HomeMy WebLinkAboutO-09882J-84--799 a Amendment No. 40 to Ordinance No. 9534 ORDINANCE NO. 9 8 8 2 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 9534, ADOPTED DECEMBER 9, 1982, THE EXISTING CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, AS AMENDED, BY CONVERTING AUTHORIZED LOANS MADE FROM THE CAPITAL IMPROVEMENT FUND INTO TRANSFERS FROM SAME; BY TRANSFERRING AN AMOUNT OF $385,000 FROM TRUST AND AGENCY FUNDS TO THE CAPITAL IMPROVEMENT FUND; AND BY DECREASING RESOURCES AND PRIOR APPROPRIATIONS FOR THE DOWNTOWN COMPONENT OF METRORAIL (PEOPLE MOVER) TO THE AMOUNT OF $2,566,900 SATISFYING THE CITY'S FUNDING COMMITMENT FOR THE FIRST PHASE OF THE PROJECT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9534 on December 9, 1982, establishing resources and appropriations for the implementation of certain capital improvements in the City of Miami; and WHEREAS, Ordinance No's. 9104, 9199, 9306, 9319, 9372, and 9534 authorized loans of Capital Improvement Fund money to the Parking Capital Projects Fund; and WHEREAS, No. 9484 authorized a loan of $750,000 of idle Capital Improvement Fund money to the Miami Convention Center; and WHEREAS, Ordinance No is. 9431 and 9534 authorized $1,041,000 advance of Fiscal Year 1984 Florida Power & Light Revenues to the Miami Convention Center; and WHEREAS, the cash was transferred to these funds upon passage of the above mentioned ordinances; and WHEREAS, due to the financial status of these projects it is necessary at this time to convert these loans into transfers; and WHEREAS, in Fiscal Year 1975, the City became a Contractor to provide jobs under the Comprehensive Employment Training Act (CETA); and WHEREAS, the CETA program expired on September 30, 1983; and WHEREAS, over the past several years the City has participated in many and various grant programs; and WHEREAS, all audits have been completed and findings related thereto have been resolved and settled for these various grant programs; and WHEREAS, it now becomes necessary to close out theaccounts and funds related to these various grant programs in Trust and Agency Funds, and WHEREAS, there remains a fund balance in said accounts of approximately $385,000; and Page 1 of 6 _ _ _ Is 2 WHEREAS, it is appropriate to transfer these funds from the various Trust and Agency Funds to the Capital Improvement Fund; and WHEREAS, the City has met its commitment to fund the first phase of the Downtown Component of Metrorail (People Mover) in the amount of $2,566,900 as stated in Resolution No. 83-543; and WHEREAS, resources and prior appropriations may be decreased to reflect the amount of $2,566,900, satisfying the City's funding commitment for the first phase of the Downtown Component of Metrorail; and WHEREAS, this ordinance hereby converts herein mentioned loans into transfer; closes out the accounts and funds relating to various grant programs further transferring remaining fund balance amount of $385,000 from the various Trust and Agency Funds to the Capital Improvement Fund; and reduces resources and prior appropriations for the Downtown Component of Metrorail from the amount of $3,612,900 to $2,566,900 as the City's funding commitment for the first phase of the project; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance 9534, adopted December 9, 1982, as amended, is hereby further amended in the following particulars:1 "Section 1. The following appropriations hereby made by fund and project title include previously authorized projects and fund appropriations for implementation of all municipal capital improvements of the City of Miami, Florida. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 5. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety and property of the City of Miami and upon the further ground of the necessity to finalize the appropriations for the current fiscal year which ends September 30, 1984. FLORIDA INTER -OFFICE MEMORANDUM GATE: August 17, 1984 ""`� SUBJECT` Agenda Item REFERENCES: ENCLOSURES: It is recommended that the attached Ordinance amending the Capital Im- provement Ordinance by converting outstanding loans to transfers, re- ceiving funds from closed grants in trust agency funds and reducing appro- priation for the downtown component of Metrorail to the Phase I commitment, be passed. Over the past several years the City has borrowed money from the Capital Improvement fund to fund both the Convention Center and several parking garage studies. It was anticipated that loans would be repaid, however it is now apparent that the financial status of these projects necessitates the conversion of these loans to transfers. This ordinance accomplishes that but it should be noted that no cash is being transferred to these projects since that was done upon passage of the original loans. Secondly, there are many grants that have expired, been audited, and all claims settled in which there remains cash balances. This ordinance authorizes the closing of these accounts and the transfer of the cash to the Capital Improve- ment Fund. Thirdly, the amount appropriated for the City contribution for the Downtown component of Metrorail (People Mover) is reduced to the City's commitment for Phase I. This amount has already been paid.
