AN EMERGENCY ORDINANCE AMENDING SECTIONS 4 AND 6 OF
ORDINANCE NO. 9684 ADOPTED SEPTEMBER 29, 1983, THE ANNUAL
APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING
SEPTEMBER 30, 1984, BY APPROPRIATING FROM THE BUILDING AND
VEHICLE MAINTENANCE DEPARTMENT, HEAVY EQUIPMENT MAINTENANCE
DIVISION, FY-83 RETAINED EARNINGS, AN AMOUNT OF S43,000;
INCREASING REVENUES IN THE SAME AMOUNT TO BE APPROPRIATED
INTO THE PRINT SHOP DIVISION TO PROVIDE CONTINUED FUNDING
FOR THE LEASING OF THE XEROX 9400 COPIER; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
BE, IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Sections 4 and 6 of Ordinance No. 9684 adopted September 29,
1983, the Annual Appropriations Ordinance for the fiscal year ending September
30, 1984, is hereby amended in the following particulars: 1/
"Section 4. The following activities which are carried on
for the service and convenience of other funds shall be
operated by the City Manager within limits of the
appropriations provided in the foregoing departments,
boards, offices, and accounts of the City of Miami and other
revenues or receipts which may be: received:

' Section 6. The above appropriations are made based on the

Section 2. An amount of 348,000 from the Building and Vehicle Maintenance
Department, Heavy Equipment Maintenance Division, FY'83 Retained Earnings is
hereby appropriated into the Print Shop Division to provide continued funding
for the leasing of the Xerox 9400 Copier.
Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this ordinance are hereby
repealed.
Section 4. If any section, part of section, paragraph, clause, phrase, or
word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency measure on
the grounds of urgent public need for the preservation of peace, health, safety,
and property of the City of Miami, and upon the further grounds of the necessity
to make the required and necessary payments to its em,.loyees and officers,
payment or its contracts, payment of interest and principal on its debts,
necessary and required purchases of goods and supplies, and to generally carry
on the functions and duties of its municipal affairs.
Section 6. The requirement of reading this ordinance on two separate days
is hereby dispensed with by a vote of not less than. four -fifths of the members
of the Commission.

Appropriations Ordinance

It is recommended that the City Commission approve the
attached emergency ordinance by appropriating from the
Building and Vehicle Maintenance Department, Heavy Equipment
Maintenance Division, FY'83 Retained Earnings, an amount of
$48,000; increasing revenue in the same amount to be
appropriated into the Print Shop Division to provide
continued funding for the leasing of the Xerox 9400 Copier.
The City Commission approved the appropriation of funds to lease a Xerox 9400
Copier through Ordinance No. 9486 for FY'83. The Commissioners also authorized
in Resolution 83-46 the acceptance of the bid from the Xerox Corporation for a
three-year period. Total funding was added to the FY'83 Print Shop budget with
the understanding that available balances would be carried over to subsequent
fiscal years.
On November 1, 1983, the Department of Building and Vehicle Maintenance prepared
a memorandum to the Finance Department requesting the encumbrance of FY'83 Print
Shop funds. Apparently this item did not qualify under the revised guidelines
recommended by the City's external auditors for fund encumbrances as outlined by
the Finance Department. As a result, we are projecting total expenditures of
$48,000 in a line item with no funds. Furthermore, this amount may cause total
expenditures in the Print Shop's budget to exceed their appropriation by the end
of the fiscal year.
This proposed emergency ordinance is prepared for the September 20, 1984 City
Commission meeting.
