AN ORDINANCE AMENDING SECTION 38-8 OF
CHAPTER 38, ENTITLED "PARKS AND OTHER
CITY PROPERTY GENERALLY", OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY CHANGING THE NAME OF THE
LITTLE HAVANA COMMUNITY CENTER TO THE
MANUEL ARTIME COMMUNITY CENTER, AND BY
PROVIDING THAT NOTHING CONTAINED IN
THE PROVISIONS OF THIS SECTION SHALL
LIMIT OR RESTRICT THE RIGHT OF THE
CITY COMMISSION TO ESTABLISH AND FIX
SPECIAL CHARGES OR SPECIAL TERMS AND
CONDITIONS FOR THE USE OF THE MANUEL
ARTIME COMMUNITY CENTER OF LITTLE
HAVANA.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORDA:
Section 1. Section 38-8 of Chapter 38, entitled: "PARKS AND OTHER
CITY PROPERTY GENERALLY", of the Code of the City of Miami, Florida, as amended,
is hereby amended in the following particulars:I
"Sec. 38-8. Use of L4tt;e-Havana-6eaaae*iy-Genter Manuel Artime
Community Center.
(A) Rates. Rates for the use of the following areas at the city facility
known as the 6 40e Havana Gawwn *ty Geeter Manuel Artime Community Center are
hereby established, which rates include normal janitorial service, air conditioning,
normal houselights, and such other items that are available at the facility for use,
but do not include event personnel or support services such as policemen, firemen,
ushering staff, ticket sellers and ticket takers, stagehands, spotlight operators,
musicians, projectionists, booth equipment and installing and dismantling electrical
installations. For those events where admission is charged, the fee shall be ten
(10) percent of ticket sales, after taxes, or the hereinbelow-specified use fee,
whichever is greater. The use rates established are as follows; however, nothing
contained in the provisions of this section shall limit or restrict the right of the,
City Commission to establish and fix special charges or special terms and conditions
for the use of the Manuel Artime Comnuni�y Center of Little Havana:

Except for the Building A large auditorium and the new building small auditorium
(second level), use of all areas at this city facility is gratuitous for tenants
of the htttle Havana Gewawn*ty Genter Manuel Artime Community. Center who have
executed current lease agreements, subject to securing insurance as required in
subsection (b) of this section, if nontenants are invited upon the premises of the
facility or if the presence of nontenants is reasonably anticipated.
(B) Insurance. The insurance requirement referred to in subsection (a)
of this section is more specifically set forth as follows: User shall provide to
the city public liability insurance in the amount of not less than three hundred
thousand dollars ($300,000.00) per occurrence for bodily injury and fifty thousand
dollars ($50,000.00) per occurrence for property damage; (and) this will be at the
cost and expense of the user. Said policy shall be written by companies authorized
to do business in the State of Florida and must carry a rating of not less than A
as to management and grade X as to financial strength, all in accordance with
Best's Key Rating Guide. All policies written must name the city as an additional
The city may be able to obtain special -event insurance for those events that meet
certain prerequisites. The city, at its sole option, may determine that the event
qualifies for said special -events insurance. If so qualified, the user may comply
with the insurance requirement by obtaining said insurance through the city at the
user's expense.
(C) Reservation Deposit; Payment of Fee.
(1) Persons or organizations wishing to use the above -designated areas at the
6$W a Havana Gewwn4 ty Genter Manuel Artime Community Center shall be
required to make a payment in the amount of twenty-five dollars ($25.00), as
a nonrefundable cash deposit, fifteen (15) days from the date of notification
by the city that the requested date(s) have been reserved. User must pay the
city not less than fifty (50) percent of the total use fee no less than five
(5) days prior to the reserved date(s), as well as provide insurance certifi-
cates as set forth in subsection (b) of this section and copyright licenses,
if applicable, at this time. User must pay the city any remaining unpaid
portion of the total use fee no less than twenty-four (24) hours prior to the
reservation date(s).
(2) For those events where admission is charged, the user shall keep available
in its office, or such other place approved by the city manager of the city,
true, accurate and complete records and accounts of all ticket sales trans-
acted in connection with the event and shall give access to the authorized
representatives of the city, during reasonable business hours, to examine
and audit such records and accounts. Final accounting and payment of all
sums due hereunder shall be made to the proper city authorities as soon after
the holding of each event as may be reasonably possible, and (sums due here-
under) in no case shall be permitted to remain unpaid longer than three (3)
working days after the event, and in all cases shall be paid prior to the
holding of another subsequent event by the same use.
(D) Compliance with Applicable Requirements. * * * * * * * * * * * * * u
Section 2. All ordinances or parts of ordinances in conflict herewith,
insofar as they are in conflict, are hereby repealed.
Section 3. If any section, part of section, paragraph, clause, phrase,
or word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.

ENCLOSURES:
It is recommended that the City Commission approve
in principle the negotiation of an extended use
agreement with Eduardo and Gustavo Rozas for the
use of the Manuel Artime Community Center audi-
torium to stage ongoing theatre productions to
begin around September, 1984. It is further
recommended that the City Commission approve on
first reading an ordinance amending Section 38-8
of the City Code to reflect the name change of the
Little Havana Community Center to Manuel Artime
Community Center and authorizing the City
Commission to establish special charges for the
use of the facility per the attached resolution
and ordinance.
The Department of Community Development has received a request for the use of the
Manuel Artime Community Center Auditorium on an extended basis. The potential
users intend to stage commercial theatrical productions that would feature well-
known Hispanic television entertainers. The promoters of this venture have
received a c amnitment from Channel 23 to promote these theatre productions. They
may also be producing taped television shows from some of these with the intention
of selling them to Spanish International Network (S.I.N.), in which case we would
require a percentage of their profit.
Presently, the Manuel Artime Community Center Auditorium is under-utilized due to
the inadequacy of the facility for cultural events. Local performing arts groups
have to spend at least $600 per performance to use the auditorium just to bring in
a minimum sound and light system, as the Center does not have any theatre equipment.
Consequently, these groups have sought out and found more adequate facilities,
which is evidenced by the limited number of cultural events held at the Community
Center.
The Center's auditorium is presently used on an average of ten days per month,
mostly for religious, civic, and educational programs. The Department currently
coordinates a weekly film series and a monthly concert/dance for the neighborhood.
Both of these events are free to the public.

