HomeMy WebLinkAboutO-099139 • J-83-835 11/2/83 ORDINANCE NO.� 99 1•3 AN'ORDINANCE AMENDING CHAPTER 2, ARTICLE IVr DIVISION 2 OF THE CODE OF THE CITY OF KIAMIr FLORIDApAS AMENDEDoBY ADDING A NEW SECTION 2-90 ENTITLED "PHASED DESIGN AND CONSTRUCTION (FAST TRACK)"r WHICH AUTHORIZES THE FIREr RESCUE AND INSPECTION SERVICES DEPARTMENT TO ISSUE PERMITS FOR CONSTRUCTION OF BUILDING PROJECTS PURSUANT TO A PHASED PROCEDURE IN ACCORDANCE WITH PROCEDURES AND GUIDELINES ESTABLISHED BY AND MAINTAINED IN THE FIRE, RESCUE AND INSPECTIONS SERVICES DEPARTMENT; REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT, AND CONTAINING A SEVERABILITY CLAUSE. { WHEREAS, Owners and Developers of real property located in the City of Miami have expressed an urgent need to commence construction of building projects prior to City approval of complete architectural/engineering plans; and WHEREAS, the Phased Design and Construction procedure ("Fast Track") is a recognized method of construction pursuant to which portions of plans can be received by the City's Department of Firer Rescue & Inspection Services, Building i Zoning Division and partial permits issued on.approved portions of construction; and WHEREAS, a committee comprised of developers, architects, engineers, contractors and City representatives have formulated procedures and guidelines as sbt forth herein; and WHEREAS, the City Commission finds it essential to provide this much needed service and needed controls for construction of building projects in a phased design and construction or Fast Track basis; - NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMIr FLORIDA: Section 1. The Code of the City of Miami, Florida, as a -ended, is hereby further amended to include a new section . entitled "Phased Design and Construction (Fast Track)": 0.- V, C, "Section 2-90. Phased Design and Construction (Fast Track) (a) Procedures and Guidelines Procedures and guidelines for requests by owner/developer or owner shall be in accordance with those maintained as required by the Fire, Rescue and Inspection Services Department, Building and Zoning Division, and attached hereto. (b) Application and Agreements Application for approval and required agreement of design and construc- tion procedure shall be as outlined in the aforementioned procedure and guide- lines. (c) Fees Fees shall be as paid in accordance with Fee Schedule as provided in Ordinance No. 6145 as amended, Section 5d.(24)." Section 2. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid the remaining provisions of this ordinance shall be affected. I A&Wli.cation by Developer A letter of intent, together with an application (see sample Form No.l) is to be sent to Fire, Rescue & Inspection Services Dept. Detailed reasons for re- questing to proceed under this method should be included in the application which should be submitted as soon as possible during the development stages of design. indicate date preferred for a Preliminary Review Meeting but no sooner than two (2) weeks after receipt of the application by the City. A fee will be assessed in accordance with the Department's Fee Schedule ordinance No. 6145 As A ended and will be required prior to Prelit*unar),- Meeting. The applicant will be notified within three (3) working days after receipt of application, date set for preliminary Meting and fee required. The City of Miami retains the right to deny an application due to iridequam- of information submitted. II Preliminary Review Meeting On the date set, after receipt of formal application, a preliminary review s meeting will be held to review and discuss the project concept. Attending this meeting should be the developer, the Design Team and, if available, the Con- tractor. Sufficient documents, including'a code descriptive analysis of the -� project should be presented at the meeting in order to determine the scope of the project. The Department will invite to the meeting any reabers of its staff and repre- sentatives of other City Departments or ct_zer regulatory agencies which it dears necessary to determine if any advance approvals or special conditions are applicable. Presentation should indicate justification and capability to pro- ceed and maintain progress of design and cb-nst_► action within tiro frare agreed upon, If the project is accepted in principle, at this tire, a second meting date will be set for finalization and documentation of phssinc and guidelines. 