AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 9534, ADOPTED DECEMBER 9, 1982, THE EXISTING CAPITAL IMPROVEMENTS APPROPRIA- TIONS ORDINANCE, AS AMENDED BY INCREASING APPROPRIATIONS FOR FORT DALLAS PARK DEVELOPMENT IN THE AMOUNT OF $227,900 FROM A CONTRIBUTION FROM THE FLORIDA RECREATION DEVELOPMENT ASSIST- ANCE PROGRAM AND $163,200 FROM A CONTRIBUTION FROM DALLAS PARC ASSOCIATES, LTD.; CONTAINING A REPEALER PROVISION AND A SEVER - ABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9534 on December 9, 1982, establishing resources and appropriations for the implementation of capital improvements in the City of Miami; and WHEREAS, the City Commission, by Resolution No. 82-752 of July 29, 1982, granted a modification of the requirements as set forth in Section 3 (4) (b) of the City of Miami Charter, Chapter 10847, Special Acts, Laws of Florida, 1925, as amended, to permit an addition to the Dallas Parc Hotel, conditioned upon the appli- cant, Dallas Parc Associates, Ltd., tendering the proffered $150,000 cash contribution toward construction of Ft. Dallas Park; and WHEREAS, the City of Miami received from Dallas Parc Asso- ciation, Ltd., on August 10, 1983, two checks in the total amount of $163,200, representing the contribution principal and interest; and WHEREAS, the City of Miami has been awarded a $227,900 grant from the Florida Recreation Development Assistance Program for the Ft. Dallas Park Development Project, contingent upon the use of the proffering as the required 1/3 match; and WHEREAS, said grant was formally accepted by Resolution No. 84-420 of April 5, 1984; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY or MIAMI, FLORIDA: _ ?I* t Section 1. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 5. This ordinance is hereby declared to be an emer- gency measure on the grounds of urgent public need for the preser- vation of peace, health, safety and property of the City of Miami and upon the further ground of the necessity to provide the neces- sary funds for the completion of the Ft. Dallas Park. The City received the contribution, plus interest, in the form of two checks on August 10, 1982. The City was subsequently awarded a $227,900 grant, which was _ formally accepted by Resolution No. 84-420 on April 5, 1984, from the Florida Recreation Development Assistance Program. The grant award was contingent upon the use of the monies prof- fered by Dallas Parc Associates, Ltd. as the required 1/3 match. The Parks and Recreation Department recommends that the attached emergency ordinance be adopted, appropriating these funds. The adoption of this ordinance will allow the City to award the construction contract and commence the Ft. Dallas Park Develop- ment Project in a timely manner. /ar cc.
