HomeMy WebLinkAboutO-09921AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI# FLORIDA, BY CHANGING THE ZONING CLASSIFICATION OF THE AREA GENERALLY BOUNDED BY AND INCLUDING PROPERTIES FRONTING ON AND IMMEDIATELY ADJACENT TO THE NORTH SIDE OF SOUTHWEST 7TH STREET FROM APPROXIMATELY 250' WEST OF THE WEST LINE OF SOUTHWEST 12TH AVENUE TO APPROXIMATELY 150' EAST OF THE EAST LINE OF SOUTHWEST 17TH AVENUE (MORE PARTICULARLY DESCRIBED HEREIN) PER PLAN ON FILE IN THE DEPARTMENT OF PLANNING AND ZONING BOARDS ADMINISTRATION, FROM RG-2/5 GENERAL RESIDENTIAL TO SPI-14.1: COMMERCIAL - RESIDENTIAL; MAKING FINDINGS; AND BY MAKING ALL. THE NECESSARY CHANGES ON PAGE NO. 35 OF SAID ZONING ATLAS MADE A PART OF ORDINANCE NO. 9500 BY REFERENCE AND DESCRIPTION IN ARTICLE 3, SECTION 300 THEREOF; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Planning Advisory Board, at its meeting of July 24, 1984, Item No. 4, following an advertised hearing, adopted Resolution No. PAB 87-84, by a 5 to 1 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set r. forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant. this change of zoning classification as hereinafter set forth; y NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CI•.TY OF MIAMI,°FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the xonl.ng.ordinance of the City of Miami, Florida, is hereby amended a by changing the zoning classification of the area generally 1 bounded by and including properties fronting on and immediately adjacent to the north side of Southwest 7th Street from approxi- mately 250 feet west of the west line of Southwest 12th:Avenue:.to approximately 150 feet east of the east line of -Southwest 17th Avennei _Miami, Florida# more particularly described as; Lota; 11-20j, Block 100; Lots 11-20, Block 1011 Lots 11-20, block 102; and Lota 19-21, Block 1.07, inclusive of LAWRONCS EST LAND C�. 2-46 i 1 Lots 1.1-1.5 , Block 991 of LAWRENCB BST LAND CQ BU4 Block - ,: got 09 # 10G (2-52) i and Lots 1-3 p block 2 of OACSOhA PARK (4-18) , of the public Recorda cif,bade Countyi Florida# per plans.on file i:n-',:the nepart%ont of Planning and Zoning boards Administration, ` from Ito-2/5 General Residential to SFi-14.is Commercial - Residential. Section 2, It is hereby found that this zoning classier fixation change: (') Ie in conformity with the adopted Miami Comprehensive .Neighborhood plant (b) Is not contrary to the established land use pattern; (c) Will not create an isolated district unrelated to adjacent and nearby districts; (d) r Is :f of out of scale with the needs of the neighborhood or the City; (e) Would not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc., (:f,Y---Wi11 not adversely influence living conditions in the `YF Y neighborhood; (g) Will not create or excessively increase traffic congestion or otherwise affect public safety; (h) Will not adversely affect property values in the adjacent area; , (i) Will not be a deterrent to the improvement or develop- ment of adjacent property in accordance with existing regulations; (j) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of, the public welfare; -' Section 3. Page No. 35 of the Zoning Atlas, made A part of Ordinance No. 9500 by reference and description in Article 3,- Section 300 of said Ordinance, is hereby amended to reflect the er.: changes made necessary by these amendments.