7 Y A PROCEDURE AND GUIDELINES III Second Meeting -- Establishment of Guidelines and Agreements The developer must have the Design Team and the contractor present at this meeting. Detailed design and construction schedules are re- quired together with anticipated times of occupancy. The Department will have representatives from all Sections, including the Fire Prevention Bureau and other Departments, if found necessary. Plans submitted at this time should contain all necessary information for zoning evaluation. Two sets of plans are required and will be retained by the Department for review by the Zoning Section for com- pliance, with a fee charged as specified for Dry Run Plan Review in the Permit Fee Schedule. Agreement will not be finalized until it is determined whether the project meets all zoning restrictions under the Zoning Ordinance for the City of Miami, Ordinance No. 9500 As Amended. Exiting concepts should be included for general review by the Fire Prevention Bureau representative. IV Agreement Within ten (10) working days of the Second Meeting, the developer will be notified if the project meets the provisions of the City of Miami Zoning Ordinance. If it is in compliance a written agreement will be prepared and the developer notified when it will be ready for execution. This agreement will include all items agreed to at the Second Meeting including but not limited to scheduling and phasing of construction and safeguards as needed. If found necessary, for timely plans re- view and inspections, provisions will be indicated for financing re- cruitment of qualified consultants. See Sample Form No. 2 for proposed text of agreement and execution. V General Procedure 1. Submittal of plans for review for each phase as approved and issuance of partial permit. 2. Full fee will be charged on initial permit other than site pregr- aration, construction fencing, etc. (Example - Foundation Permit). 3. Sub -Contractor's Permits such as Electrical, Plumbing, HVAC, Elevator, etc. will not be issued until detailed plans for those systems have been submitted and approved. Exception: For subsurface Fork in conjunction with a foundation permit. 4. A full permit fee will be required at the time of issuance of initial partial permit. Developers over the years have requested permitting a Building Project on a Fast Track method. The Department, in a few cases, has allowed this when they showed a need to begin construction prior to the completion of plans and the normal plan review. However, procedures and guidelines and means of reimbursing the City for the additional work of reviewing plans and inspection was not available. Therefore, a committee made up of Architects, Engineers, Developers, Contractors and City Staff was created to first determine whether there is a real need for the process, and second to formulate a set of procedures and guidelines to insure that the public is protected and the buildings are safe and built according to codes. The committee also discussed special fees to be charged to the developer to defray the additonal cost to the City by allowing them to proceed ' under a Fast Track schedule. Included in this package are the Procedures and Guidelines, sample forms which will be used by the applicant and a proposed fee schedule, as approved by the committee. Howard V. Gary City Manager -2- August 29, 1984 The committee also decided that the title, Phased Design and Construc- tion, would better identify this type of procedure rather than Fast Track. However, Fast Track was included in the text since this is the term that is known throughout the construction industry. Benefits 1. To the Developer a) Will be able to start construction at an earlier date, taking advantage of available money at lower interest rate. b) Will realize profits sooner due to earlier completion of project.. c) Examples: The developer will be able to start construction at an earlier date and thereby complete construction of project sooner. Time savings may be from two to three months depending on size of project. - Completing the project sooner than if construction proceeded at normal schedule generates a cost savings, such as: 1) Interest saving on land carry cost. Example: Taking a 100 unit apartment building at a construction cost of $5,000,000.00, and a land cost of $750,000.00, assuming a time saving of two (2) months and a prime rate of interest at 12%. savings for the land carry at 12% for two months will be $15,000.00. • 2) Start earning revenue at an earlier date. Example: same as above for 1. Net earnings for the 100 unit apartment building after expenses is assumed to be $80,000.00 per year. Therefore, earnings of approximately $13,000.00 can be anticipated for the two month period. 3) A possible savings can be derived from ability to take advantage of money when available at a lower rate than it may be two or three months later and also on cost of construction materials.' It follows that the larger the project the greater the benefits to the developer. y Howard V. Gary City Manager -3- August 29, 1984 on a condominium there would be an added benefit in that at various stages of construction, prospective buyers are re- quired to pay a certain percentage of selling price. This method therefore makes the money available at an earlier date for reinvestment or use for required construction money. The estimated savings which would be mainly interest savings is approximately 4%. This 4% was derived after consulting with developers. 2. To the City Placement in tax roll upon completion of the project will generate revenues at an earlier date.
