HomeMy WebLinkAboutR-84-1026RESOLUTION NO. 84-1026 A RESOLUTION AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE ON BEHALF OF THE CITY OF MIAMI A TRI-PARTY RAILROAD REIMBURSEMENT AGREEMENT FURTHER UE31GNATED AS JOB NO. 87000- 6955, PARCEL 1(XNG-N) BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, FLORIDA BAST COAST RAILWAY COMPANY AND THE CITY OF MIAMI FOR THE CONSTRUCTION AND MAINTENANCE OF THE RAILROAD GRADE CROSSING ON N. E. 71 STREET AT N. E. 4 AVENUE. SEAS, the City of Miami entered into an agreement with the East Coast Railway Company on February 10, 1956, that the City to maintain the railroad grade crossing on N. E. t at N. E. 4 Avenue ; and REAS, as part of a State wide railroad crossing improvement the State of Florida Department of Transportation proposes the Florida East Coast Railway Company construct at the expense a new railroad grade crossing on N. E. 71 Street 4 Avenue; NOW, THEREFORE, BE IT RESOLVED BY tHE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the City of Miami enter into a tri-party Railroad Reimbursement Agreement, further designated as Job No. 87000-6955, Parcel 1(XNG-N), with the State of Florida Department of Transportation and the Florida East Coast Railway Company for the construction and maintenance of the railroad grade crossing on N. E. 71 Street at N. E. 4 Avenue, which crosses the right of way and tracks of the Florida East Coast Railway Company at FDOTIAAR Crossing Number 27262J-J. Section 2. That the City of Miami, upon completion of the new railroad grade crossing', shall be responsible for the maintenance and replacement costs of the highway roadbed, including the Standard Railroad Crossing Type "T" Modified, across the entire width of the Florida East Coast Railway Company's right of way as designated in Paragraph 2 of the Railroad Reimbursement agreement. The Florida East Coast Railway Company shall be responsible for maintenance and replacement cost of all track bed and rail components. Section 3. E. 4 Avenue �M' � R[RRENGEf Dona d W.-Cather (For Commission Meeting of Director of Public Works ENCLOSURES: September 13, 1984) The Department of Public Works recommends that the City enter into a tri-party RAILROAD REIMBURSEMENT AGREEMENT between between the State of Florida Department of Transportation, FLorida East Coast Railway Company and the City of Miami for CONSTRUCTION AND MAINTENANCE OF THE RAILROAD GRADE CROSSING ON N. E. 71 STREET AT N. E. 4 AVENUE. The City of Miami entered into an agreement with the Florida East Coast Railway Company on February 10, 1958 that required the City to maintain the railroad grade crossing on N. E. 71 Street at N. E. 4 Avenue. This grade crossing needs to be rebuilt to present standards. As part of a State wide railroad crossing improvement program, the State of Florida Department of Transportation (FDOT) proposes to have the Florida East Coast Railway Company (FEC) construct at the State's expense, a new railroad grade crossing on N. E. 71 Street at N. E. 4 Avenue. The grade crossing will be constructed in accordance with FDOT standards. The FDOT has requested that the City enter into a tri-party Railroad Reimbursement Agreement with FDOT and FEC for the construction and maintenance of the new railroad grade crossing. The agreement specifies that the City will be responsible for the maintenance and future replacement costs of the highway roadbed, including the Standard Railroad Crossing Type "T" Modified consisting of concrete slabs adjacent to the rails with a rubber filler between the rails and slabs. The FEC will be responsible for maintenance and replacement costs of all track bed and rail components. the grade crossing traffic control devices will be maintained by Metropolitan Dade County and the FEC under a separate agreement. rma Page 1 of 2 Howard v.
