Section 5 and 6 of Ordinance No. 9684, adopted September 29, 1983, the Annual Appropriations Ordinance for the fiscal year ending September 3 3 30, 1984, as amended, is hereby further amended in the following particulars: 1/ "Section 5. The following appropriations are made in Trust and Agency Funds: l Trust and Agency Funds Appropriations Self Insurance $16;8993316 $16,499,316 TOTAL TRUST AND AGENCY FUNDS $38397GT185 $39,370,185 Section 6. The above appropriations are made based on the following sources of revenue for the 1983-84 fiscal year: Trust and Agency Funds Appropriations —i Self Insurance $167099,316 $16,499,316 TOTAL TRUST AND AGENCY FUNDS $38T978;1:85 $39,370,18511 i Section 2. The herein appropriation of $400,000 to the Self Insurance i Trust Fund from FY'83 Self Insurance Fund Balance is for the purpose of paying additional liability claims resulting from recent unfavorable court rulings against the City of Miami. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All figures are rounded to the next dollar. ?0 W Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers,payment or its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. FLORIDA INTER -OFFICE MEMORANDUM DATE` August 21, 1984 FILE: SUBJECT: Agenda Item REFERENCES: ENCLOSURES: It is recommended that the City Commission approve the attached emergency ordinance increasing the revenues and appropriation in the Self Insurance Trust Fund in the amount of $400,000 from FY'83 Self -Insurance Fund Balance. This increase is to pay for additional liability claims resulting from recent unfavorable court rulings against the City of Miami. The impact of large claims settled or paid this year on the current Self -Insurance budget is severe. The Self -Insurance budget has already paid over $1.3 million dollars on large liability claims since the beqinninq of the fiscal year. These payments were not anticipated when the current FY'84 budget was developed. The department has compensated for this problem by transferring available funds from other line items within their budget to the liability loss line items. However, the impact of additional large liability losses which must be paid by the conclusion of this budget year and the continuing expense in this area requires the transfer of $400,000 from the FY'83 Self Insurance Fund Balance to the current year budget.