Section 38-8 of the City Code authorizes the City to collect a use fee for the
facility ($100 minimum for first four hours; $50 each additional hour or 10% of
ticket sales, whichever is greater). The City collects an average of $700/month
in use fees. During the course of a year, the City Commission grants an average
of ten fee waivers for the use of the Center's auditorium, mostly to civic organi-
zations.
Average attendance at the limited cultural events held at the Center are three to
four hundred people. Attendance at the religious events averages three hundred
people; civic and educational programs have an attendance from two to six hundred
people.
In view of the potential revenue as well as the cultural activity that could be
generated from the proposed theatre productions, we are requesting authorization
from the City Commission to discuss conditions of use with the promoters of this
event, with the possibility of arriving at a one-year use agreement that would be
in the City's and community's best interest. In addition to revenue, the promoters
have indicated their willingness to provide a number of free tickets to area resi-
dents, in order that the current level of free activity available at the Center
will be maintained if not increased. Additionally, we intend to reserve at least
two days per week for other community uses. It is anticipated that the current
level of events could be accommodated during these two days per week.
This venture will create jobs for the Hispanic artistic community since local
performers, technicians, directors, etc., will be involved along with the inter-
national talent.
If the City Commission approves the idea of granting an extended use permit for
the aforestated use, we will negotiate an agreement to be presented to the City
Commission for approval on July 30, 1984.
It is also recommended that Section 38-8 of the City Code be amended to allow the
City the flexibility to negotiate a higher use fee under certain circumstances,
as well as provide for the name change of the Little Havana.Community Center to
the Manuel Artime Community Center approved by Resolution 82-1087 dated November 4,
1982, per the attached Ordinance.

It is recommended that the City Commission approve
in principle the negotiation of an extended use
agreement with Eduardo and Gustavo Rozas for the
use of the Manuel Artime Community Center audi-
torium to stage ongoing theatre productions to
begin around September, 1984. It is further
recommended that the City Commission approve on
first reading an ordinance amending Section 38-8
of the City Code to reflect the name change of the
Little Havana Community Center to Manuel Artime
Community Center and authorizing the City
Commission to establish special charges for the
use of the facility per the attached resolution
and ordinance.
The Department of Community Development has received a request for the use of the
Manuel Artime Community Center Auditorium on an extended basis. The potential
users intend to stage commercial theatrical productions that would feature well-
known Hispanic television entertainers. The promoters of this venture have
received a commitment from Channel 23 to promote these theatre productions. They
may also be producing taped television shows from some of these with the intention
of selling them to Spanish International Network (S.I.N.), in which case we would
require a percentage of their profit.
Presently, the Manuel Artime Community Center Auditorium is under-utilized due to
the inadequacy of the facility for cultural events. Local performing arts groups
have to spend at least $600 per performance to use the auditorium just to bring in
a minimum sound and light system, as the Center does not have any theatre equipment.
Consequently, these groups have sought out and found more adequate facilities,
which is evidenced by the limited number of cultural events held at the Community
Center.
The Center's auditorium is presently used on an average of ten days per month,
mostly for religious, civic, and educational programs. The Department currently
coordinates a weekly film series and a monthly concert/dance for the neighborhood.
Both of these events are free to the public.

Section 38-8 of the City Code authorizes the City to collect a use fee for the
facility ($100 minimum for first four hours; $50 each additional hour or 10% of
ticket sales, whichever is greater). The City collects an average of $700/month
in use fees. During the course of a year, the City Commission grants an average
of ten fee waivers for the use of the Center's auditorium, mostly to civic organi-
zations.
Average attendance at the limited cultural events held at the Center are three to
four hundred people. Attendance at the religious events averages three hundred
people; civic and educational programs have an attendance from two to six hundred
people.
In view of the potential revenue as well as the cultural activity that could be
generated from the proposed theatre productions, we are requesting authorization
from the City Commission to discuss conditions of use with the promoters of this
event, with the possibility of arriving at a one-year use agreement that would be
in the City's and community's best interest. In addition to revenue, the promoters
have indicated their willingness to provide a number of free tickets to area resi-
dents, in order that the current level of free activity available at the Center
will be maintained if not increased. Additionally, we intend to reserve at least
two days per week for other community uses. It is anticipated that the current
level of events could be accommodated during these two days per week.
This venture will create jobs for the Hispanic artistic community since local
performers, technicians, directors, etc., will be involved along with the inter-
national talent.
If the City Commission approves the idea of granting an extended use permit for
the aforestated use, we will negotiate an agreement to be presented to the City
Commission for approval on July 30, 1984.
It is also recommended that Section 38-8 of the City Code be amended to allow the
City the flexibility to negotiate a higher use fee under certain circumstances,
as well as provide for the name change of the little Havana.Community Center to
the Manuel Artime Community Center approved by Resolution 82-1087 dated November 4,
1982, per the attached Ordinance.
