Background
On December 15, 1983, at second reading of an Ordinance rezoning
part of they Pantry Pride site at 1-95 and SW 15th Road from RS-
2/2 One ami ly Detached Residential and RG 2/5 General
Residential to CR-2/7 Commercial, Residential Co mmu n i t y ) , the
applicant, Guillermo Socarras, proffered by covenant to
under -write a traffic study, in an amount not to exceed $30,000,
for the area bounded by 1-95, SW 15th Road and Metrorail right-
of-way. This; traffic study was to be a vital component of a
Planning Departiic-nt evaluation of a possible change of zcning of
the surrounding UnC ar(?a from RS-212 Otte Family Detacled Picsidential
and R G -- 2,"' 5 Genera? Residential a r e i, t c) 2 liberal
class if icc.tion, as reque--ted by the neighbors.
Per the dated December 16, 1984, "hr:Pi)licalnt was to
underwrit- -raj,f,ic f�tji(iy to bc- cojnpletLcc by February 15, 1984.
David Pluaiiatfr ar.d Associates, traffic consultants, proceeded to
contract- 11 Ct g O'C' i a t i 0 n s with the applicant and, upon verbal
assurances, commenced work on the traffic study.

Planning Department had concluded that without this input, the

Alternative,�
The neighbors have requested more liberal RO-2/5 to RO-3/7
Residential Office Districts. At this point Planning
Department is only prepared to recommend a change of zoning to
RG-2/5 General Residential for lack of a traffic study.
Four alternativQs are available to enable the completion of the
traffic study:

recovery from Mr. Socarras through legal action
to enforce the covenant.
The Planninp Department recommends t%ii.: last; alternative, but

attached.
It is requested that this item be brought up for discussion at
this September 20, 1984, City Commission meeting.

ning Department. The conclusion of the study may be extended beyond
this time if agreed upon by the City Manager, Planning Department and
the Property Owners,
2. A "tot lot" shall be provided in a park selected by the City
of Miami. The total cost thereof shall not exceed. $30,000.O0 . This
