APPROPRIATIONS ORDINANCE, AS AMENDED, BY
INCREASING APPROPRIATIONS FOR EAST LITTLE
HAVANA STREET IMPROVEMENTS -PHASE I BY A TOTAL
AMOUNT OF $11069,000 AND INCREASING RESOURCES
IN THE 1960 HIGHWAY GENERAL OBLIGATION BOND
FUND IN THE AMOUNT OF �516-;000 AND THE 1970

SAID RESOURCES TO ESTABLISH WESTERN DRAINAGE
PROJECT AS A NEW PROJECT IN SAID FUND, AND
INCREASING APPROPRIATIONS FOR FLAGLER STORM
SEWER MODIFICATIONS BY THE AMOUNT OF $326,000
FROM ANTICIPATED BOND SALES IN SAID FUND;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9534 on
December 9, 1982, establishing resources and appropriations for the
implementation of certain Capital Improvements in the City of
Miami; and
WHEREAS, the City Commission adopted Ordinance No. 9756 on
November 18, 1983, appropriating $1,300,000 for S. W. 16 STREET
IMPROVEMENTS; and
WHEREAS, bids were received on June 14, 1964 for construction
of S. W. 16 STREET IMPROVEMENTS; and
WHEREAS, a resolution accepting the low bid submitted for
construction of S. W. 16 STREET IMPROVEMENTS was adopted by the
City Commission on July 30, 1984; and
WHEREAS, increased appropriations in the amount of $1351000
should be made for the project prior to execution of the contract
for S. W. 16 STREET IMPROVEMENTS; AND
a
WHEREAS, the amount of $94,000 is available from the 1980
Highway General Obligation Bond Fund and the amount of $41,000 is
available from the 1970 and 1978 Storm Sewer General Obligation
Bond Fund to increase appropriations for construction of S. W. 16
STREET IMPROVEMENTS by the total amount of $135,000 in the Capital
Improvement Fund, and
WHEREAS, the total appropriations for S. W. 16 STREET
IMPROVEMENTS is $1,435,000; and
WHEREAS, the City Commission adopted Ordinance No. 9756 on
November 18, 1983, appropriating $1,800,000 for EAST LITTLE HAVANA
STREET IMPROVEMENTS -PHASE 1; and
WHEREAS, the extent of the street and storm sewer improvements
were increased during design and after the funds were appropriated;
and
WHEREAS, the costs for construction of street and storm sewer
improvements have increased; and
WHEREAS, bids were received on June 14, 1984 and July 30, 1984
for construction of EAST LITTLE HAVANA STREET IMPROVEMENTS -PHASE
1; AND
WHEREAS, resolutions accepting the low bids submitted for
construction of EAST LITTLE HAVANA STREET IMPROVEMENTS -PHASE I were
adopted by the City Commission on July 31, 1984; and
WHEREAS, increased appropriations in the amount of $1,069,000
should be made for the project prior to execution of the contracts
for EAST LITTLE HAVANA STREET IMPROVEMENTS -PHASE I; and
WHEREAS, the amount of $5369000 is available from the 1980
Highway General Obligation Bond Fund and the amount of $533,000 is
available from the 1970 and 1978 Storm Sewer General Obligation
Bond Fund to increase appropriations for construction of EAST
LITTLE HAVANA STREET IMPROVEMENTS -PHASE I by the total amount of
$19069,000 in the Capital Improvement Fund; and
WHEREAS, the total appropriations for EAST LITTLE HAVANA
STREET IMPROVEMENTS -PHASE I is $2,869,000; and
WHEREAS, numerous drainage problems exist in the western
region of the City; and
WHEREAS, the City Commission has adopted Motion 83-729 which
recognizes the need for more drainage improvements west of West 42
Avenue; and
WHEREAS, WESTERN DRAINAGE PROJECT, a new project, was
established to alleviate some of the severe drainage problems in
said area; and
WHEREAS, bids have been accepted for the construction of
WESTERN DRAINAGE PROJECT; and
WHEREAS, an amount of $2,105,000 should be made available
from the anticipated sale of 1984 Storm Sewer General Obligation
Bond Funds to appropriate monies for the total project cost of
WESTERN DRAINAGE PROJECT; and
WHEREAS, Metropolitan Dade County will start construction of
the rebuilding of West Flagler Street between W. 42 Avenue and
W. 72 Avenue in 1984; and
WHEREAS, it will be necessary for the City to construct storm
sewer crossings of West Flagler Street in order to connect areas
south of West Flagler street to future positive drainage facilities
into the Tamiami Canal; and
WHEREAS, these storm sewer crossings should be constructed now
to minimize the disruption of business activities and traffic along
West Flagler Street; and
WHEREAS, a preliminary estimate in an amount of $200,000 was
made and funding appropriated by Ordinance No. 9794 adopted by the
City Commission on February 9, 1984, on the basis of ten (10)
crossings of West Flagler Street; and
WHEREAS, a more detailed study of future storm drainage
requirements concluded that seventeen (17) crossings along West

