HomeMy WebLinkAboutO-09878-+ ,_tAndment No. 41 to Ordinance No. 9534 ORDINANCE NO. 9878 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 9534 ADOPTED DECEMBER 9, 1982, THE EXISTING CAPITAL IMPROVEMENTS APPROPRIATION ORDINANCE, AS AMENDED BY INCREASING THE APPROPRIATIONS I14 THE CAPITAL IMPROVEMENT FUND IN THE AMOUNT OF $172,552, FROM FY'84 FUND BALANCE AND ESTABLISHING A NEW PROJECT IN THE CAPITAL IMPROVEMENT FUND ENTITLED "LOAN FOR SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT" ITEM IX.0 (ii) 12, FOR A LIKE AMOUNT, TO BE REPAID AT A FUTURE DATE FROM THE PROCEEDS OF TAX INCREMENT REVENUE BONDS OR OTHER FINANCIAL SOURCES: CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9534 on December 9, 1982 establishing resources and appropriations for the implementation of Capital Improvements in the City of Miami, Florida; and WHEREAS, on July 29, 1982, the City Commission of the City of Hiami passed Resolution No. 82-755 approving the Southeast Overtown/Park West Community Redevelopment Plan; and WHEREAS, on December 7, 1982 the Metropolitan Dade County Board of County Commissioners passed Resolution No. 82-1677 approving the Southeast Overtown/Park West Community Re -development Plan, and WHEREAS, on December 21, 1982, the Metropolitan Dade County Board of County Commissioners passed Ordinance No. 82-1115 approving the tax increment financing plan for the Southeast Overtown/Park West Community Re -development Trust Fund through which tax increment monies will be channelled for re -development activities; and WHEREAS, the City Commission on September 29, 1983 approved ordinance No. 9684, the Annual Appropriations Ordinance for FY'84 which appropriated in a Special Revenue Fund $612,347 for Southeast Overtown Park West administrative activities; and WHEREAS, said appropriation was based on the following sources of revenue for FY'84: Community Development Block Grant 9th Year $225,000 Loan from the Capital Improvement Fund 172,552 UMTA Grant 2nd Year 214,795 Total WHEREAS, the loan from the Capital Improvement Fund and the Community Development Block Grant monies are anticipated to be repaid at a future date from the proceeds of tax increment revenue bonds or other financial sources; 14014, therefore, be it ordained by the commission of the C+ty of Miami, Florida: Section 1. The following appropriations hereby made by fund and project title include previously authorized projects and Fund appropriations for implementation of all municipal Capital Improvements of the City of Miami, Florida. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, $afety, and property of the City of Miami, and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Surana, Director FROM: Department of Management & Budget DATE: August 14, 1984 FILEs DMB2 SUBJECT: Amendment to Ordinance No. 9534 REFERENCES: ENCLOSURES: It is recommended that the attached emergency ordinance amending the existing Capital Improvement Appropriation Ordinance No. 9534 be approved, increasing the appropriation in the Capital Improvement Fund in the amount of $172,552 from FY184 Fund Balance and establishing a new project in the Capital Improvement Fund entitled "Loan for Southeast Overtown/Park West Re -Development" for a like amount. Said loan will be repaid at a future date from the proceeds of tax increment revenue bonds or other financial sources. The City Commission on July 29, 1982 passed resolution No. 82-755 approving in principal the Southeast Overtown/Park West Community Re -development Plan. The Metropolitan Dade County Board of County Commissioners passed Resolution No. 82-1677 on December 7, 1982 also approving the Southeast Overtown/Park West Re -development Plan. The County Commissioners also approved Ordinance No. 82-1115 on December 21, 1982 establishing a Re -development Trust Fund through which tax increment monies will be channeled for re -development activities. Given the temporary absence of tax increment revenues for FY'84 the project has received administrative funding through ordinance No. 9684, the FY'84 Annual Appropriations Ordinance whereby $612,347 was appropriated in a Special Revenue Fund for the Southeast Overtown/Park West administrative activities. This funding is as follows: Community Development Block Grant 9th Year $225,000 Loan from the Capital Improvement Fund 172,552 UMTA Grant 2nd Year 214,795 $G The funding received from Community Development Block Grant 9th Year and the loan from the Capital Improvement Fund represent loans to the project to be repaid at a future date from tax increment revenue bonds or other financial sources.
