaining provisions of this ordinance shall not
be affected.

ENCLOSURES:
It is recommended that the City Commission
approve the attached Ordinance and Resolution,
appropriating the additional sum of $5,479,910
consisting of $2,535,910 of funds previously
allocated for 1984-85 activities from repro-
gr armed funds and projected program income, and
$2,944,000 additionally added to our Block
Grant as a result of the Office of the Census
correction of data pertaining to Cuban and
Haitian entrants, and authorizing the City
Manager to submit an addendum for the
approved Grant Program Final Statement to
the U.S. Department of Housing & Urban
Development requesting increased funding
in the amount of $2,944,000 for the proposed
Community Development Program during 1984-85,
and further authorizing the City Manager,
upon approval of said Grant by HUD, to accept
the same and negotiate the necessary imple-
menting contracts and agreement.
The City Commission held a public hearing on April 10, 1984, at
which time it allocated funds for the 1984-85 Community Development
program year consisting of the following:

Recently, based on information submitted by this department,
the Office of the Census corrected data pertaining to the Cuban
and Haitian entrants that were counted as part of the 1980
Presidential Order to more properly reflect the degree of
poverty in the City. This has resulted in an increased alloca-
tion of $2,944,000 to the City of Miami by the U.S. Department
of Housing & Urban Development.
Per attached memo, staff recommended to the Community Develop-
ment Advisory Board that these funds be targeted to the King
Heights and East Little Havana areas in a concentrated effort
to improve the housing stock in those areas through rehabili-
tation of multifamily housing and the acquisition of blighting
influence in the neighborhood. In addition to this, staff
recommended $588,000 for administration to cover costs associated
with the implementation of these additional programs as well as
to cover administrative costs associated with the different HUD
programs which will be forthcoming, such as the Housing Rehabili-
tation Block Grant and the Housing Development Action Grant for
which administrative funds are not available.
The Board, although generally in agreement with staff's proposal,
recommended that all the funds be allocated to one neighborhood
in order to have a greater impact, and that these funds be
allocated to the King Heights area. In addition, the Board
re^ommended that fifteen percent of the grant be allocated to
provide additional funding to social service programs, $300,000
to provide a twenty percent increase to existing social service
programs, and $135,000 to assist social service agencies having
special problems.
Staff, nevertheless, recommends the dual approach of dividing the
housing funding between East Little Havana and King Heights as

eed money is required in both areas to stimulate housing

ehabilitation and as such development is consistent with the
long-standing revitalization plans of each area.
With respect to social programs, it is recommended that $150,000
be used to fund a ten percent across-the-board increase to all
social service agencies. Social Service agencies have not
received any increase during the last three years.

On June 14, 1984, the City Commission passed Agenda Item #46
(10th Year CDBG Appropriation Amendment to Ordinance #9834)
on first reading. This ordinance had a deficiency in its
structure (but not the title) which has been corrected in the
attached redraft and is now in proper form for final
adoption.
On July 69 1984 we received your draft of a proposed
ordinance amending 9th Year CDBG appropriation (Ordinance No.
9639). This draft has been modified and may now be
considered by the City Commission in the attached form.