Flagler Street would be needed at a total project cost of $526,000;
and
WHEREAS, it is now necessary to increase prior appropriations
by an amount of $326,000 so that contracts may be awarded; and

WHEREAS, an amount of $j26,000 should be made available from
the anticipated sale of 1984 Storm Sewer General Obligation Bond
Funds to increase appropriations from $200,000 to $52b,000 for
FLAGLER STORM SEWER MODIFICATIONS;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 9534, adopted
December 9, 1982, as amended, is hereby amended in the following
particulars:1
"Section 1. The following appropriations hereby made by fund
and project title include previously authorized projects and fund
appropriations for implementation of all municipal capital
improvements of the City of Miami, Florida. The sources of
revenues to support the herein appropriations are hereby identified

Section 2. Ail ordinances or parts of ordinances in conflict
herewith, insofar as they are in conflict, are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid, the
remaining provision of this ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City of
Miami, and upon the further ground of the necessity to appropriate
sufficient funds for FLAGLER STORM SEWER MODIFICATIONS, S.W. 16
STREET IMPROVEMENTS, EAST LITTLE HAVANA STREET IMPROVEMENTS -PHASE I
AND WESTERN DRAINAGE PROJECT.
Section 5. The requirement of reading this Ordinance on two
separate days is hereby dispensed with by an affirmative vote of
not less than four -fifths of the members of the Commission.

recommends adoption of an emergency
ordinance amending CAPITAL IMPROVEMENT
APPROPRIATION ORDINANCE NO. 9534, as
amended, by increasing appropriations
for EAST LITTLE HAVANA STREET
IMPROVEMENTS -PHASE I, S. W. 16 STREET
IMPROVEMENTS AND FLAGLER STORM SEWER
MODIFICATIONS and establishing a new
project, WESTERN DRAINAGE PROJECT and
appropriating funds for same.
Capital Improvement Appropriation Ordinance NO. 9534, as amended,
established the resources and appropriations for the implementation of
capital improvements in the City of Miami. Included in this ordinance
were appropriations of $1,dOO,000 for East Little Havana Street
Improvements -Phase I, $1,300,000 for S. W. 16 Street Improvements and
$200,000 for Flagler Storm Sewer Modifications. These projects
require increased appropriations. In addition, a new project, Western
Drainage Project, has been established for which there is no
appropriation in Ordinance 9534, as amended. This project will
require a new appropriation.
Bids were received on June 14, 1984 and July 30, 1984 for construction
of East Little Havana Street Improvements -Phase I. Resolutions were
adopted by the City Commission on July 31, 1984 accepting the low
bids. Based on the low bids, the total cost of this improvement will
be $2,869,000 and $1,800,000 has been appropriated. An additional
$1,069,000 should be appropriated prior to the execution of contracts
for East Little Havana Street Improvement -Phase I. The amendment to
the appropriations ordinance is required because the extent of the
street and storm sewer improvements were increased during the design
of the project after funds were appropriated. A portion of this
project is at a low elevation requiring the raising of street grades
and extensive storm sewer improvements. Also, the competition between
contractors for street and storm sewer contacts is not as competitive
as it was and bid prices are increasing.

Bids were received for the construction of S. W. 16 Street
Improvements on June 14, 1984. A resolution accepting the low bid
submitted for construction of this improvement was adopted by the City
Commission on July 30, 1984. Based on the low bid, the total cost of
this improvement will be $1,4359000 and $19300,000 has been
appropriated. An additional $135,000 should be appropriated prior to
the execution of contracts for S. W. 16 Street Improvements.
Bids were received for Flagler Storm Sewer Modifications on June 19,
1984, and a resolution adopted by the City Commission on July 30,
1984 accepting the low bid. Based on the low bid, the total project
cost will be $526,000 and $200,000 has been appropriated. An
additional $326,000 should be appropriated from anticipated bond sales
prior to the execution of the contract for Flagler Storm Sewer
Modifications. The amendment to the appropriations ordinance is
necessitated by an increase in the number of storm sewer crossings of
W. Flagler Street. These crossings wll be constructed in conjunction
with Metropolitan Dade County's rebuilding of W. Flagler Street
between W. 42 and 72 Avenues. A preliminary estimate was made based
on a need for ten storm sewer crossings. A more detailed study after
funds were appropriated showed that seventeen storm sewer crossings
would be needed to meet future storm sewer requirements.
Bids were received for Western Drainage Project on July 24, 1984, and
a resolution adopted by the City Commission on July 31, 1984 accepting
the low bid. Based on the low bid, the total project cost will be
$2,105,000 and funds have not been appropriated for this project. A
new project should be established in the appropriation ordinance and
funds should be appropriated from anticipated bond sales prior to the
execution of the contract for Flagler Storm Sewer Modifications.
Originally considered as a local drainage project, this project was
expanded in scope to address the numerous drainage problems that
exist in the western region of the City. Motion 63-729 adopted by the
City Commission recognizes the need for more drainage improvements in
the City west of West 42 Avenue. Funds established in the
appropriation ordinance under local drainage projects have been
encumbered by other projects and therefore a new project should be
established.
