HomeMy WebLinkAboutO-09907J-84-803 ORDINANCE NO. 99 9 q AN EMERGENCY ORDINANCE ESTABLISHING A SPECIAL ASSESSMENT FUND IN THE AMOUNT OF $2,000,000 FOR THE PURPOSE OF RECORDING ASSESSMENT LIEN ACTIVITY FOR FY'84 AND EACH ENSUING FISCAL YEAR, REVENUE WILL BE EQUAL TO THE ESTIMATED CASH COLLECTION OF ASSESSMENT LIENS AND TRANSFERRED TO THE GENERAL OBLIGATION DEBT SERVICE FUND TO PROVIDE AN ADDITIONAL RESOURCE FOR THE REPAYMENT OF MATURING PRINCIPAL AND INTEREST ON OUTSTANDING GENERAL OBLIGATION BOND ISSUES APPROVED BY THE CITY COMMISSION' CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami frequently makes special assessments on property owners who benefit from public improvements; and WHEREAS, examples of said improvements include pavement of streets and laying of sanitary and storm sewers, which add to the value of property; and WHEREAS, the City establishes an official list showing the amount of special assessments levied against such property benefited by an improvement or service; and WHEREAS, the City prepares assessment lien notices and mails same to property owners benefiting from a specific improvement or service to help defray the total cost of said improvements; and WHEREAS, generally accepted accounting principals as outlined by the Governmental Finance Officers Association dictates that the establishment of a Special Assessment Fund is required to record the cash collection from assessment liens; and WHEREAS, the City is desirous of being in compliance with this requirement as of September 30, 1984; NOW, THEREFORE, BE IT ORDAINED BY THE COISMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Assessment Fund is hereby established and resources are hereby appropriated as described herein: Fund Title: Special Assessment Fund Resources: Annual Collection of Assessment Liens $2,000,000 Appropriation: Special Assessment Fund $2,000,000 Section 2. The herein Special Assessment Fund is established for the purpose of recording assessment lien activity for FY'84 and each ensuing fiscal year. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this ordinance shall be held to be invalid, the remaining provisions of this ordinance shall not be affected. Section S. The requirement of reading this ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission.. Section 6. This ordinance -is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety and property of the City of Miami and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Garcia REFERENCES: Director of Finance ,t_� _ ENCLOSURES: It is recommended that the attached Emergency Ordinance establishing a Special Assessment Fund in the amount of $2,000,000 for the purpose of recording assessment lien activity for FY-84 and each ensuing fiscal year, revenue will be equal to the estimated cash collection of assess- ment liens and transferred to the General Obligation Debt Service Fund to provide an additional resource for the repayment of maturing principal and interest on outstanding general obligation bond issues approved by the City Commission, be passed. This ordinance is necessary to establish a fund for the 4x collection of assessment liens. These funds are then a transferred to the Debt Service Fund to assist in paying off the general obligation debt of the C i ty .
